Book excerpt: While it accepts that there may be a pressing need to reform non-party campaigning, the report Legislative Scrutiny: Transparency Of Lobbying, Non-party Campaigning And Trade Union Administration Bill (HL 61, HC 755) calls on the Government to pause the passage of the Transparency of Lobbying, Non-party Campaigning and Trade Union Administration Bill to allow for further scrutiny and for further consultation with the Electoral Commission, the Commission on Civil Society and Democratic Engagement and relevant stakeholders. The report recommends that there be more careful consideration of the potential impact on campaigners' rights to free speech and freedom of association. The Committee welcomes the Government improvements made to Part 2 during its passage though the Commons, but suggest that concerns remain. The Joint Committee express concerns regarding: the lack of clarity about the practical effects of the provision in this Part of t

Download or read book House of Lords House of Commons Joint Committee on Human Rights Legislative Scrutiny Offender Rehabilitation Bill HL 80 HC 829 written by Great Britain: Parliament: Joint Committee on Human Rights and published by The Stationery Office. This book was released on 2013-11-18 with total page 48 pages. Available in PDF, EPUB and Kindle. Book excerpt: This report welcomes the Bill's potentially human rights enhancing objectives of taking measures to protect the public from crime, at the same time as focusing on rehabilitation and extending positive support to those vulnerable people who receive short-term prison sentences. However, it remains concerned that insufficient information was provided by the Government (i) to demonstrate the compatibility of the provisions of the Bill with relevant international standards other than the ECHR and (ii) to support its assertion that the proposals have been considered fully in line with the requirements of the Equality Act 2010. The Committee calls on the Government to publish the information which demonstrates this without delay. The Committee welcomes the Government's assurance that private providers of probation services are obliged to act compatibly with human rights law but recommends that there should be statutory provision in the Bill setting out the providers' duties. The Committee calls on the Government to develop clear guidance on the human rights obligations of private probation providers, and to set out how it will monitor the performance of the contracted providers in this regard

This book was released on 2013-12-13 with total page 88 pages. Available in PDF, EPUB and Kindle. Book excerpt: The report The Implications For Access To Justice Of The Government's Proposals To Reform Legal Aid (HL100, HC 766) concludes that the government should reconsider its proposals for the reform of legal aid. The government has so far made welcome exemptions to its proposed residence test in the light of responses to its consultation, but the Committee is still not satisfied that the proposed test will not affect vulnerable groups. While accepting that it is legitimate for the government to introduce a residence test for civil legal aid and to restrict the scope of prison law funding, the Committee calls for more and broader exemptions from these proposals to avoid breaches of the fundamental right of effective access to justice in individual cases. The exceptional funding framework may not be working as intended and could therefore leave certain groups unable to access legal aid when human rights law requires it. The proposal to remove cases with

This book was released on 2014-03-03 with total page 48 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Joint Committee on Human Rights accepts that the measures in the Immigration Bill serve the legitimate aim of immigration control, but is concerned that some of them may be applied in practice in a way which breaches human rights in particular cases. The Committee is particularly concerned about the risk of the new provisions relating to residential tenancies giving rise in practice to homelessness in the case of people who have no right to remain in the UK but face genuine barriers to leaving. The Committee is also concerned to ensure that these measures do not give rise to an undue risk that migrant children will be exposed to homelessness or separation from family members. The provisions in the Bill on access to residential tenancies may heighten the risk of racial discrimination against prospective tenants, notwithstanding the fact that such discrimination is unlawful under the Equality Act. The First Tier Tribunal, not the Secretary of State, should decide whether it is within

This book was released on 2013-10-18 with total page 12 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Transparency Of Lobbying, Non-Party Campaigning And Trade Union Administration Bill (HL 62), the Select Committee on the Constitution raises significant concerns about the content and handling of the Transparency of Lobbying, Non-Party Campaigning and Trade Union Administration Bill. The Bill, which regulates lobbying and sets rules on expenditure by persons or bodies other than political parties at elections, is due for its second reading in the Lords on 22 October 2013. The report says that effective parliamentary scrutiny is of manifest importance for legislation of constitutional significance. The Committee questions whether the significant lowering of the cap on expenditure at general elections by third parties is justified, given the fundamental constitutional right to freedom of political expression. There has been a lack of consultation by the Government on the proposals, including with the Electoral Commission, as well as the lack of

