Book excerpt: This inquiry was launched in summer 2009 in order to investigate the progress of the EU Better Regulation agenda. The agenda has been running since 2005 with the aim of cutting red tape, reducing administrative burdens and improving the legislative process by means of impact assessment. In January 2009, new Impact Assessment Guidelines were issued, which, among other things, introduced the inclusion of an "SME test", that is, an assessment of the particular impact any likely legislation would have on small businesses, to the standard Commission impact assessment. This report focuses to a large extent on the impact assessment process, in particular how IAs are produced, the role of the Impact Assessment Board in monitoring their quality, and their subsequent use by the European Institutions. The intention of this report is to take the views of various stakeholders in EU better regulation and to suggest areas where further examination might be necessary. It does seem to be the case that the Council of Ministers and the European Parliament are not making as full use of impact assessments as they might. Certain other areas have been highlighted where the situation is unclear and further investigation might be warranted. These include the conformity of IAs to the Guidelines, the production and use of IAs on comitology proposals, the adequacy of consultation exercises in the preparation of assessments, whether the SME test is working and the use of ex-post evaluation

This book identifies the European Union’s impact assessment regime as a source of these norms. In 2002 the European Commission – later followed by the European Parliament and the Council of Ministers – committed to performing rigorous assessment of the economic, social and environmental impacts of policy options before adopting (legislative) proposals. Applying a ‘constitutional lens’ to this ‘regulatory’ topic, Anne Meuwese examines both the details and the framework of IA in EU lawmaking to date, drawing attention to its strengths, its contradictions, and its power to enhance the deliberative quality of legislative debates. Integrating the perspectives of political scientists and economists with the concerns of legal scholars and practitioners, Dr Meuwese describes and interrelates such aspects of the subject as the following: the potential role of impact assessment as a catalyst of legal principles, by emphasising or overriding norms that govern both the procedural and the substantive aspects of the EU legislative process; the ‘constitutional tasks’ of impact assessment as applied to European legislative proposals, especially relating to subsidiarity, proportionality, and the precautionary principle; the formal and informal extension of the scope of impact assessment beyond the co-decision procedure; the question whether impact assessment crosses the line between informing the legislator and fettering legislative discretion. In the course of her analysis Dr Meuwese develops models for possible usages of IA in EU lawmaking, analyses the implementation of impact assessment processes in the European Commission, the European Parliament and the Council as well as the roles of relevant ‘co-actors’, and offers results of empirical research in the forms of a survey of EU legislative practice and in-depth case studies of four EU legislative dossiers.

Book excerpt: EU administrative law is highly fragmented and has never evolved into a consistent set of rules applicable across the EU administration. This fragmentation impinges on the EU’s ability to consistently uphold standards of good governance and administration, as well as to protect citizens’ rights when they interact with the administration. This impact assessment compares the option of 'doing nothing' with two alternative policy options: making the 2001 Code of Good Administrative Behaviour binding vs. adopting the regulatory framework proposed by the European Parliament in 2016. The study concludes that adopting the European Parliament’s regulatory framework would be the preferred option, since it would lead to clear advantages in terms of cost savings for the public, as well as the accessibility, transparency, legal certainty and predictability as well as the legitimacy of, and trust in, EU institutions. This option would also offer additional advantages in terms of its compatibility with Member States’ administrative law and readiness for the transition towards e-government and e-administration tools, which promises further efficiency increases in the EU administration.

Book excerpt: All policy systems are struggling to respond to wicked policy problems like international terrorism, drug crime and unsustainable development, none more so than the European Union (EU) which is renowned for its fluidity, deeply sectorized structures and weak political leadership. As the traditional mode of coordinating - essentially issuing regulation - no longer commands sufficient political support, the EU has turned to what are increasingly termed soft or 'new' modes of governance, which rely upon different actors working together in relatively non-hierarchical networks. New modes of governance are in vogue because they appear to provide the EU with a new way to add value to national level activities without the slow and process of agreeing new legislation or the cost associated with building new administrative capacities in Brussels. This analysis provides the first book-length account of how effective network-based modes are at addressing problems that simultaneously demand greater levels of horizontal and vertical coordination. Taking, as an example, the thirty year struggle to build environmental thinking into all areas and levels of EU policy making, it systematically explores the steps that two major EU institutions (the European Commission and the European Parliament), and three member states (Germany, the Netherlands and the UK) have (not) taken to build effective networked governance. By blending state of the art theories with new empirical findings, it offers a stark reminder that networked governance is not and has never been a panacea. Coordinating networks do not spontaneously 'self organise' in the EU; they have to be carefully designed as part of a repertoire of different coordinating instruments. The book concludes that the EU urgently needs to devote more of its time to the more mundane but important task of auditing and managing network, which, paradoxically, is an exercise in hierarchy. In so doing, this book helps to strip away some of the rhetorical claims made about the novelty and appeal of new modes, to reveal a much more sober and realistic appraisal of their coordinating potential.
