This monograph argues that these practices represent a threat to the maintenance of international peace and security and assesses the extent to which international law regulates this conduct. The traditional view among international legal scholars is that, in the absence of direct and specific international law on the topic of espionage, cyber espionage constitutes an extra-legal activity that is unconstrained by international law. This monograph challenges that assumption and reveals that there are general principles of international law as well as specialised international legal regimes that indirectly regulate cyber espionage. In terms of general principles of international law, this monograph explores how the rules of territorial sovereignty, non-intervention and the non-use of force apply to cyber espionage. In relation to specialised regimes, this monograph investigates the role of diplomatic and consular law, international human rights law and the law of the World Trade Organization in addressing cyber espionage. This monograph also examines whether developments in customary international law have carved out espionage exceptions to those international legal rules that otherwise prohibit cyber espionage as well as considering whether the doctrines of self-defence and necessity can be invoked to justify cyber espionage. Notwithstanding the applicability of international law, this monograph concludes that policymakers should nevertheless devise an international law of espionage which, as lex specialis, contains rules that are specifically designed to confront the growing threat posed by cyber espionage.

Book excerpt: During the interwar period, Japanese intellectuals, writers, activists, and politicians, although conscious of the many points of intersection between their politics and those of Mussolini, were ambivalent about the comparability of Imperial Japan and Fascist Italy. In The Fascist Effect, Reto Hofmann uncovers the ideological links that tied Japan to Italy, drawing on extensive materials from Japanese and Italian archives to shed light on the formation of fascist history and practice in Japan and beyond. Moving between personal experiences, diplomatic and cultural relations, and geopolitical considerations, Hofmann shows that interwar Japan found in fascism a resource to develop a new order at a time of capitalist crisis. Japanese thinkers and politicians debated fascism as part of a wider effort to overcome a range of modern woes, including class conflict and moral degeneration, through measures that fostered national cohesion and social order. Hofmann demonstrates that fascism in Japan was neither a European import nor a domestic product; it was, rather, the result of a complex process of global transmission and reformulation. By focusing on how interwar Japanese understood fascism, Hofmann recuperates a historical debate that has been largely disregarded by historians, even though its extent reveals that fascism occupied a central position in the politics of interwar Japan. Far from being a vague term, as postwar historiography has so often claimed, for Japanese of all backgrounds who came of age from the 1920s to the 1940s, fascism conjured up a set of concrete associations, including nationalism, leadership, economics, and a drive toward empire and a new world order.

Book excerpt: In Ruling the Root, Milton Mueller uses the theoretical framework of institutional economics to analyze the global policy and governance problems created by the assignment of Internet domain names and addresses. "The root" is the top of the domain name hierarchy and the Internet address space. It is the only point of centralized control in what is otherwise a distributed and voluntaristic network of networks. Both domain names and IP numbers are valuable resources, and their assignment on a coordinated basis is essential to the technical operation of the Internet. Mueller explains how control of the root is being leveraged to control the Internet itself in such key areas as trademark and copyright protection, surveillance of users, content regulation, and regulation of the domain name supply industry. Control of the root originally resided in an informally organized technical elite comprised mostly of American computer scientists. As the Internet became commercialized and domain name registration became a profitable business, a six-year struggle over property rights and the control of the root broke out among Internet technologists, business and intellectual property interests, international organizations, national governments, and advocates of individual rights. By the late 1990s, it was apparent that only a new international institution could resolve conflicts among the factions in the domain name wars. Mueller recounts the fascinating process that led to the formation of a new international regime around ICANN, the Internet Corporation for Assigned Names and Numbers. In the process, he shows how the vaunted freedom and openness of the Internet is being diminished by the institutionalization of the root.
