Book The Legal Foundations of INTERPOL

Download or read book The Legal Foundations of INTERPOL written by Rutsel Silvestre J Martha and published by Bloomsbury Publishing. This book was released on 2010-07-23 with total page 280 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a study of the legal aspects of the birth and development of an international organisation, using the example of INTERPOL as a detailed case study. It is not a constitutional manual for INTERPOL, but an organisational study, and does not seek to be exhaustive in terms of its description of INTERPOL's operations. Its main focus is the examination of the question whether an international organisation, in this case INTERPOL, can be created without a solemn and formally celebrated treaty. At the same time the book sets out the legal foundations for extra-judicial international police enforcement cooperation and explains the creation, structure and operation of INTERPOL, the organisation that promotes that cooperation. For practitioners who, for whatever reason, have to deal with INTERPOL, it provides a much-needed explanation of the legal foundations of the Organisation, its legal status and some basic guidance on its operations. It also includes information relevant for lawyers litigating issues with INTERPOL about how their clients can challenge the way the Organisation has processed information concerning them, or has alerted police forces worldwide about them. The work is to be welcomed not only because of its thorough research and main conclusions, but primarily because it submits known facts about INTERPOL to a rigorous legal analysis from the perspective of public international law…The practical, as well as theoretical importance of the study needs to be underlined. The study provides practitioners who for whatever reason have to deal with INTERPOL, with the much needed explanation about the legal foundation of the Organisation, its legal status and some basic guidance on its operations. Foreword by Ronald K Noble, Secretary General of INTERPOL, July 2009

Book The Legal Foundations of INTERPOL

Download or read book The Legal Foundations of INTERPOL written by Rutsel Silvestre J Martha and published by Bloomsbury Publishing. This book was released on 2020-11-26 with total page 371 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the publication of the extremely well regarded first edition of this title, the legal regime which forms the basis for INTERPOL has changed significantly due to increasing criticism and calls for reform. This timely new edition provides a complete update to reflect the significant developments within the Organization since 2010. This new edition also examines INTERPOL's internal and external law and situates INTERPOL's assistance to its members in the legal regime of responsibility. It is the first text to undertake this task. It draws on the jurisprudence of the Commission for the Control of INTERPOL's Files and the authors' extensive experience before this body to discuss in great detail how an individual can challenge INTERPOL's interventions (including the issuance of notices) on the basis of the Organization's internal rules. It also meticulously describes the procedures under which INTERPOL members might challenge INTERPOL's interventions and how an individual can hold INTERPOL responsible for breaches of its external law. Retaining the clarity of expression and expert analysis that were hallmarks of the first edition, this book is required reading for practitioners and academics alike. It provides academics with a valuable case study on the creation of an international organisation and the responsibility of international organisations, and it offers practitioners a forensic analysis of how to challenge INTERPOL and its actions.

Book Policing the World without a World Police Assessing the Conditions of International Police Cooperation

Download or read book Policing the World without a World Police Assessing the Conditions of International Police Cooperation written by Ron Böhler and published by GRIN Verlag. This book was released on 2017-09-29 with total page 22 pages. Available in PDF, EPUB and Kindle. Book excerpt: Seminar paper from the year 2010 in the subject Politics - International Politics - Topic: International Organisations, grade: 2.0, , language: English, abstract: In a speech in 2006, the Secretary General of the International Criminal Police Organization (ICPO) referred to Interpol as ‘the world’s largest international police organization, the world’s only global police organization, and the world’s most effective international police body’. With 188 member countries the ICPO is the second largest international organization after the United Nations , based on intergovernmental cooperation between domestic law enforcement services, the so called National Central Bureaus (NCB). In times when transnational (organized) crime and terrorism increase exceedingly through globalization and the internationalization of transportation and communication systems as well as international trade, the global role of Interpol and the need to react rapidly and effectively emerge as well. Whenever two or more countries are involved in a criminal act, it is a matter of the International Criminal Police Organization. National police agencies adopt a double role: As a states executive branch they are not fully independent from political interventions. The national justice system and the securing of civil society are subjects to the state in order to control social violence and destruction, and to protect the citizens from victimization in the domestic arena. In short: It is a matter of state sovereignty. Related to the international level and the membership in Interpol, the police can instead not be equated with national governments. The NCBs are the `key element[s] in the day-to-day performance of the tasks identified with Interpol ́ and are consequently political actors in international relations.

Book European Data Collection on Sexual Offences Against Minors

Download or read book European Data Collection on Sexual Offences Against Minors written by Gert Vermeulen and published by Maklu. This book was released on 2001 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fight against the sexual exploitation of and trade in children has gained particular and renewed international attention in the last few years and has become one of the most important concerns in the context of international law enforcement policy and cooperation. Since 1998, policy makers have come up with new legal initiatives at global as well as regional levels in order to tackle this problem in a more effective and coordinated way. This proves that the time has come to match words and actions, and to come up with concrete and useful tools for law enforcement services and NGO's active in the areas concerned. The current study therefore examines the feasibility of the further elaboration and implementation of recommendations from a previous project (96/STOP/003) regarding the systematic gathering and administration of data concerning missing minors, minor victims of trafficking in or sexual exploitation of children and perpetrators of sexual offences against minors, with the goal to further prepare the practical setting up of several international databases with immediate relevance to the police and the prosecuting or investigating magistrates or officials, both in the EU Member States and the candidate countries. It is recommended to give Interpol a mandate to host an international database on missing persons and to create an EU monitoring centre responsible for the gathering and administration of reliable statistics and legal information on sexual exploitation of children and trafficking in human beings. It is also recommended for Interpol to host an international reference database on child pornography and to set up an analysis/intelligence child porn database at Europol. Regarding suspected and convicted sex offenders, it is proposed to create a database on pending investigations, an EU criminal records database and a database at Europol containing encoded information on both suspected and convicted offenders of sexual offences against children. Finally, it is suggested to create a European network of national DNA databases. The book also contains a summary of the conclusions in French.
