Book excerpt: Excerpt from Illinois Appellate Court Unpublished Opinions, Vol. 320: First Series Of the Probate Gonrt entered May 2, 1941, allowing an additional sum of $750 to the conservator and on additional sum of to Mr. Ads-e, its attorney, was preper, and that the order authorizing the conservator to use the assets of the ward for the purpose of reimbursing itself on account of overdrafts and to make payment on the other items authorized, was also proper. The executrix appeals from this decree. On June 12, 1936 the Probate Court overruled the objections of the executrix and approved the final report, subject to a future hearing upon the question of fees for the conservator and its attorney. No appeal was taken from this order. Prior to the entry of this order there was a full hearing, lasting several days. We agree with.the Circuit court that the order of June 12, 1956 was Egg,49gigg§§ as to the account; The only letter which remained for determination was the question of additional fees; We have carefully inspected the record and are convinced that the additional fees allowed to the conservator and Mr. Adena, its attorney, are reasonable. Perceiving no error in the recordq the decree of the circuit Court of Cook Gounty is affirmed, degree affirmed. He could see the headlights of the truck and fluorescent paint on the back tailgate of the truck and rear reflectors, but he said he did not observe any lighted taillights. He flashed his headlight from high to low beam three or four times and then pulled off into the left lane to pass the 'pickup truck. He was about 100 feet behind the truck when he Started to pass and testified that when he got into the lefthand lane the truck pulled across the center line to make a left turn. He then tried to hit his brakes and gear down and go to the right of the truck, but hit the back end of the truck. It is a misstatement to equate Officer Riggio's testimony with the assertion contained in the State's brief. The officer dis covered that the papers were betting slips only after he had arrested and searched the defendant. The arrest and subse quent search were unlawful since there was no probable cause present to justify the arrest. App. 3d. V. 28 The first possible argument which could be raised on ap peal is that the trial court, in accepting defendant's plea of guilty, failed to comply with Supreme Court Rule 402. (ill. Rev. Stat. 1973, ch. 110a, par. The record reflects that when defendant's case was called, defendant appeared repre sented by privately retained counsel. After a pretrial confer ence with the court, defense counsel in defendant's presence informed the trial judge that defendant wished to enter a plea of guilty. The trial judge informed defendant of the crime charged in each of the indictments by name. Defendant was advised of the possible statutory penalties for each of the crimes charged and of the fact that the sentences could be made to run consecu tively. Defendant stated that he understood that by the enter ing of a plea of guilty, he waived his right to a trial by jury, his right to a bench trial and his right to confront the witnesses against him. The trial judge by questioning defendant ascertained that he understood there had been a pretrial conference with the court and understood the sentences which would be imposed upon a plea of guilty. Thereafter, the facts which provided the basis for each of the indictments were stipulated to by the parties. Defendant's pleas of guilty were then accepted by the trial court.
