However, while arrest rates for domestic violence increased throughout the 1990s and 2000s, these cases continue to receive lenient treatment by our courts. Most are resolved with dismissals. Currel-Dykeman explores if the court community literature can offer a possible explanation to this problem. She analyzes the local legal culture of two courts, a traditional court and a specialized problem solving court to understand how they discuss and process domestic violence cases differently. Court workgroup members were interviewed and candidly spoke about these cases in a way that helped explain the problem.

Book excerpt: The Kings County Integrated Domestic Violence (IDV) Court parts adjudicate criminal cases of domestic violence involving defendants who also have Family Court custody, visitation, or family offense petitions pending, and/or a concurrent Supreme Court matrimonial case. This "one family-one judge" model is designed to provide judges and attorneys with more complete information about all the related cases, improving efficiency, ensure consistency of court orders, and enhance victim safety and satisfaction. Although increasing convictions is not an explicit goal of IDV Courts, previous CJA research found that the conviction rates in the Kings County IDV Court in 2007-2009 was considerably higher than in Criminal Court DV cases. The current study follows up on this finding and examines why the conviction rate was higher in IDV Court during this time period.

Some advocates of the policy have endorsed this moral choice, but Sherman argues that domestic violence will continue in spite of, and sometimes because of, our attempts to stop it. Further, while it is possible to predict which couples will continue to suffer abusive behavior, it has been difficult to find effective ways of preventing chronic violence, even when arrests are made.
