Book excerpt: The essays collected in this volume reflect the profound impact of Martha Nussbaum‘s philosophical writings on law and legal scholarship. The capabilities approach that she has largely authored has influenced the approach scholars take to the law of disabilities, both in the United States and in Canada, as well as to international human rights and to domestic private law‘s protections of vulnerable populations. Her analyses of the relationship between our emotions and our thought and action has triggered a re-assessment of the legal regulation and recognition of emotion in a range of fields, most particularly in the field of criminal law; and her writing on the nature of dignity has informed an understanding of the emerging civil rights of gay and lesbian citizens worldwide. Our appreciation of the role of narrative in legal thought and discourse and the contributions of literature to law and legal culture, have also been broadened and deepened by her contributions. Taken together, and including the introduction by the editor, the essays collected in this volume demonstrate the far-reaching impact of Nussbaum‘s philosophical oeuvre.

Book Animals and the Economy

Download or read book Animals and the Economy written by Steven McMullen and published by Springer. This book was released on 2016-08-11 with total page 221 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the economic institutions that determine the nature of animal lives as systematically exploited objects traded in a market economy. It examines human roles and choice in the system, including the economic logic of agriculture, experimentation, and animal ownership, and analyses the marginalization of ethical action in the economic system. Animals and the Economy demonstrates that individual consumers and farmers are often left with few truly animal-friendly choices. Ethical participants in the economy must either face down an array of institutional barriers, or exit mainstream markets entirely. This book argues that these issues are not necessary elements of a market system, and evaluates a number of policy changes that could improve the lives of animals in the context of a market economy.

Book The Animal Rights Debate

    Book Details:
  • Author : Gary L. Francione
  • Publisher : Columbia University Press
  • Release : 2010-10-26
  • ISBN : 0231526695
  • Pages : 289 pages

Download or read book The Animal Rights Debate written by Gary L. Francione and published by Columbia University Press. This book was released on 2010-10-26 with total page 289 pages. Available in PDF, EPUB and Kindle. Book excerpt: Gary L. Francione is a law professor and leading philosopher of animal rights theory. Robert Garner is a political theorist specializing in the philosophy and politics of animal protection. Francione maintains that we have no moral justification for using nonhumans and argues that because animals are property or economic commodities laws or industry practices requiring "humane" treatment will, as a general matter, fail to provide any meaningful level of protection. Garner favors a version of animal rights that focuses on eliminating animal suffering and adopts a protectionist approach, maintaining that although the traditional animal-welfare ethic is philosophically flawed, it can contribute strategically to the achievement of animal-rights ends. As they spar, Francione and Garner deconstruct the animal protection movement in the United States, the United Kingdom, Europe, and elsewhere, discussing the practices of such organizations as PETA, which joins with McDonald's and other animal users to "improve" the slaughter of animals. They also examine American and European laws and campaigns from both the rights and welfare perspectives, identifying weaknesses and strengths that give shape to future legislation and action.

Book Literary Bioethics

Download or read book Literary Bioethics written by Maren Tova Linett and published by NYU Press. This book was released on 2020-07-14 with total page 222 pages. Available in PDF, EPUB and Kindle. Book excerpt: Uses literature to understand and remake our ethics regarding nonhuman animals, old human beings, disabled human beings, and cloned posthumans Literary Bioethics argues for literature as an untapped and essential site for the exploration of bioethics. Novels, Maren Tova Linett argues, present vividly imagined worlds in which certain values hold sway, casting new light onto those values; and the more plausible and well rendered readers find these imagined worlds, the more thoroughly we can evaluate the justice of those values. In an innovative set of readings, Linett thinks through the ethics of animal experimentation in H.G. Wells’s The Island of Doctor Moreau, explores the elimination of aging in Aldous Huxley’s Brave New World, considers the valuation of disabled lives in Flannery O’Connor’s The Violent Bear It Away, and questions the principles of humane farming through reading Kazuo Ishiguro’s Never Let Me Go. By analyzing novels published at widely spaced intervals over the span of a century, Linett offers snapshots of how we confront questions of value. In some cases the fictions are swayed by dominant devaluations of nonnormative or nonhuman lives, while in other cases they confirm the value of such lives by resisting instrumental views of their worth—views that influence, explicitly or implicitly, many contemporary bioethical discussions, especially about the value of disabled and nonhuman lives. Literary Bioethics grapples with the most fundamental questions of how we value different kinds of lives, and questions what those in power ought to be permitted to do with those lives as we gain unprecedented levels of technological prowess.
