Book excerpt: In Imposing Standards, Martin Hearson shifts the focus of political rhetoric regarding international tax rules from tax havens and the Global North to the damaging impact of this regime on the Global South. Even when not exploited by tax dodgers, international tax standards place severe limits on the ability of developing countries to tax businesses, denying the Global South access to much-needed revenue. The international rules that allow tax avoidance by multinational corporations have dominated political debate about international tax in the United States and Europe, especially since the global financial crisis of 2007–2008. Hearson asks how developing countries willingly gave up their right to tax foreign companies, charting their assimilation into an OECD-led regime from the days of early independence to the present day. Based on interviews with treaty negotiators, policymakers and lobbyists, as well as observation at intergovernmental meetings, archival research, and fieldwork in Africa and Asia, Imposing Standards shows that capacity constraints and imperfect negotiation strategies in developing countries were exploited by capital-exporting states, shielding multinationals from taxation and depriving nations in the Global South of revenue they both need and deserve. Drawing on this impressive data set, Downes shows that regime change increases the likelihood of civil war and violent leader removal in target states and fails to reduce the probability of conflict between intervening states and their targets. As Downes demonstrates, when a state confronts an obstinate or dangerous adversary, the lure of toppling its government and establishing a friendly administration is strong. The historical record, however, shows that foreign-imposed regime change is, in the long term, neither cheap, easy, nor consistently successful. The strategic impulse to forcibly oust antagonistic or non-compliant regimes overlooks two key facts. First, the act of overthrowing a foreign government sometimes causes its military to disintegrate, sending thousands of armed men into the countryside where they often wage an insurgency against the intervener. Second, externally-imposed leaders face a domestic audience in addition to an external one, and the two typically want different things. These divergent preferences place imposed leaders in a quandary: taking actions that please one invariably alienates the other. Regime change thus drives a wedge between external patrons and their domestic protégés or between protégés and their people. Catastrophic Success provides sober counsel for leaders and diplomats. Regime change may appear an expeditious solution, but states are usually better off relying on other tools of influence, such as diplomacy. Regime change, Downes urges, should be reserved for exceptional cases. Interveners must recognize that, absent a rare set of promising preconditions, regime change often instigates a new period of uncertainty and conflict that impedes their interests from being realized.

At the same time, artificial intelligence, deep learning, machine learning, cognitive computing, blockchain, virtual reality and augmented reality, belong to the fields most likely to affect law and, in particular, administrative law. The book examines universally applicable patterns in administrative decisions and judicial rulings. Liberalism has always favored limited government, but there has been wide-ranging dispute among liberals about just how extensive the scope of government should be. Included in this dispute are questions about the extent of state ownership of the means of production, redistribution of wealth and income through the tax code and transfer programs, and the extent of government regulation. One of N. Scott Arnold's goals is to give an accurate characterization of both modern liberalism and classical liberalism, explaining along the way why libertarianism is not the only form that classical liberalism can take. The main focus of Arnold's book, however, concerns regulation--specifically, the modern liberal regulatory agenda as it has taken shape in contemporary American society. This is the set of regulatory regimes favored by all modern liberals and opposed by all classical liberals. It includes contemporary employment law in all its manifestations, health and safety regulation, and land use regulation. The heart of the book consists of a systematic evaluation of arguments for and against all the items on this agenda. It turns out that there are good arguments on both sides for most of these regulatory regimes. Because of this, and because someone's vision of the proper scope of government will ultimately prevail, some procedural requirements that all liberals could agree to must be satisfied for one side to impose legitimately its values on the polity at large. These procedural requirements are identified, argued for, and then applied to the elements of the modern liberal regulatory agenda. Arnold argues that many, though not all, of these elements have been illegitimately imposed on American society.

Available in PDF, EPUB and Kindle. Book excerpt: How do modern states emerge from the turmoil of undergoverned spaces? This is the question Reo Matsuzaki ponders in Statebuilding by Imposition. Comparing Taiwan and the Philippines under the colonial rule of Japan and the United States, in the late nineteenth and early twentieth centuries, he shows similar situations produce different outcomes and yet lead us to one conclusion. Contemporary statebuilding efforts by the US and the UN start from the premise that strong states can and should be constructed through the establishment of representative government institutions, a liberalized economy, and laws that protect private property and advance personal liberties. But when statebuilding runs into widespread popular resistance, as it did in both Taiwan the Philippines, statebuilding success depends on reconfiguring the very fabric of society, embracing local elites rather than the broad population, and giving elites the power to discipline the people. In Taiwan under Japanese rule, local elites behaved as obedient and effective intermediaries and contributed to government authority; in the Philippines under US rule, they became the very cause of the state's weakness by aggrandizing wealth, corrupting the bureaucracy, and obstructing policy enforcement. As Statebuilding by Imposition details, Taiwanese and Filipino history teaches us that the imposition of democracy is no guarantee of success when forming a new state and that illiberal actions may actually be more effective. Matsuzaki's controversial political history forces us to question whether statebuilding, given what it would take for this to result in the construction of a strong state, is the best way to address undergoverned spaces in the world today.
