Book excerpt: Proliferation of weapons of mass destruction (WMD), terrorism, and the nexus between the two are inarguably among the greatest threats facing international peace and security today. In 2004, the United Nations Security Council adopted Resolution 1540, obligating states to take steps to counter the proliferation of chemical, biological and nuclear weapons to non-state actors. Regional organizations are widely considered an important part of the puzzle to implement Resolution 1540. To that end, this thesis analyses the oft-overlooked complementary relationship between regional organizations and the United Nations in maintaining global peace and security. It demonstrates that regional bodies have evolved throughout history to become assistant guardians, together with the UN, against regional and international perils. In turn, it explores the opportunities and limitations of regional bodies--specifically the League of Arab States and the Gulf Cooperation Council (GCC)--in the Middle East to assist their memberships in complying with the Resolution 1540. This region was selected because of its relatively low 1540 implementation rates, porous borders, lax export controls, challenges stemming from transnational crime, and the increased interest in nuclear power--all which make Middle Eastern states attractive and prone to being exploitation by non-state actors seeking to acquire WMD or transfer such devices through the region. The thesis concludes that key features of the League of Arab States and the GCC--scope and focus, current and evolving institutional infrastructure, and ongoing and prior work related to 1540 implementation--make them appropriate bodies that can effectively assist their membership with 1540 implementation. Policy recommendations include that the League of Arab States and the GCC request assistance available under 1540's mandate to employ a dual-hatted 1540 Coordinator for their overlapping memberships to further 1540 implementation in the Middle East.

It assesses the institutional context of the 1540 Committee and explores the nature of cooperation between the EU and the Committee, including by identifying gaps in EU reporting on its assistance measures. The paper concludes that although direct EU funding to the work of the 1540 Committee on assistance has been low, the EU has played a valuable role in capacity-building outside of the EU through bilateral and regional cooperation programmes in several relevant functional areas.

Book excerpt: In 2004, recognizing the potentially grave consequences of a weapon of mass destruction (WMD) terrorist attack anywhere in the world, the UN Security Council adopted Resolution 1540, which mandates a comprehensive set of supply-side controls on all States. Since then, governments have worked to varying degrees to ensure compliance with the terms of the Resolution; yet, for a variety of reasons ranging from abject disinterest to a vexing lack of capacity, progress on implementation has been uneven. Since 2004, civil society organizations around the world have demonstrated that they have an integral role to play in both monitoring and assisting States in meeting the objectives of UNSCR 1540. But because the 1540 mandate is ultimately the responsibility of national governments, there can be little doubt that the central role for civil society should be to assess their respective national governments' efforts, and to advocate for enhanced attention to meeting the terms of the Resolution. Of course, this advocacy role need not be the limit to civil society engagement on 1540. In some cases, civil society, think tanks, and other academic and educational institutions with specialized expertise can further expand their efforts in supporting States in their compliance efforts. Examples of civil society engagement may ultimately include undertaking legal gap analyses, conducting targeted training, the provision of specialized expertise, financial assistance, building implementation networks, the identification of external donors, coordinating regional cooperation, and/or the sharing of best practices across national boundaries.

The primary aim of the conference was to promote the concept of a CBRN security culture which recognizes synergy across the individual disciplines. As a first step in the practical application of this synergistic view, the conference introduced assessment methodologies that could be refined and customized to enhance the role of the human factor in CBRN security. This, we hope, will enable countries to fulfill their international obligations and implement United Nations Security Council Resolution 1540. This mandate was extended an additional two years with the adoption of Resolution 1673 (2006) and an additional three years with the adoption of Resolution 1810 (2008). UNSCR 1540 is a key nonproliferation and counterterrorism tool that needs to be implemented well. Its obligations are a core part of nuclear infrastructure development.

Book excerpt: Liberal international relations theories predict that states with respect for the rule of law will more readily comply with their international obligations. This paper tests this prediction against compliance within the nonproliferation regime and specifically with UNSCR 1540, a resolution mandating that member nations enact domestic legislation to counter proliferation of weapons of mass destruction and certain dual use technologies. Using a rule of law measure based upon contract intensive money, the findings lend strong support for a positive relationship between rule of law states and compliance with nonproliferation norms. However, there is no support for the relationship between rule of law and implementation of specific UN-mandated tenets of UNSCR 1540. The influence of regional compliance is strong across both models. This study contributes to an understanding of the predictors of regime compliance, lending support to liberal theory and even the democratic peace literature.This compilation includes a reproduction of the 2019 Worldwide Threat Assessment of the U.S. Intelligence Community.The international community has long sought to limit the spread of weapons of mass destruction (WMD). The most significant efforts have been codified as multilateral agreements-"security regimes"-signed by states, such as the Nuclear Non-proliferation Treaty (NPT), the Convention on Toxin and Biological Weapons (BTWC), and the Chemical Weapons Convention (CWC). Even though efforts to negotiate and ratify these agreements occur at the international level, their success depends upon the behavior of actors within the domestic sphere. Non-state groups and even individuals have stated their desire to acquire WMD, and this possibility remains a key concern of U.S. policy. There is therefore a gap between the obligations incurred by national governments and the potential actions of individuals and groups that have not made these commitments on their own. In order to bridge this gap, states can create domestic enablers to support international regimes. Among the domestic enablers is codification of the regime's tenets in domestic law. In order to understand whether non-proliferation regimes are likely to be effective, we must identify the factors that allow for the domestic enforcement of these agreements. This effort is part of a larger project that seeks to answer: What predicts the success of the non-proliferation regime?
