Book excerpt: Superfund cleanup timing has been a long-standing concern of the Congress & EPA. In the Superfund Amendments & Reauthorization Act of 1986, the Congress set time goals for EPA & federal agencies to evaluate individual nonfederal & federal sites for placement on the National Priorities List (NPL) & begin various cleanup actions. In 1992, EPA introduced several initiatives designed to expedite Superfund cleanups. This report examines trends in the time taken to evaluate & process hazardous waste sites for possible placement on the NPL & to clean up these sites following their listing. Tables & graphs.

Available in PDF, EPUB and Kindle. Book excerpt: The EPA's Superfund & Resource Conservation & Recovery Act (RCRA) programs were established to clean up hazardous waste sites. Because some sites cannot be cleaned up to allow unrestricted use, institutional controls -- legal or administrative restrictions on land or resource use to protect against exposure to the residual contamination -- are placed on them. This report reviews the extent to which: (1) institutional controls are used at Superfund & RCRA sites; & (2) EPA ensures that these controls are implemented, monitored, & enforced. Also reviews EPA's challenges in implementing control tracking systems. This report examined the use, implementation, monitoring, & enforcement of controls at a sample of 268 sites. Charts & tables.

Available in PDF, EPUB and Kindle. Book excerpt: While more than 2,700 emergency removals of hazardous materials have taken place under Superfund, implementing the long-term cleanup program has been the object of considerable controversy. One of the most contentious issues is whether the liability standards in the law should be revised. The authors analyze the pros and cons associated with the current liability approach, as well as with a variety of alternative strategies.

Book excerpt: Pursuant to a congressional request, GAO reviewed the Environmental Protection Agency's (EPA) Superfund cleanup efforts, focusing on comparing EPA's estimate of future cleanup times compared with the program's historical performance. GAO noted that: (1) as of July 1, 1997, remedial action had been completed at 13 percent (95) of the 752 sites placed on the National Priorities List in fiscal years 1986 through 1994; (2) these remedial actions were completed in an average of 6.3 years after the sites were listed; (3) as of the same date, remedial action had not been completed at 87 percent (657) of the sites listed in fiscal years 1986 through 1994; (4) these uncompleted sites had been in the cleanup process an average of 8.1 years, that is, they had been listed on the National Priorities List an average of 8.1 years earlier; (5) assuming that all remedial actions at these "in process" sites had been completed on July 1, 1997, the average cleanup duration for all sites listed on the National Priorities List during the 9-year period would have been 7.9 years, almost as long as EPA's 8-year estimate of the cleanup time for recently listed sites; (6) because such a larger proportion of the sites listed in the 9-year period are still in process, the average cleanup time for these sites will exceed 8 years, possibly by a substantial margin; and (7) furthermore, for EPA to meet its 8-year estimate for cleaning up recently listed sites will require much faster cleanup times than the program has produced in the past.

Book excerpt: Under the Superfund program, the Environmental Protection Agency (EPA) may address the long-term cleanup of certain hazardous waste sites by placing them on the Nat. Priorities List (NPL) and overseeing the cleanup. EPA regions have discretion to choose among several other approaches to address sites eligible for the NPL. For ex., under the Superfund program, EPA regions may enter into agreements with PRPs using the SA approach. EPA may also defer the oversight of cleanup at eligible sites to approaches outside of the Superfund program. This report examines (1) how EPA addresses the cleanup of sites it has identified as eligible for the NPL; (2) how the processes for implementing the SA and NPL approaches compare; and (3) how SA agreement sites compare with similar NPL sites in completing the cleanup process. Tables and figures. This is a print on demand report.

Book excerpt: " Under the Superfund program, EPA may address the long-term cleanup of certain hazardous waste sites by placing them on the NPL and overseeing the cleanup. To be eligible for the NPL, a site must be sufficiently contaminated, among other things. EPA regions have discretion to choose among several other approaches to address sites eligible for the NPL. For example, under the Superfund program, EPA regions may enter into agreements with PRPs using the SA approach. EPA may also defer the oversight of cleanup at eligible sites to approaches outside of the Superfund program. GAO was asked to review EPA's implementation of the SA approach and how it compares with the NPL approach. This report examines (1) how EPA addresses the cleanup of sites it has identified as eligible for the NPL, (2) how the processes for implementing the SA and NPL approaches compare, and (3) how SA agreement sites compare with similar NPL sites in completing the cleanup process. GAO reviewed applicable laws, regulations, and guidance; analyzed program data as of December 2012; interviewed EPA officials; and compared SA agreement sites with 74 NPL sites selected based on their similarity to SA agreement sites.
