Book excerpt: The No Child Left Behind Act of 2001 was signed into law in an effort to reduce the educational achievement gap in America. One of the most important goals of the law is to have 'all' students in the public school system at grade level in math and reading by the year 2014. The spirit of the law appears to encompass the learning and educational development for each student. However, the letter of the law and the terminology used do not appear to actually include all students. Many believe that the law is discriminatory for various groups of students including students with disabilities. The law doesn't appear to take into consideration the various levels of disabilities i.e. mild, moderate, and/or severe. This thesis explores the perception of educators (administrators, general educator and special educators) and parents on NCLB and its influence or affects on students with disabilities. The diversity of perceptions by these groups may contribute to how students with disabilities are regarded with respect to access to an equitable public education. The results indicate a need for clarification of the terminology used in the law, as well as in-service training that involve parents and educators. Specifically, this hearing was held to determine how the No Child Left Behind Act helps, hurts, or keeps about the same, what has been done for children with disabilities. The Subcommittee heard recommendations on how to improve both special and general education programs, the need to prepare all teachers to work with all students, and how to improve No Child Left Behind to ensure that it accounts for the complexities that states, school districts, and schools must address in educating and assessing students with disabilities. Testifying before the Subcommittee were Hon. Charles W. Boustany, Jr., a Representative in Congress from the State of Louisiana; Hon. Susan A. Phil Hare, a Representative in Congress from the State of Illinois; the Illinois Positive Behavior Intervention and Support Program (PBIS); the American Occupational Therapy Association (AOTA); Hon. Dale E. Kildee, Chairman, Subcommittee on Early Childhood, Elementary and Secondary Education; and the National School Boards Association (NSBA). Witnesses were: Dr. Rebecca H. Cort, deputy commissioner, Office of Vocational and Educational Services for Individuals with Disabilities (VESID), New York State Education Department; Dr. Michael L. Hardman, dean-designate, College of Education, University of Utah; William Henderson, Ed.D., principal, the O'Hearn Elementary School; Rachael Quenemoen, senior research fellow, National Center on Education Outcomes, University of Minnesota; and Jane Rhyne, Ph.D., assistant superintendent, Programs for Exceptional Children of the Charlotte-Mecklenburg Schools. Book excerpt: In 2004, the National Council on Disability (NCD) issued a report called "No Child Left Behind: Improving Educational Outcomes for Students with Disabilities," which examined the impact of No Child Left Behind (NCLB) and the Individuals with Disabilities Education Act (IDEA) on improving educational outcomes for students with disabilities. This report provides both a follow-up and a more detailed reporting of the trends and attitudes about NCLB and IDEA over the past several years. The authors spoke to dozens of researchers, practitioners, and state administrators from across the country about NCLB and IDEA. In addition, they conducted a study of 10 of the largest states in the nation, representing approximately half the U.S. general population. This report is divided into four sections. Part I provides a brief overview of trend data regarding students with disabilities. Part II describes conversations with state administrators and representatives about trends and issues related to NCLB and IDEA. Part III describes similar conversations with advocates, federal officials, and other stakeholders. Part IV provides recommendations based on the authors' findings. Board of Education, a decision that declared segregated schools cannot be equal, it affirmed the right of every student access to equal education. Prior to this law students with disabilities were taught in separate facilities. This court case deemed the separation as unconstitutional and students with disabilities were able to attend schools amongst general population. Despite this ruling there has still been academic achievement gaps amongst students in the public education system. No child left behind Act made this issue a national crisis. The law reassessed the public-school system and decided American students needed proficiency in reading and Mathematics. It also aimed to increase graduation rates for all students. But, did NCLB really include all students? Did it account for those 6.7 million enrolled in special education programs? This report assesses stakeholder perception of NCLB as it relates to disabled student's education objectives. The researcher evaluates NCLB by comparing measurement of assessments with the intended goal to have all public education students graduate. While there are different types of assessments given to students with disabilities, all students are required to be assessed yearly. We will answer the question according to stakeholders, under NCLB is the United States public school system failing students with special needs? Stakeholders who would be most concerned and involved with this policy includes parents of disabled students, teachers, administrators and policy makers. We found that NCLB did shed light on educational discrepancies in public school education. For example; there was a high number of students not proficient on their assessment because the exam was not tailored to the students IEP. It is important to realize that education policy derives from a top down approach were policy makers prescribe solutions for educational hurdles that arise for general population students in public schools. The issue we found with the NCLB act is that this approach must be bottom-up to adhere to the many conflicts in educating students with disabilities. National education policy can use this study to include more special education framework and collaborative governance at the start of policy formation. We concluded that NCLB made shortcomings in education for students with disability a frequent topic of discussion, however it did not increase graduation rates for disabled students.
