Eva Pils offers a nuanced account of this contentious area, examining human rights as a set of social practices. Drawing on a wide range of resources including years of interaction with Chinese human rights defenders, Pils discusses what gives rise to systematic human rights violations, what institutional avenues of protection are available, and how social practices of human rights defence have evolved. Three central areas are addressed: liberty and integrity of the person; freedom of thought and expression; and inequality and socio-economic rights. Pils argues that the Party-State system is inherently opposed to human rights principles in all these areas, and that – contributing to a global trend – it is becoming more repressive. Yet, despite authoritarianism's lengthening shadows, China’s human rights movement has so far proved resourceful and resilient. The trajectories discussed here will continue to shape the struggle for human rights in China and beyond its borders.

To this end the definition of human rights from a United Nations perspective will be used. After briefly looking at the history of human rights abuses in China, the paper turns towards the main analysis shedding light on the EU’s conditional engagement policy towards China and the nature of the EU-China relations - whether it be a true strategic partnership or merely a strategic dialogue. The paper then evaluates the success of the EU’s policy by looking at how far it has been able to achieve its objectives set with regard to human rights in the PRC. Moving on from the achievements to date, a critical outlook on the prospects of Europe’s strategy is given comprising an analysis of the opportunities and challenges the EU is likely to face in this respect. Finally, the paper concludes that the impact of the European Union on the human rights development in China remains far from clear-cut. Whereas some scholars and politicians attribute much of the observed advancements to Europe’s conditional engagement policy, others challenge this view and contest that developments in this area are predominantly related to China’s overall economic progress. While the truth probably lies somewhere in between these two opposing views, future human rights development in the PRC will nevertheless remain a challenging task. Whereas developments on the economic and social side are also in China’s interest and will thus be relatively easy to promote, holistic progress - including civil and political rights - will only be possible if substantial differences between the EU and China can successfully be dissolved. Amongst other things, this will require the development of deep mutual cultural understanding and the discovery of sophisticated, novel negotiation approaches. Due to the complexity and sensitivity of the involved issues meaningful progress will only develop gradually, though, and the achievement of a universally acceptable human rights standard in China will still require a substantial amount of time as well as the willingness to compromise on behalf of both parties.

The reform of ‘old’ social organizations and the emergence of new, privately-initiated, non-profit organizations only began to occur in the 1980s, and such organizations continued to expand throughout the 1990s. Within a short period these new organizations have become a vibrant force in Chinese society. This unique volume – the first book in English to offer systematic and critical research in this field - is the outcome of a three-year research project on the Legal Aspects of Social Organisations in China. The main aim of the project was to encourage Chinese researchers to deepen their knowledge and understanding of the current status of social organizations in China, and to allow them to explore possible ways of creating a friendly legal environment conducive to the exercise of the right to freedom of association. The book contains some of the best results of the Chinese researchers’ work and papers presented by European experts at two international seminars, organized jointly by the Institute of Law of Chinese Academy of Social Sciences and Law Faculty of Utrecht University, The Netherlands. At stake, however, are much more than moral concerns and hurt national feelings. To Washington, the undemocratic nature of the Chinese government makes it ultimately suspect on all issues. To Beijing, the human rights pressure exerted by the West on China seems designed to compromise its legitimacy. As China's economic power grows and its influence on the politics of developing countries continues, an understanding of the place of human rights in China's foreign relations is crucial to the implementation of an effective international human rights agenda. In Human Rights in Chinese Foreign Relations, Ming Wan examines China's relations with the United States, Western Europe, Japan, and the United Nations human rights institutions. Wan shows that, after a decade of persistent external pressure to reform its practices, China still plays human rights diplomacy as traditional power politics and deflects pressure by mobilizing its propaganda machine to neutralize Western criticism, by making compromises that do not threaten core interests, and by offering commercial incentives to important nations to help prevent a unified Western front. Furthermore, at the UN, China has largely succeeded in rallying developing nation members to defeat Western efforts at censure. In turn, it is apparent to Wan that, while the idea of human rights matters in Western policy, it has seldom prevailed over economic considerations or concerns about national security. Western governments have not committed as many policy resources to pressuring Beijing on human rights as to other issues, and the differing degrees of commitment to human rights-related foreign policy explain why Japan, Western Europe, and the United States, in that order, have gradually retreated from confronting China on human rights issues.
