Book excerpt: Se sia più opportuno affidare la decisione giurisdizionale a un giudice collegiale o monocratico è un problema non nuovo e costituisce una vexata quaestio dibattuta fra gli studiosi del processo penale. La questione non è di quelle che comportano una definizione unica per tutti i tempi e per tutti i luoghi. Rilevano scelte di politica giudiziaria caratterizzate da un’intrinseca relatività sul piano storico e normativo, circostanza che impone di considerare ogni soluzione offerta come contingente.Se le argomentazioni addotte a sostegno della struttura giudicante unipersonale si pongono tutte sul piano dell’efficienza e della celerità processuale, quelle alla base della pluralità si radicano nell’indiscusso ruolo che il collegio ricopre per assicurare l’imparzialità del giudice e una maggiore affidabilità della decisione. Ovviamente si deve trattare di una collegialità autentica, che vede il contributo di tutti i giudici dell’organo giurisdizionale e il rispetto del principio di maggioranza. E, se è vero che in Costituzione non vi è un esplicito riferimento alla composizione pluripersonale del giudice, tuttavia, se si indaga sul senso della collegialità come garanzia, si scopre come, in realtà, il Costituente abbia considerato la stessa un valore inquadrabile nel sistema delle garanzie cui il legislatore ordinario deve attenersi per disciplinare la composizione dell’organo giudiziario. L’assenza dell’udienza preliminare nei procedimenti innescati dalla citazione diretta a giudizio davanti al tribunale monocratico, poi, oltre a non sembrare un fattore di effettivo snellimento dell’iter processuale, si rivela un’ulteriore perdita di tutela per l’imputato capace di esplicare i suoi effetti sui rapporti fra le parti nel corso delle indagini preliminari e fra queste e il giudice del dibattimento.Su questo sfondo il presente lavoro ripercorre la disciplina del procedimento davanti al tribunale in composizione monocratica, cercando di proporre alcune soluzioni interpretative agli aspetti più problematici.Simone Lonati è Assistant Professor di procedura penale presso l’Università “Luigi Bocconi” di Milano e già Dottore di ricerca in procedura penale. Book excerpt: Although the first analytic philosophers were primarily focused on the logical analysis of language, some of their initial works also contained ontological discussions. One of the most distinct ontological positions of the twentieth century was defended by Arthur Norman Prior. The unusual nature of the position could be demonstrated by the fact that he was ascribed to such divergent positions as nominalism and platonism. This might have been caused by his atypical combination of ontological views. He was, on the one hand, a nominalist in his mature works. On the other hand, he advocated intensional logic and presentism. The aim of this study is to reconstruct the ideas which influenced him as he formulated his ontological positions. Not only are Prior’s ideas introduced, but also the ideas of his precursors and contemporaries who influenced him. In contrast, the ideas of logicians and philosophers who Prior opposed are also presented. The dissertation consists of four parts which deal with Prior’s concepts of possible worlds, theories of quantifications, propositions and individuals. It is a historical study and therefore the polemics which arose after Prior’s death are not discussed.
