Book Victims Rights and Advocacy at the International Criminal Court

Download or read book Victims Rights and Advocacy at the International Criminal Court written by T. Markus Funk and published by Oxford University Press, USA. This book was released on 2010-04-29 with total page 479 pages. Available in PDF, EPUB and Kindle. Book excerpt: Victims' Rights and Advocacy at the International Criminal Court is the first detailed analysis of the newly-recognized right of victims to participate in the trials of their accused abusers. Author T. Markus Funk draws on his extensive background in international criminal law and litigation to walk the reader through this unique - and, indeed, controversial - body of procedural and substantive rights for victims of atrocity crimes. To set the stage for his analysis, Mr. Funk provides a historical account of the ICC's creation and the origins of victims' rights. In addition, Mr. Funk gives the reader practical guidance on what it takes to litigate cases before the Court. This background, in turn, allows the reader to work through a number of key questions: How does the ICC function and how is it structured? What are the legal, theoretical, and political pillars upon which the ICC is built? What is the proper role for victims in atrocity crimes litigation? How successfully has the ICC lived up to its promises to victims? How does one become an ICC victim representative, prosecutor, or judge, and what does it take to fulfill the mandate of these positions? What are the costs and benefits sovereign nations must weigh before joining the ICC? What institutional flaws have kept the ICC, as well as other predecessor ad hoc tribunals, from meeting the weighty expectations they have set for themselves and the world community? In addition to addressing these key issues, Mr. Funk proposes concrete reforms to help the ICC fulfill its mission of effectively redressing past atrocities, while preserving the rights of both victims and the accused. The book also presents a detailed explanation of the ICC's rules of procedure and evidence and other practical issues impacting the Court's daily litigation practice. Featuring a foreword by Paolina Massidda, Principal Counsel of the Office of Public Counsel for Victims at the International Criminal Court, Victims' Rights and Advocacy at the International Criminal Court equips lawyers, victim advocates, academics, government officials, and other interested Court observers and decision-makers with a thorough understanding of the promises and potential pitfalls of victim advocacy, and, indeed, advocacy in general, at the ICC. The book, therefore, is an indispensable guide to anyone interested in this new, important and constantly-evolving juridical body.

Book Judicial Decisions in International Law Argumentation

Download or read book Judicial Decisions in International Law Argumentation written by Letizia Lo Giacco and published by Bloomsbury Publishing. This book was released on 2022-10-20 with total page 227 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the question of how the multiplication of judicial decisions on international law has influenced the way in which legal findings in international law adjudication are justified. International law practitioners frequently cite judicial decisions to persuade. Courts interpreting international law are no exception to this practice. However, judicial decisions do much more than persuading: they enable and constrain interpretive discretion. Instead of taking the road of the sources of international law, this book turns to the somewhat uncharted terrain of legal argumentation. Using international criminal law as a case study, it shows how the growing number of judicial decisions has normalised courts' resort to them in legal justification and enabled some argumentative practices to become constitutive of international law. In so doing, it critically revisits the implications of an iterative use of judicial decisions, and reassesses the influence of the 'judicialisation turn' on the ways in which the meaning of international law is formed, shaped and reshaped by reference to judicial decisions.

Book The Law of International Lawyers

Download or read book The Law of International Lawyers written by Wouter Werner and published by Cambridge University Press. This book was released on 2017-03-30 with total page 443 pages. Available in PDF, EPUB and Kindle. Book excerpt: For decades, Martti Koskenniemi has not just been an influential writer in international law; his work has caused a significant shift in the direction of the field. This book engages with some of the core questions that have animated Koskenniemi's scholarship so far. Its chapters attest to the breadth and depth of Koskenniemi's oeuvre and the different ways in which he has explored these questions. Koskenniemi's work is applied to a wide range of functional areas in international law and discussed in relation to an even broader range of theoretical perspectives, including history, political theory, sociology and international relations theory. These invaluable insights have been expertly brought together by the volume editors, who identify the key and common themes of many of the book's contributions. This volume demonstrates the importance of critical legal scholarship in the ways international law is enacted, shaped and reshaped over time.
