In 417, or per cent, of the 516 cities reporting, the board is elected by the people; and in 99, or per cent, it is appointed by the mayor, city council, or commission. Of the 99 boards appointed, 32 are appointed by the mayor and 67 by the council or commission. Most of the States having general laws regarding the method Of choosing city school boards provide for election by the people. (see p. Students of school administration almost without exception favor an elec tive board, especially in the smaller cities. They say that appointment by the mayor or city council places the schools too far away from the people, and that the people take more interest in the schools if they elect the board. It is pointed out that in some cities where boards are appointed the mayor or the members of the city council control the schools to a very great degree, so' that anyone seeking an appointment or a contract needs only to Obtain the approval of the mayor or the members of the council. In brief, an appointive board is too often the tool of the mayor or council, many times not working for the inter est Of the schools but for the interest of party. If the council appoints, there is temptation on the part of its individual members to dictate policies to the school board and to influence it to elect such janitors and teachers as they may suggest. In other words, appointment by either the mayor or city council tends to entangle the schools in petty city and ward politics. We are told that the American city council has proved itself in practice unfit to be trusted. Its powers have been taken away only because it has abused them. Whatever methods of election or of organization have been tried, it has been found impossible to secure good council men. The system of council rule worked well enough in the early days, with simple administrative problems and a compara tively high qualification for the electorate. But with the intro duction of universal suffrage, the influx of foreign immigrants, the intrusion of party politics and the growth of municipal functions, the system broke down completely. These state ments are usually made as if they were self-evident common places of history. Seldom is any detailed study brought to their support. But historical evidence must be handled with the greatest care in order to be conclusive. Failure rightly to analyze causes and effects and to take account of differences in conditions is apt to vitiate our reasoning. Not yet have we suflicient knowledge of municipal history or suflicient outlook into the future to justify dogmatic conclusions as to the relative success of council rule and mayor rule. A few considerations may be presented, however, which show how comparatively weak is this argument in favor of the mayor system from our experience in city government. Book excerpt: Excerpt from The State's Provisions for Higher Education: January 19, 1942 The four institutions of higher education were all opened within three or four years after their establishment, Each was under the control of a local executive board, under the general supervision of the state board of education. In 1909, the powers of the local executive boards were more closely defined and the state board of education assumed more power. In 1915, the four institutions of higher education were combined into the University of Montana, under the executive control of an officer, titled chancellor. This officer was appointed in 1915, and opened the chancellor's office in 1916. However, the local executive boards were retained, and still exist, even though their functions were taken from them. In 1953, legislative appropriation for the posi tion of chancellor was discontinued and the office of the chancellor was left in charge of the executive secretary, who had worked in the central office under the chancellor. Still later, the office of the executive secretary became vacant, and an office employe became acting executive secretary. The presidents now serve directly under the state board of education and for matters of common con cern the presidents form a council to advise the board. In 1927, the legislative assembly established Eastern Montana Normal School. This school was located by the state board of education at Billings. And in case of the death, removal, resignation, or necessary absence of the governor from the Territory, the secretary shall be and he is hereby authorized and required to execute and perform all the powers and the duties of the governor during such vacancy or necessary absence, or until another governor shall be duly appointed to fill such vacancy. Sec. 4. And be it' further enacted, That the legislative power and authority of said Territory shall be vested in the governor and a legislative assembly. The legislative assembly shall consist of a council and house of representatives. The council shall consist of nine members having the quali fications of voters, as hereinafter prescribed, whose term of service shall continue two years. The house of representatives shall, at its first session, consist of eighteen members, possessing the same qualifications as prescribed for members of the council, and whose term of service shall continue one year. The number of councilors and representatives may be increased by the legislative assembly, from time to time, in proportion to the increase of population; provided, that the whole number shall never exceed fifteen councilors and thirty-nine representatives. An apportionment shall be made, as nearly equal as practicable, among the several counties or districts for the election of the council and representatives, giving to each section of the Territory representation in the ratio of its population, Indians excepted, as nearly as may be. And the members of the council and of the house of representatives shall reside in and be inhabitants of the districts for Which' they may be elected, respectively. Previous to the first election, the gov ernor shall cause a census or enumeration of the inhabitants of the several counties and districts of the Territory to be taken, and the first election shall be held at such time and places and be conducted in such manner as the. Governor shall appoint and direct; and he shall, at the same time, declare the number of members of the council and house of representatives to which each of the counties and districts shall be entitled under this act. The subject, however, is so large that even that amount of time has meant that the work has been done under great pressure and in haste. It would have been impossible but for the helpful and courteous cooperation of a number of people. It was the intention to acknowledge their help by name but the list has grown so long that none could be mentioned without distinctions that would be unfortunate. The writer wishes therefore to make, at once, acknowledgment to the officials of a large number of war chests, to the officers of the Fosdick Commission, the Red Cross, the Y. M. C. A., the War Camp Community Service, and to many others who have given a great deal of assistance. Book excerpt: Excerpt from First Annual Report of the State Department of Health of Massachusetts, 1916 Section 2. The commissioner of health shall be appointed by the governor, with the advice and consent of the council, and he shall be a physician skilled in sanitary science and experienced in public health administration. The term of office of the commissioner of health shall be five years. He shall receive an annual salary of seventy - five hundred dollars and shall devote his entire time to his official duties. The commissioner of health shall be the administrative head of the state department of health. His powers and duties shall be to administer the laws relative to health and sanitation and the regulations of the department; to prepare rules and regulations for the consideration of the public health council; and, with the approval of the public health council, to appoint and remove directors of divisions, district health ofiicers, inspectors and other necessary employees, and to fix their compensation, subject to the approval of the governor and council, within the limitations of appropriations therefor. Directors of divisions and district health officers shall be exempt from civil service regulations. The commissioner of health shall submit annually to the public health council a report containing recommendations in regard to health legislation; and he shall perform all executive duties now required by law of the state board of health and Such other duties as are incident to his position as chief executive officer. He may direct any executive officer or employee of the state department of health to assist in the study, suppression or prevention of disease in any part of the commonwealth.
