Book excerpt: To ensure that a driver's license is revoked promptly when a test shows an alcohol concentration of 0.10 or more, regardless of court outcome or plea bargaining on the criminal charge, Minnesota adopted an administrative revocation law 1976, adding to the conventional implied consent revocation for refusing to take the test. This law was unique to Minnesota until 1981 when two other jurisdictions passed similar laws. In 1982 three more, and in 1983 thirteen more states established similar prompt revocation on test result systems. The author describes the Minnesota law as amended in 1982 and discusses legal and constitutional issues. Effect on apprehension rates, swiftness of sanction, deterrence and perceived risk are analyzed. The author concludes that a two-track DWI control system employing both prompt administrative driver license sanctions on one track and conventional court action on a related but not directly connected parallel criminal track enhances deterrence through more certain, swift penalty, perceived by drivers as severe.

Book excerpt: Tennessee remains one of eight states relying on the judicial system to suspend a drunken driver's license instead of an administrative process. Federal agencies and special interest groups such as Mothers Against Drunk Driving (MADD) and the Insurance Institute for Highway Safety press for Administrative License Suspension (ALS) laws arguing these laws reduce drunken driving. While some research supports this view, there is an equally and more compelling literature indicating ALS laws are not effective in reducing drunken driving. This study analyzed data from eight states that have adopted ALS laws to determine if the ALS laws reduced drunken driving. A selection process was employed that identified eight diverse states without factors that might confound the results. For each of the eight states, single vehicle nighttime (SVN) crash fatalities and driver fatalities with blood alcohol concentration of .01 or greater (BAC .01[arrow up]) were analyzed. An auto-regressive with an integrated moving average (ARIMA) statistical model was used to compare 36 months of pre-ALS law data to 36 months of post-ALS law data for each state. If the ALS laws reduce drunken driving, then a statistically significant change should be observed in the data at the ALS law's intervention date. However, only one state showed a possible reduction in drunken driving in just one of its major drunken driving proxies. The remaining states' data indicate the ALS laws had no effect on drunken driving. The analyses as a whole support the conclusion that ALS laws do not deter drunken drivers.

Book excerpt: The most effective measures to deter drunken driving are legal actions that provide for certain, serious, and swift sanctions. An administrative per se statute that summarily revokes or suspends a driver's license for a DUI offense satisfies these criteria. Because the revocation would be imposed by an administrative, rather than a judicial, system, concerns about due process violations have been raised. Although the Supreme Court has never directly ruled on the constitutionality of an administrative per se statute, its rulings in other cases provide indications of what would be required for such a statute to be found constitutional. This report reviews the relevant cases on the issues of due process and double jeopardy. It also discusses the statutes and experience of states with per se laws and studies that document the impact of such laws. In addition to deterring drunken driving, enactment of an administrative per se statute would benefit Virginia by bringing the Commonwealth one step closer to qualifying for additional federal funds.
