La trattazione è aggiornata, in particolare, alle novità introdotte dai seguenti provvedimenti: - la L. 30 ottobre 2013, n. 125 (di conv. del D.L. 101/2013) con cui si è previsto che il ricorso al lavoro flessibile nelle amministrazioni pubbliche sia consentito solo per rispondere ad esigenze di carattere temporaneo o essenziale; - la L. 6 agosto 2013, n. 97, che ha esteso l’accesso ai posti di lavoro alle dipendenze delle amministrazioni pubbliche ai familiari di cittadini dell’Unione europea, ai soggiornanti di lungo periodo, ai rifugiati e ai titolari dello status di protezione sussidiaria; - il D.P.R. 16 aprile 2013, n. 70 contenente il regolamento istitutivo del Sistema unico di reclutamento e il riordino delle scuole pubbliche di formazione, nell’ottica del coordinamento delle politiche formative; - il D.P.R. 16 aprile 2013, n. 62 con il quale è stato approvato il nuovo Codice di comportamento dei dipendenti pubblici; - il D.Lgs. 8 aprile 2013, n. 39, recante disposizioni in materia di inconferibilità e di incompatibilità di incarichi presso le pubbliche amministrazioni e presso gli enti privati in controllo pubblico; - il D.Lgs. 14 marzo 2013, n 33, che ha introdotto una serie di obblighi di pubblicità e di diffusione delle informazioni a carico delle pubbliche amministrazioni ed ha inasprito il sistema sanzionatorio per il mancato, ritardato o inesatto adempimento degli stessi. Il volume tiene altresì conto degli ultimi indirizzi giurisprudenziali, fra i quali è riportata la pronuncia delle Sezioni Unite del 24 ottobre 2013 sulla differenza fra la fattispecie di induzione indebita di cui all’art. 319-quater c.p. e quella di concussione di cui all’art. 317 c.p., facente seguito alle novità introdotte dalla L. 190/2012, legge sull’anticorruzione.

Book excerpt: Da questa ricerca emerge una tesi provocatoria: il sistema di pubblico impiego che si sta mettendo in atto con le innovazioni contrattuali degli ultimi anni non favorisce il processo di recupero di efficacia organizzativa, ma si traduce molto spesso in un ulteriore ostacolo al rinnovamento. L'analisi delle Condizioni di funzionamento degli , quali in particolare enti locali e amministrazioni periferiche dello Stato, è il punto di partenza della ricerca. Attraverso 8 studi di casi, condotti in Lombardia e nelle Puglie, si sono affrontati i problemi connessi alla gestione del rapporto di impiego ed alla utilizzazione del personale. E' proprio l'esame di casi e situazioni alla periferia del sistema a suggerire la conclusione già richiamata: gli attuali istituti normativi e contrattuali si traducono ancora in ostacoli ad una razionale gestione delle strutture; troppi sono gli elementi che vincolano un efficace management pubblico e che finiscono per depotenziare le amministrazioni; ne consegue la mancata valorizzazione del lavoro e della professionalità, esito tanto più frustrante quando venga rapportato alle potenzialità esistenti nel ed alle tendenze in atto in altri settori dì attività. Ma la ricerca è orientata soprattutto a formulare una serie di proposte per una revisione dei principali istituti contrattuali; l'avvio di un processo di recupero di efficacia organizzativa nella pubblica amministrazione richiede interventi coordinati sull'assetto istituzionale, sui meccanismi di allocazione delle risorse Finanziarie, sulla cultura amministrativa e organizzativa e sullo stesso sistema di pubblico impiego. Per quanto riguarda quest'ultimo punto, che è l'oggetto specifico della ricerca, al fondo di tutto c'è il bisogno estremo di aprire spazi ben diversi da quelli attuali per "figure eccellenti" di operatori pubblici, nei settori più disparati ed a tutti i livelli di responsabilità.
