U. n. 5 dell’8 gennaio 2014), in vigore dal 7 febbraio 2014, analizza tutta L’EVOLUZIONE NORMATIVA succedutasi per affermare la totale equiparazione tra figli legittimi e naturali. Sono stati aboliti i pregressi distinti stati di filiazione, nonché la categoria dei figli non riconoscibili, con l’affermazione dell’unicità dello stato giuridico di figlio. Inoltre è stata introdotta una disciplina incentrata sulla figura del figlio, con il superamento del tradizionale concetto di potestà in favore della RESPONSABILITÀ GENITORIALE. Sono state dettate nuove norme in tema di riconoscimento, azioni di stato, PROVA DELLA FILIAZIONE, inserimento del figlio nato fuori del matrimonio nella famiglia del genitore, specificazione della nozione di abbandono, diritto internazionale privato, in parte recependo gli orientamenti nel tempo maturati nella giurisprudenza costituzionale e di legittimità. Sono state specificamente regolamentate le forme con le quali gli ascendenti possono far valere il loro diritto a mantenere rapporti significativi con i nipoti minorenni e le modalità con cui deve essere realizzato L’ASCOLTO DEL MINORE, privilegiando la spontaneità e genuinità delle relative dichiarazioni. È stato ribadito il fondamentale diritto del figlio di vivere e crescere nella propria famiglia di origine e sono state introdotte importanti modifiche in materia di successione mortis causa. - Dai filii iusti o legitimi ed i figli naturales o vulgo concepti alla equiparazione della filiazione legittima e naturale. Le decisioni della Corte europea dei diritti dell’uomo- La legge 10 dicembre 2012, n. 219 recante le “Disposizioni in materia di riconoscimento dei figli naturali”. L’unificazione dello stato di figlio- Il percorso di parificazione tra famiglia legittima e famiglia naturale- Famiglia, famiglie. Book excerpt: The aim of the book is to present the path the Romans followed in shaping the culture of the ruling classes of the Allies between the years of the conquest in the 4th and 3rd centuries BC and the age of Augustus, when a unified culture of Italy emerges as a pillar of imperial power. Taking ananthropological approach, Mario Torelli places special emphasis on the religious values and cult traditions that developed during the archaic period and the early attempts to colonize Latium, and which were subsequently spread by the Romans throughout Italy by means of Latin colonies. Formaltemples of Latin (or, in south Italy, Greek) tradition enjoyed a special prestige among the Italic tribes and played a fundamental role in the construction of the urban ideal, one of the main principles of cultural transformation. The book also puts under scrutiny the survival of indigenous peoplesin particular areas, such as Daunia and Lucania, and great attention is given to the evidence provided by such ethnic groups of resistance and counter-acculturation in Etruria, Lucania, and elsewhere in Italy.
