This book was released on 2012-06-19 with total page 122 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since its inception in 1998, ICANN [Internet Corporation for Assigned Names and Numbers] has been charged with promoting competition in the registration of domain names while ensuring the security and stability of the DNS. In 2000 and 2003, ICANN conducted a limited expansion of gTLDs [generic top-level domains]. In 2005 it initiated the process we are discussing today. After 6 years of multi-stakeholder discussion, including input from governments through the governmental advisory committee, ICANN approved the rules for the new gTLD program in the form of an applicant guidebook. Expansion of the gTLD space is expected to provide a platform for city, geographic, and internationalized domain names, among other things. This type of change to the DNS is expected to enhance consumer trust and choice and reinforce the global nature of the Internet. It is also expected that a portion of applications will either be generic words or brand- focused as part of business development, investment, and startup plans.

Book Policy Oriented Evaluation of the Expansion of Top Level Domain Name Space

Download or read book Policy Oriented Evaluation of the Expansion of Top Level Domain Name Space written by Keisuke Kamimura and published by . This book was released on 2017 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This study is an attempt to estimate the essentiality of the new generic top-level domains, which were newly introduced to the domain name system according to ICANN's New gTLD Program, and to draw implications on Internet policy for both national governments and ICANN. Based on quantitative analyses, the author finds that the effect of the registration fee on the number of domain name registrations is significantly different between the generic and geographic gTLD's, and between the generic and internationalised gTLD's, thus concluding that the geographic and internationalised gTLD's have a higher degree of essentiality and that they cater to different demands of the domain name registrants. Based on the findings, the author also draws two policy implications. First, the expansion of the top-level domain name space, which ICANN has implemented over years, is considered to serve real-world user demands. Second, considering the higher degree of essentiality, the geographic gTLD's, unlike new gTLD's of other types, may well fall under some regulatory oversight in order to ensure stability and trust among the domain name registrants.

Book excerpt: Just like the technology world prepared for Y2K, the dot-com centric way of Internet addressing is preparing to change. Instead of typing www.dot.com into your web browser, you will be able to enter www.dot.anything. This is because the organization in charge of domain names, the Internet Corporation for Assigned Names and Numbers (ICANN), has approved plans for the introduction of new generic Top Level Domain (gTLD) extensions. This dramatically increases the number of TLDs, with familiar domain extensions like .com, .org, and .net, from the current 22 to an unlimited number of TLDs. ICANN is rewriting the nomenclature for web addressing. More importantly, the expansion is likely to place an undue burden on government regulation and negatively impact trademark owners. During ICANN's incorporation in 1999, careful consideration was given to its technical functions, its obligation to the global public interest and its governance over the Internet. These considerations are captured in Article IV of ICANN's Articles of Incorporation and its Bylaws. Originally, the primary role of ICANN, which was incorporated as a “nonprofit public benefit corporation,” was to assume technical responsibility for the operational stability of the Internet. However, ICANN quickly realized, and subsequently announced that it was necessary to begin making policy decisions related to its technical function. In 2002, ICANN amended its Bylaws, a decision that was approved by the Board, and ICANN was allowed to start creating domain name policies by a vote of the Board, irrespective of consensus among the various stakeholders. The extent to which the ICANN board should be able to independently create these “technically related” policies has been a source of much controversy, intensified by debates surrounding the recent expansion of gTLDs. This Note examines whether ICANN's rationale for expanding gTLDs to increase “consumer choice,” contradicts its charter to “lessen the burden of government” in regulating the Internet. Part I outlines the scope and legal framework under which ICANN was chartered. Part II explores the structure of the Domain Name System and discusses the justifications for and against gTLD expansion. Part III reviews ICANN's planned gTLD application process and the proposed trademark protection mechanisms. Part IV determines the challenges the gTLD expansion may face and highlights the new burdens it will place on regulation and the impacts it will have on trademark owners. This Note concludes with proposals on how ICANN can comply with its charter.

Book excerpt: This seventh volume in the Swedish Studies in European Law series brings together some of the most prominent scholars working within the fast-evolving field of EU civil justice. Civil justice has an impact on matters involving, inter alia, family relationships, consumers, entrepreneurs, employees, small and medium-sized businesses and large multinational corporations. The particular themes covered include forum shopping, alternative dispute resolution, simplified procedures and debt collection, family matters and collective redress. Book Global Governance of Intellectual Property in the 21st Century

Download or read book Global Governance of Intellectual Property in the 21st Century written by Mark Perry and published by Springer. This book was released on 2016-05-24 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses the governance foundations of innovation, brands, inventions, secrets and expression, which are the keys to a century based on knowledge. They are reflected in legal rights that have been fermenting over centuries of national policy deliberations on intellectual property rights, constantly in flux in the face of new advances in science, but overall a trend towards greater protectionism. As countries are challenged by the strictures of international agreements, often extorted through imbalanced power relationships, they seek their own national means for beneficial differentiation from the new global norms, whilst complying with international obligations. This book deals with the outcomes of regional governance of intellectual property, which often creates ripples in the search for harmony in the laws that form the basis for the future of intellectual property. The work has contributions that come from developing and developed nations, showing a common theme of the struggle to find the balance in an area of law that often does not provide clearcut solutions to real world environments. There are many intellectual property struggles illustrated in this work: patent at the boundaries of nature and invention, the need for drug development, which is driven by profit based on the patent monopoly; copyright, the expression of original thought, seeking to maximise exposure facilitated by the internet, but a system that facilitates rampant copying; trade marks, supporting company branding, seeks to exploit global branding through naming domains names; and other areas concomitant to the globalisation of intellectual property governance, such as foreign direct investment. This book holds up a mirror to the issues of world governance of intellectual property rights in this century, asking whether the direction we are currently following is in the best interest of global citizens, and showing the divergence that constraints are stimulating on a national level.
