Book excerpt: L’osservazione della realtà invita ad interrogarsi su fondamento giuridico, limiti ed effetti degli scambi privati dei provvedimenti autorizzatori all’esercizio dell’attività di trasporto pubblico non di linea e di assistenza farmaceutica. Il mercato secondario dei titoli pubblici nei settori a mercato amministrato con strumenti di contingentamento dell’offerta, pur rispondendo a spinte economiche fondate sull’autonomia privata, incide il profilo sociale degli interessi pubblici garantiti dagli strumenti di pianificazione quantitativa. La scelta legislativa di prevedere (senza regolare) la trasferibilità privata del titolo autorizzatorio in quegli ambiti sottratti alla liberalizzazione e destinatari di misure pro-concorrenziali di scarso impatto, si pone in netta contrapposizione con la logica del sistema in cui è chiamata ad operare. Alto è il rischio che la circolazione privata del provvedimento autorizzatorio inneschi meccanismi derogatori della resistenza al mercato, decostruendo dall’interno un sistema di “contingentamento utile” ormai stabilizzato in ragione della protezione sociale intrinseca alle attività economiche. L’esistenza di un mercato secondario dei titoli amministrativi privo di adeguata regolazione avvia dinamiche conseguenti sia per gli strumenti amministrativi di tutela dei valori pubblici, sia per il corretto operare della legge del mercato, necessario presupposto degli scambi in concorrenza. La circolazione privata dei titoli pubblici genera così un mercato governato da crescenti rendite di posizione, forte anticoncorrenzialità ed elevati costi di transazione. Il punto di non ritorno è una progressiva decostruzione del valore giuridico (espressione della finalità sociale) connesso al “bene” scambiato nel mercato secondario a vantaggio di logiche economiche “parallele al mercato”. L’analisi si estende, per differenza, anche ad altri settori in cui il mercato secondario per trasferibilità del titolo pubblico è invece oggetto di specifica regolazione amministrativa. Il volume mira a ricostruire in modo critico l’immagine giuridica della rete di scambi “ad oggetto amministrativo” che si innerva fra le ragioni pubbliche e le dinamiche private dei “mercati in attesa del mercato”.

Yet the role of law in the neoliberal story has been relatively neglected, and the idea of neoliberalism as a juridical project has yet to be considered. That is: neoliberal law and its interrelations with neoliberal politics and economics has remained almost entirely neglected as a subject of research and debate. This book provides a systematic attempt to develop a holistic and coherent understanding of the relationship between law and neoliberalism. It does not, however, examine law and neoliberalism as fixed entities or as philosophical categories. And neither is its objective to uncover or devise a ‘law of neoliberalism’. Instead, it uses empirical evidence to explore and theorise the relationship between law and neoliberalism as dynamic and complex social phenomena. Developing a nuanced concept of ‘neoliberal legality’, neoliberalism, it is argued here, is as much a juridical project as a political and economic one. And it is only in understanding the juridical thrust of neoliberalism that we can hope to fully comprehend the specificities, and continuities, of the neoliberal period as a whole.

There are numerous features of water use and consumption that distinguish Italy from other comparable countries, such as the significant role played by agriculture (a water-intensive activity), a lead position in the consumption of bottled water, lower-than-average prices of water and a far-from-optimal efficiency of waterworks. All such aspects, and many others, make Italy an essential case study.
