Muovendo dall'analisi del procedimento ad evidenza pubblica, questa monografia si propone l'obiettivo di analizzare gli istituti che caratterizzano la fase di esecuzione dei contratti pubblici, in quanto capaci di incidere sulle scelte precedentemente effettuate dall'amministrazione, mettendone in luce la ratio, sulla scorta di un processo evolutivo che si sviluppa da più di un secolo e che sembra rimettere in discussione il principio di concorrenza a favore dell'esigenza, che si palesa sempre più emergente nelle scelte dell'amministrazione, di garantire la corretta e tempestiva esecuzione del contratto. A tal fine "Il principio di concorrenza nell'esecuzione dei contratti pubblici" affronta la tematica delle ipotesi modificative dell'accordo in fase di esecuzione, funzionale alla comprensione del rapporto fra il principio di concorrenza e l'interesse pubblico emergente in sede di esecuzione del contratto, soffermandosi altresì sulla problematica della tutela del terzo concorrente leso dalla condotta della stazione appaltante anche con riferimento alla giurisdizione competente.

But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.

Yet the role of law in the neoliberal story has been relatively neglected, and the idea of neoliberalism as a juridical project has yet to be considered. That is: neoliberal law and its interrelations with neoliberal politics and economics has remained almost entirely neglected as a subject of research and debate. This book provides a systematic attempt to develop a holistic and coherent understanding of the relationship between law and neoliberalism. It does not, however, examine law and neoliberalism as fixed entities or as philosophical categories. And neither is its objective to uncover or devise a ‘law of neoliberalism’. Instead, it uses empirical evidence to explore and theorise the relationship between law and neoliberalism as dynamic and complex social phenomena. Developing a nuanced concept of ‘neoliberal legality’, neoliberalism, it is argued here, is as much a juridical project as a political and economic one. And it is only in understanding the juridical thrust of neoliberalism that we can hope to fully comprehend the specificities, and continuities, of the neoliberal period as a whole.

Classical economic theory--the cluster of ideas about free markets--became the guiding model for the structure and function of both private and public law.
