Telles sont les questions au cœur de cet ouvrage. The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). More than 200 speakers from 50 countries studied these questions from the legal angle, but also philosophic, economic and anthropological. This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family. Phenomena such as increasing life expectancy, population urbanization, labor-market entry barriers, decline of traditional family patterns, mark in depth our contemporary world and involve old solidarity disappearance and new solidarity emergence, reshaping relations between generations while bringing up the problem of the fate of the most vulnerable: children, the sick, disabled, and especially elderly people. – What then is the role of families and communities in protecting these people? – What is the relationship between public and private solidarity? – What are the rights and freedoms of people placed by age, illness or disability in a dependence situation? These are the issues addressed by the authors of this book.

During his confinement for his anti-fascist beliefs, the Italian political philosopher Carlo Rosselli (1899-1937) wrote this work not only as a critique of fascism, but also as an investigation into the history of Marxism and the need for a liberal reformulation of socialism. In this first English- language edition, Nadia Urbinati highlights both the historical and theoretical importance of Liberal Socialism, which continued to inspire the anti-fascist movement "Giustizia e Liberta." long after Rosselli's assassination by Mussolini's agents, and which outlines a possible rebirth of the socialist and democratic movements. Rosselli's analysis provides an illuminating interpretation of the ideological crisis of Marxism, in its positivistic version, during the late nineteenth century and exposes the intellectual weakness of revisionist efforts to delineate new versions of Marx's doctrine. Book excerpt: This book examines the phenomenon of infanticide in Ireland from 1850 to 1900, examining a sample of 4,645 individual cases of infant murder, attempted infanticide and concealment of birth. Evidence for this study has been gleaned from a variety of sources, including court documents, coroners’ records, prison files, parliamentary papers, and newspapers. Through these sources, many of which are rarely used by scholars, attitudes towards the crime, the women accused of the offence, and the victim, are revealed. Although infant murder was a capital offence during this period, none of the women found guilty of the crime were executed, suggesting a degree of sympathy and understanding towards the accused. Infanticide cases also allude to complex dynamics and tensions between employers and servants, parents and pregnant daughters, judges and defendants, and prison authorities and inmates. This book highlights much about the lived realities of nineteenth-century Ireland.

Book excerpt: From the tone of the report by the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Re search, one might conclude that the whole-brain-oriented definition of death is now firmly established as an enduring element of public policy. In that report, Defining Death: Medical, Legal and Ethical Issues in the Determination of Death, the President's Commission forwarded a uni form determination of death act, which laid heavy accent on the signifi cance of the brain stem in determining whether an individual is alive or dead: An individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions, or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead. A determination of death must be made in accordance with accepted medical standards ([1], p. 2). The plausibility of these criteria is undermined as soon as one confronts the question of the level of treatment that ought to be provided to human bodies that have permanently lost consciousness but whose brain stems are still functioning.

Samuel Fleischacker argues that guaranteeing aid to the poor is a modern idea, developed only in the last two centuries. Earlier notions of justice, including Aristotle's, were concerned with the distribution of political office, not of property. It was only in the eighteenth century, in the work of philosophers such as Adam Smith and Immanuel Kant, that justice began to be applied to the problem of poverty. To attribute a longer pedigree to distributive justice is to fail to distinguish between justice and charity. Fleischacker explains how confusing these principles has created misconceptions about the historical development of the welfare state. Socialists, for instance, often claim that modern economics obliterated ancient ideals of equality and social justice. Free-market promoters agree but applaud the apparent triumph of skepticism and social-scientific rigor. Both interpretations overlook the gradual changes in thinking that yielded our current assumption that justice calls for everyone, if possible, to be lifted out of poverty. By examining major writings in ancient, medieval, and modern political philosophy, Fleischacker shows how we arrived at the contemporary meaning of distributive justice.
