Book excerpt: Long a major element of classical studies, the examination of the laws of the ancient Romans has gained momentum in recent years as interdisciplinary work in legal studies has spread. Two resulting issues have arisen, on one hand concerning Roman laws as intellectual achievements and historical artifacts, and on the other about how we should consequently conceptualize Roman law. Drawn from a conference convened by the volume's editor at the American Academy in Rome addressing these concerns and others, this volume investigates in detail the Roman law of obligations—a subset of private law—together with its subordinate fields, contracts and delicts (torts). A centuries-old and highly influential discipline, Roman law has traditionally been studied in the context of law schools, rather than humanities faculties. This book opens a window on that world. Roman law, despite intense interest in the United States and elsewhere in the English-speaking world, remains largely a continental European enterprise in terms of scholarly publications and access to such publications. The censor was one of the most fascinating legal institutions of Republican Rome. Although the office of the censor has been studied by various scholars from prosopographical, historical, and social perspectives, there has been no comprehensive study of its impact on the development of written law. This book aims to full the gap by providing an overview of the applications of the nota censoria to demonstrate its impact on the development of numerous regulations in the field of private and public laws during the Republican and Imperial periods. This book explores the relationship between magistrate law (ius honorarium) and regimen morum, and how the activities of the censors in this area influenced the formation of praetorian edicts and later legislation during the Principate period, most notably the marriage laws of Augustus. By examining the influence of the censor and the censorial nota in these spheres, readers will gain a new understanding of the overall significance of the censor's office in shaping the Roman legal order. Pričujoča monografija tako prinaša številne nove ugotovitve in nove poglede na Marijo Terezijo in njeno dobo. Pri monografiji je sodelovalo več kot dvajset priznanih raziskovalcev, večinoma iz Slovenije, nekaj pa tudi iz tujine. Izhodišče prispevkov je slovenski prostor in vplivi cesaričnih reform nanj. Te reforme so bile korenite, temeljite in dolgoročne, kar pomeni, da njihove učinke čutimo še danes, čeprav se tega morda ne zavedamo. Druga rdeča nit monografije pa je ohranjanje spomina na Marijo Terezijo na Slovenskem kot tudi v njenih nekdanjih deželah, ki so danes samostojne države (Avstrija, Madžarska, Hrvaška in Češka). Monografija je napisana pretežno v slovenskem jeziku, medtem ko so prispevki tujih avtorjev v tujem jeziku (nemško, angleško, italijansko in hrvaško) z daljšim slovenskim povzetkom.

Such a topic is crucial for understanding both Italian imperial rule and the complex dynamics of the different colonial societies where several actors, like notables, political leaders, minorities, etc., were involved. The chapters gathered in the book constitute an unprecedented account of a heterogeneous geographical area. The cases of Eritrea, Libya, Dodecanese, Ethiopia, and Albania confirm that citizenship and subjecthood in the colonial context were ductile political tools, which were structured according to the orientations of the Metropole and the challenges that came from the colonial societies, often swinging between submission, cooptation to the colonial power, and resistance. On one hand, the book offers an account of the different policies of citizenship implemented in the Italian colonies, in particular the construction of gradated forms of citizenship, the repression and expulsion of dissidents, the systems of endearment of local people and cooptation of the elites, and the racialization of legal status. On the other, it deals with the various answers coming from the local populations in terms of resistance, negotiation, and construction of social identity.
