Book excerpt: FREDERICK THE SECOND is the story of the remarkable man whose power and sphere of influence straddled the worlds of Christendom and of Islam. The last of the Hohenstaufens, HolyRoman Emperor and King of Sicily and Jerusalem, Frederick II was an energetic and versatile ruler, a man of great ambition in whose lifetime the conflict between Emperor and Pope reached a newintensity. Excommunicated three times by the Church, he was an absolute monarch whose power, defended in almost continuous struggle, extended over much of Germany and Italy as well as the Holy Land. Frederick was a complex man of cultured tastes and licentious manners who had unusually wide intellectual interests. At his Sicilian court scholars of all religions were welcomed--Christian, Jewish, Mohammedan. He founded the University of Naples in 1224 and was a patron of the arts and sciences. The life of this dynamic man is fully explored in Ernst Kantorowicz's notable biography, filled with dramatic incident and absorbing detail, and written with style and scholarship.

Available in PDF, EPUB and Kindle. Book excerpt: Syngoroi are widely known in Athenian law to have served as supporting speakers and aids to the main prosecutors within a courtroom. Lene Rubinstein argues that these people were an important part of court practice and social and political litigation, though largely ignored in many previous studies of Athenian politics. Her study draws extensively on the speeches of syngoroi , revealing their multi-functionality as witnesses, as co-speakers alongside the main prosecutor and as part of a collaborative legal team.

Book European Traditions in Civil Procedure

Download or read book European Traditions in Civil Procedure written by C. H. van Rhee and published by Intersentia nv. This book was released on 2005 with total page 362 pages. Available in PDF, EPUB and Kindle. Book excerpt: European co-operation has resulted in many new and challenging opportunities for legal scholars who, since the so-called 'codification period', have become used to operating in a purely national context. This applies also to scholars in the field of civil procedure, who, for a considerable period of time, have resisted leaving the purely national domain. These scholars have devoted a great deal of attention to the question whether or not harmonisation of civil procedural law is a feasible option, and, if so, in what manner harmonisation should be achieved. The contributors to this book seek to further the harmonisation debate by exploring some of the main trends in the development of civil procedural law during the last two centuries in several European countries (Germany, Austria, Switzerland, France, England and Wales, The Netherlands and Belgium). Two of the central issues that are addressed by the contributors are the extent to which the various procedural models have influenced each other and the extent to which common traditions in civil procedural law may be distinguished in Europe. Each general chapter in this book is supplemented by three chapters devoted to specific procedural topics: Conciliation, Party Interrogation as Evidence and the Role of the Judge. In addition, extensive bibliographical references are included.

Book Civil Procedure in Japan

Download or read book Civil Procedure in Japan written by Takaaki Hattori and published by Juris Publishing, Inc.. This book was released on 2000-12-01 with total page 38 pages. Available in PDF, EPUB and Kindle. Book excerpt: The only book of its kind available in English, Civil Procedure in Japan is the most reliable and comprehensive reference on the broad subject of the Japanese civil justice system. Civil Procedure in Japan discusses the problems encountered in litigating a civil controversy in the chronological order in which they are most likely to arise. Since civil procedure, as all law, is a product of historical developments and since it cannot be understood without reference to the political structure within it is to operate, Chapter 1 presents the historical background to date of the development of court procedure. The chapter looks at Japan's political organization (Executive, Legislative, etc), the court structure, and the sources of law. Chapter 2 is devoted to a look at the world of Japanese Legal Profession including legal education and non-Japanese lawyers in Japan, while Chapter 3 is an overview of the Judiciary as a whole. Chapter 4 sets forth the basic concepts involved in the judiciary authority and its interface with other governmental authorities. Subsequent chapters deal with practical issues of civil procedure, starting with Chapter 5 through Chapter 8, the trial is traced from beginning (parties to action and pre-commencement preparation including provisional remedies) through appellate procedures. Chapters 8 and 9 deal with various judicial proceedings outside of typical civil actions. Chapter 11 specifically explains various insolvency proceedings from straight bankruptcy to corporate reorganization. Chapter 12 is devoted to the arbitration law of 2002. Chapter 13 is about various terms of the court costs. Enforcement of civil judgments is treated in detail in Chapter 14. Finally, Chapter 15 is reserved for international cooperation in litigation and sets forth Japan's bilateral arrangements for international co-operation. Furthermore, appendices include an English translation of the Code and Rules of Civil Procedure of 1996 and other important statutes, English translations of sample judgments, glossaries, bibliography, ect.
