There is a growing interest in further developing cross-border collaboration in the field of health, both at a bilateral and a multilateral level. This is supported by European Union (EU) legislation and policies, and extends to improving access to health technologies.2. Changes in health technologies markets, such as the generalization of managed entry agreements (MEAs) and the prevailing lack of price transparency - particularly in price discounts - require different approaches to those applied in the past.3. There is a sound rationale for increased voluntary collaboration between countries in the procurement of health technologies: to enhance transparency through better information sharing to enable cross-country learning by sharing experience to strengthen bargaining power and mitigate overly high transaction costs by pooling skills, capacities and through joint negotiations to ensure sustainable access to health technologies by sharing resources through cross-border exchange of products in short supply.4. However, in practice, developing sustainable cross-border collaboration in procurement seems to be challenging. Experiences in Europe are still limited and too recent to really allow clear lessons to be drawn about their effectiveness and impact.5. Nevertheless, it is clear that related initiatives would require strong political commitment and mutual trust between purchasing partners in order to succeed. It is therefore advisable that they be built progressively, starting with collaboration in information sharing and knowledge exchange, before moving towards joint purchasing activities.

Structured cooperation works at different levels (linking countries; health care or training bodies; and/or clusters of organizations and individuals) but is always influenced by the institutional framework in which it takes place and the underlying European and national legal and policy frameworks.4. Evaluation of different models of structured cooperation is still scarce but policy-makers can enhance the chances of structured cooperation succeeding by reviewing the five main groups of factors that can enable or block success, specifically: legal factors including differences between jurisdictions on eligibility or licensing of products and medicines; political factors and the commitment to making exchanges work; economic factors including price and wage differences and the availability of EU funding; sociocultural factors and issues like trust, communication and language barriers which influence patient preferences and impact the level and quality of knowledge and information exchange that can be achieved; and organizational factors including context, the type of delivery system and any existing (informal) networks and relations.5. Policy-makers at a European and national level can support structured cooperation and address health workforce challenges in highly specialized care by: Building highly specialized care capacity throughout the EU through structured postgraduate training exchanges as a cross-border cooperation activity;Tailoring all structured cooperation to the context in which it takes place; Supporting successful initiatives on a structural basis, with political and financial support from domestic authorities and/or the EU; Using the grassroots experience of structured cooperation in highly specialized health care to inform macro-level policies when appropriate; Promoting the exchange of good practices in cross-border cooperation in (highly specialized) health care, not least as a way of inspiring health system actors to overcome health workforce challenges to the benefit of patients and health professionals.

Open trade can increase access to medical services and goods—and the critical inputs needed to manufacture them—improve quality and variety, and reduce costs. However, excessive concentration of production, restrictive trade policies, supply chain disruptions, and regulatory divergence can jeopardize the ability of public health systems to respond to pandemics and other health crises. Trade Therapy: Deepening Cooperation to Strengthen Pandemic Defenses, coordinated by Nadia Rocha and Michele Ruta at the World Bank and Marc Bacchetta and Joscelyn Magdeleine at the World Trade Organization, provides new data on trade in medical goods and services and medical value chains, surveys the evolving policy landscape before and during the pandemic, and proposes an action plan to improve trade policies and deepen international cooperation to deal with future pandemics. As the COVID-19 pandemic lingers, the focus of policy action is on the response, which includes actions aimed at removing bottlenecks and providing government support to promote equitable access to vaccines. As the emergency subsides, the focus should shift to prevention and preparedness. Steps to close information gaps—building on the Multilateral Leaders Task Force on COVID-19, the ACT-Accelerator, and the open markets, for example—by negotiating tariff reductions on medical goods and greater market access in services should take priority. Also important are measures to improve the efficiency of markets, which include harmonizing regulation through mutual recognition or equivalence of standards and creating international standards for essential medical goods, inputs, and production processes. Agreement on a crisis rulebook to be deployed during an emergency—including clear and agreed limits on export policy flexibility and shared rules on intellectual property flexibilities—would provide a more solid policy foundation to address future challenges.

