In this process, planners employ a variety of disciplines, including law. However, the law is only an instrument of urban planning, and cannot solve all urban problems or meet all social needs. The ability of the legal system to implement the planning process is limited by philosophical, historical, and constitutional constraints. Jurisprudence is concerned with societal values and relationships that limit the effectiveness of the law as an instrument of urban planning. When law is definite and certain, freedom is enhanced within the boundaries created by the law. This doctrine of Anglo-American law imposes an obligation on courts to be guided by prior judicial decision or precedents and, when deciding similar matters, to follow the previously established rule unless the case is distinguishable due to facts or changed social, political, or economic conditions The author focuses on seven specific areas of law in relation to land use planning: law as an instrument of planning, zoning, exclusionary zoning and managed growth, subdivision regulations, site plan review and planned unit development, eminent domain, and the transfer of development rights. Book excerpt: Using Science to Improve the BLM Wild Horse and Burro Program: A Way Forward reviews the science that underpins the Bureau of Land Management's oversight of free-ranging horses and burros on federal public lands in the western United States, concluding that constructive changes could be implemented. The Wild Horse and Burro Program has not used scientifically rigorous methods to estimate the population sizes of horses and burros, to model the effects of management actions on the animals, or to assess the availability and use of forage on rangelands. Evidence suggests that horse populations are growing by 15 to 20 percent each year, a level that is unsustainable for maintaining healthy horse populations as well as healthy ecosystems. Promising fertility-control methods are available to help limit this population growth, however. In addition, science-based methods exist for improving population estimates, predicting the effects of management practices in order to maintain genetically diverse, healthy populations, and estimating the productivity of rangelands. Greater transparency in how science-based methods are used to inform management decisions may help increase public confidence in the Wild Horse and Burro Program.

Book excerpt: This volume deals with land degradation, which is occurring in almost all terrestrial biomes and agro-ecologies, in both low and high income countries and is stretching to about 30% of the total global land area. About three billion people reside in these degraded lands. However, the impact of land degradation is especially severe on livelihoods of the poor who heavily depend on natural resources. The annual global cost of land degradation due to land use and cover change (LUCC) and lower cropland and rangeland productivity is estimated to be about 300 billion USD. Sub-Saharan Africa (SSA) accounts for the largest share (22%) of the total global cost of land degradation. Only about 38% of the cost of land degradation due to LUCC - which accounts for 78% of the US$300 billion loss – is borne by land users and the remaining share (62%) is borne by consumers of ecosystem services off the farm. The results in this volume indicate that reversing land degradation trends makes both economic sense, and has multiple social and environmental benefits. On average, one US dollar investment into restoration of degraded land returns five US dollars. The findings of the country case studies call for increased investments into the rehabilitation and restoration of degraded lands, including through such institutional and policy measures as strengthening community participation for sustainable land management, enhancing government effectiveness and rule of law, improving access to markets and rural services, and securing land tenure. The assessment in this volume has been conducted at a time when there is an elevated interest in private land investments and when global efforts to achieve sustainable development objectives have intensified. In this regard, the results of this volume can contribute significantly to the ongoing policy debate and efforts to design strategies for achieving sustainable development goals and related efforts to address land degradation and halt biodiversity loss.
