The ICTR was established for the prosecution of persons responsible for genocide and other serious violations of international humanitarian law committed in the territory of Rwanda between January 1, 1994 and December 31, 1994. The ICTR may also deal with the prosecution of Rwandan citizens responsible for genocide and other such violations of international law committed in the territory of neighboring States during the same period. The book is both descriptive and critical and its emphasis is on day-to-day practice, drawing on the experience of the Yugoslavia, Rwanda and Sierra Leone Tribunals. This book is an attempt to define and explain the core principles and rules that have developed at those ad hoc Tribunals; the rationale and origin of those rules; and to assess the suitability of those rules in the particular context of the International Criminal Court which is still at its early stages. The ICC differs in structure from the ad hoc Tribunals and approaches the legal issues it has to resolve differently from its predecessors. The ICC is however confronted with many of the same questions. The book examines the differences between the ad hoc Tribunals and the ICC and seeks to offer insights as to how and in which circumstances the principles established over years of practice at the ICTY, ICTR and SCSL may serve as guidance to the ICC practitioners of today and the future. The contributors represent a cross-section of the practicing international criminal bar, drawn from the ranks of the Bench, the Prosecution and the Defence and bringing with them different legal domestic cultures. Late that year, in an effort to redeem itself, the United Nations Security Council created the International Criminal Tribunal for Rwanda to seek accountability for some of the worst atrocities since World War II: the genocide suffered by the Tutsi and crimes against humanity suffered by the Hutu. But faced with competing claims, the prosecution focused exclusively on the crimes of Hutu extremists. No charges would be brought against the Tutsi-led Rwandan Patriotic Front, which ultimately won control of the country. Positive autonomy, as defined in this work, has three defining characteristics; first, the ability of a country to pursue its own internally driven policy choices, especially in the face of international opposition but not necessarily in the face of opposition; second, the "ownership" of a community over policy developments that affect them, i.e. their involvement in the administration of the policy; third, the ability of a country to reject policy propositions from the outside. Positive autonomy is meant to convey the highest levels of political autonomy historically enjoyed only by the most wealthy and powerful states.

Book excerpt: This article investigates the influence of the international criminal tribunals on the conclusions reached by ICRC Customary Study. To engage in such an analysis requires an understanding of the interplay of treaties and customary international law and of the status of the jurisprudence of international tribunals as a source of international law. In relation to the latter, it is noted that the impact of any individual case is strongly linked to the quality of the reasoning it contains. Having thus set the scene, this article then goes on to appraise the ICRC Study's approach to the international criminal tribunals founding documents and case-law. It criticises the Study for not setting out the precise normative status it places on the ICTY, ICTR and Special Court for Sierra Leone's Statutes, and for failing to take a sufficiently nuanced view on the Rome Statute, in particular owing to Article 10 of that Treaty. The piece then moves on to look at some instances where case-law is relied upon by the Study without sufficient discussion of its merits, and where it has placed too much reliance on controversial aspects of the Rome Statute. It concludes by noting the problematic relationship between some of the rules and their commentary, but, despite the criticisms made, also agreeing with many of the conclusions the Study reaches.