Ensuring efficient and transparent public procurement can contribute to address many of Europe's major challenges, especially in creating sustainable growth and jobs. Public authorities, by increasing efficiency of public spending to obtain better value for money, can contribute to a more innovative, sustainable, inclusive and competitive economy, while delivering better outcomes for societal and other public policy objectives. In addition, improving procurement is part of the stronger single market strategy pursued by the European Commission. Transparency and competition can lower prices and increase the quality of goods and services purchased by national contracting authorities and create a larger cross-border tendering in the EU. A well-functioning public procurement market, ensuring high level of openness and competition, would benefit European companies and ultimately, all European citizens enjoying a higher quality and effective public spending. Companies bidding for public contracts in their own, as well as other EU Member States, would benefit from improved access to procurement markets. At the same time, these rules aim to create better SME opportunities and ensure reciprocity with trading partners outside the EU. Technological acceleration and digitalisation, changing demographics and evermore interconnected markets strongly affect our societies and economies. In a globalised world, the economic integration brought about by the single market remains a key driver for wealth creation and competitiveness, and therefore our best protection. A clear and precise picture of the cross-border public procurement trends is therefore needed to help the European Commission adopt informed actions and potentially re-shape the applicable legal framework. This study depicts the recent cross-border activity in public procurement in the EU27 and updates the timelines of relevant indicators calculated in two previous studies1 of similar scope. It closely follows the structure and the methodologies of the previous work on the subject, and both take a top-down approach in describing the EU27 cross-border public procurement: first by presenting the macro data that sheds light on the potential size of the market, and second by performing a statistical analysis using micro data to quantify and formally analyse the factors related to cross-border procurement. Additionally, this work presents novel aspects that reflect increased integration arising from the extension of the global value chains. It also contributes to the macro measurement and, to some extent, the micro measurement by presenting a novel quantification of the cross-border public procurement that includes the existing value-added supply chains. Finally, the complete study contains a vast amount of information on the characteristics of the public procurement contract awards registered in the Supplement to the Official Journal from 2016 to 2019, with some sections covering even wider time frame (2009-2016). This executive summary only reports a selected number of these characteristics together with the main key findings.

The 2014 reform of the EU public procurement rules (mainly Directive 2014/24) has expanded the tool-kit available to contracting authorities willing to engage in joint or centralised procurement activities, and in particularly in cross-border procurement collaboration. In a push forward, and as part of the Strategy for a deeper and fairer single market in its larger context, the European Commission is developing a policy to facilitate and promote cross-border collaborative public procurement in the European Union. This paper adopts a sceptical approach and critically assesses the political, economic and in particular legal factors that can facilitate or block such development. To do so, it focuses on a case study based on a theoretical scenario of cross-border collaboration between centralised purchasing bodies in different EU Member States. The paper ultimately aims to establish a blueprint for future legal research in this area, in particular regarding the emergence of trans-EU public law.

Book excerpt: Under the European Directive on the application of patients' rights in cross-border health care, the development of European reference networks was promoted as one of the prime areas for cross-border cooperation among Member States. These networks are meant to improve access to and provision of high-quality health care to all patients who have conditions requiring a concentration of specialized resources or expertise. At the same time they could act as focal points for medical training and research, information dissemination and evaluation, especially for rare diseases. The idea of pooling resources in order to better address medical conditions that are rare or require very specialized expertise or equipment, corresponds with moves towards concentration of specialized health care services, often motivated by common health systems challenges like tightening financial constraints, workforce shortages and growing attention for quality and safety. This book examines the different ways in which the concept of reference networks has been implemented in European countries, and what kind of medical conditions or interventions it covers in various countries. It also looks at the motivations behind the establishment of such networks, the regulatory and administrative processes for identifying and designating them, as well as the financial arrangements needed for their proper functioning. This study outlines the key policy implications and challenges for developing the concept of reference networks at national and European levels. Ultimately we aim to provide a better understanding of the issues that may be encountered when implementing the Directive.