Book House of Commons Political and Constitutional Reform Committee The Government s Lobbying Bill Volume I HC 601 I

Download or read book House of Commons Political and Constitutional Reform Committee The Government s Lobbying Bill Volume I HC 601 I written by Great Britain: Parliament: House of Commons: Political and Constitutional Reform Committee and published by The Stationery Office. This book was released on 2013-09-19 with total page 52 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Committee supports the aims of increasing transparency in lobbying and effectively and fairly regulating third-party campaigning, but finds that the Government's bill is seriously flawed, because of inadequate consultation and a lack of pre-legislative scrutiny. Moreover, the definition of "consultant lobbying" is so narrow that not only would it exclude in-house lobbyists, which was the Government's intention, but it would also exclude the vast majority of third-party lobbyists and particularly the larger organisations. Many companies undertake lobbying as part of a wider communications and public relations business, and they spend very little of their time meeting directly with Ministers and Permanent Secretaries, meaning they could argue they were exempt from registering. The register should be expanded to include in-house lobbyists, and to cover the provision of advice on lobbying, as well as direct contact with Ministers and Permanent Secretaries. Special Advisers and Senior Civil Servants should be included in the list of people with whom contact counts as lobbying. Part 2 of the Bill, on non-party campaigning, and particularly the definition of spending "for electoral purposes" is confusing. The Committee urges the Government temporarily to withdraw the Bill and support a motion in the House to set up a special committee to carry out pre-legislative scrutiny, using the text of the existing Bill as a draft. The special committee should be charged with producing an improved Bill within six months.

Book House of Commons Committee on Standards The Transparency of Lobbying Non Party Campaigning and Trade Union Administration Bill HC 638

Download or read book House of Commons Committee on Standards The Transparency of Lobbying Non Party Campaigning and Trade Union Administration Bill HC 638 written by Great Britain: Parliament: House of Commons: Committee on Standards and published by The Stationery Office. This book was released on 2013-09-04 with total page 16 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Committee's accepts the Leader of the House's assurance that the Transparency of Lobbying, Non-Party Campaigning and Trade Union Administration Bill (HCB 97, 2013-14 (ISBN 9780215057969)) was never intended to capture the normal work of Members as Members. Nevertheless they consider the approach the Government has taken to drafting the definition of consultant lobbying is unsatisfactory. The Bill is unclear in its definition of consultant lobbying and, in particular, about the way in which its provisions would apply to Members. The sweeping powers to refine this definition delegated to the Registrar of Consultant Lobbyists are unacceptable. It is perfectly possible that the courts and the Registrar of Consultant lobbyists will clarify that the definition does not extend so far. But primary legislation should be unambiguous about such matters. The difficulties about the way in which this legislation applies to Members of Parliament would be swept away if paragraph 2 of Schedule 1 was removed. It is necessary to make clear that Members' ordinary work is not caught by the Bill. A new subparagraph should be added to paragraph 6, stating that a reference to payment does not include a reference to the salary an MP receives as a Member of the House of Commons

Download or read book House of Lords House Of Commonos Joint Commmittee on Human Rights Legislative Scrutiny Immigration Bill HL 102 HC 935 written by Great Britain: Parliament: Joint Committee on Human Rights and published by The Stationery Office. This book was released on 2013-12-18 with total page 56 pages. The First Tier Tribunal, not the Secretary of State, should decide whether it is within its jurisdiction to consider a new matter raised on an appeal. In the report, the Committee concludes that the restriction on appeal rights might constitute a serious threat to the practical ability to access the legal system to challenge unlawful immigration and asylum decisions, and to enforce the statutory duty to have regard to the need to safeguard and promote the welfare of children when exercising immigration and asylum functions. The Committee also comments on other aspects of the Bill.

Book Devolution in the UK

Download or read book Devolution in the UK written by James Mitchell and published by Manchester University Press. This book was released on 2013-07-19 with total page 410 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explains devolution today in terms of the evolution of past structures of government in the component parts of the United Kingdom. Available in paperback for the first time, it highlights the importance of the English dimension and the role that England’s territorial politics played in constitutional debates. Similarities and differences between how the components of the UK were governed are described. It argues that the UK should be understood now, even more than pre-devolution, as a state of distinct unions, each with its own deeply rooted past and trajectory. Using previously unpublished primary material, as well as a wealth of secondary work, the book offers a comprehensive account of the territorial constitution of the UK from the early twentieth century through to the operation of the new devolved system of government.
