Book excerpt: Cette thèse s'inscrit dans le cadre des transferts d'entreprises que l'on peut définir comme une opération de croissance externe et de leurs effets sur le comportement des salariés. L'originalité de cette étude repose sur la volonté d'expliquer un phénomène constaté en gestion des ressources humaines (le syndrome du survivant) par une autre discipline, le droit régissant les opérations de croissance externe. Le spratiques de gestion des ressource shumaines s'expliquent en partie par le cadre institutionnel et juridique qui encadre les opérations de transfert. Après une étude comparative des règles de droit régissant le transfert des entreprises en Europe, il ressort un principe général du maintien des contrats de travail qui comprend deux exceptions. La première exception à ce principe général concerne le droit allemand qui reconnaît un droit d'opposition au transfert automatique au bénéfice des salariés allemands. La seconde exception est française et s'applique aux journalistes au travers des clauses de conscience et cession qui leur permettent de quitter volontairement leur journal. Ce constat conduit à la question de recherche suivante : le droit d'opposition au transfert de contrat de travail, issu du bénéfice de la clause de cession, influence-t -il l'apparition du syndrome du survivant? L'apport de cette recherche est théorique (extension des recherches sur le syndrome du survivant aux opérations de croissance externe) et pratique (les effets d'un droit d'opposition sur le management des salariés restants).

Book excerpt: Le développement des formes d’emploi atypiques (intérim, CDD, temps partiel...) constitue l’un des traits marquants de l’évolution récente du marché du travail en France. Ce développement, qui résulte en partie des besoins de flexibilité dans la gestion de la main d’oeuvre exprimés par les entreprises, suscite des interrogations dans le champ de la gestion des ressources humaines. Les questions principales portent sur les impacts possibles de ces nouvelles relations d’emploi sur les attitudes et les comportements des salariés qui s’y trouvent confrontés. Notre travail porte plus spécifiquement sur les impacts des arrangements contractuels atypiques sur l’implication au travail. Le concept d’implication au travail (work commitment), qui permet de décrire la relation qu’un individu entretient avec les différents objets liés à sa sphère professionnelle (le travail en tant que tel, la profession, l’organisation, le groupe de collègues, le syndicat, etc....) apparaît comme prédicteur d’un certain nombre de comportements organisationnels. (absentéisme, turnover, effort au travail...), et suscite donc à ce titre l’intérêt des chercheurs et des praticiens des ressources humaines. La plupart des données empiriques dont nous disposons sur le sujet de l’implication au travail ont été obtenues en étudiant les salariés en situation d’emploi permanent. Il paraît donc intéressant aujourd’hui de se demander si la remise en cause progressive de la norme de travail typique a des impacts à la fois théoriques et pratiques sur l’implication des salariés, et, le cas échéant, de déterminer quels sont ces impacts. Notre recherche a été menée auprès de salariés intérimaires, qui forment une population très représentative des nouvelles formes d’emploi, et constituent un terrain d’étude intéressant, notamment en raison du fort développement de ce type de contrats en France. Une revue de la littérature théorique sur l’implication des salariés « précaires » conduit à poser l’hypothèse que ceux-ci se trouvent dans une situation d’insécurité qui n’est pas favorable à leur implication : une majorité d’auteurs considèrent qu’il existe un lien négatif entre précarité de la relation salariale et implication au travail. Les recherches empiriques menées sur ces catégories de salariés, conduisent paradoxalement à des résultats très contrastés, qui ne permettent pas de valider sans réserve cette hypothèse de départ. Cette absence de consensus dans la littérature nous a tout d’abord conduits à nous interroger sur la pertinence de la transposition de notion d’implication au travail au cas des salariés intérimaires, puis à proposer un modèle qui vise à approfondir l’étude du lien entre une forme d’emploi particulière et l’implication au travail, et qui soit apte à rendre compte de l’hétérogénéité des résultats empiriques. Notre modèle cherche à montrer que le statut d’emploi n’est pas en lui-même un obstacle à l’implication : tout dépend notamment de la manière dont les salariés intérimaires interprètent leur relation d’emploi, à travers la notion de précarité subjective, ou précarité perçue. Une étude qualitative exploratoire nous a permis de construire un questionnaire adapté à la population étudiée. Les résultats obtenus nous ont permis de valider la plupart des hypothèses formulées. Nous avons notamment mis en lumière le rôle médiateur de la précarité perçue sur la relation entre précarité objective des contrats temporaires et implication au travail, et montré que l’employabilité perçue et le degré de préférence pour l’intérim influent significativement sur la précarité perçue. Ces résultats nous ont permis dans un second temps de proposer une typologie des salariés intérimaires apte à rendre compte de l’hétérogénéité de leurs trajectoires et de leurs attitudes.
