Book excerpt: Companies House has two main functions: the incorporation, dissolution and restoration of limited companies; and the maintenance of a register of company details, annual reports and accounts which it makes available for public inspection. It funds its work by charging fees and pays a small dividend to the Treasury each year. Companies House handles a vast amount of data. It is now doing much more of this electronically. This move has not been entirely smooth. In the Committee's view, the greatest difficulties facing Companies House, and those who use its services, arise from matters which are not directly controlled by Companies House itself - namely the way in which the internet has enabled faster and easier access to information. The Committee makes a number of recommendations about assessing particular risks and trying to reduce them. An underlying theme of this report is the need for Companies House to do more to explain the limitation of the information it holds. It is felt that much more could and should be done to make clear that the role of Companies House is to receive and publish data and that its power to verify information is extremely limited

The report calls for a change in the way we tackle criminal justice and seek to cut re-offending. The Committee states that the criminal justice system faces a "crisis of sustainability" if resources continue to be absorbed by an ever-expanding programme of prison building rather than on preventing crimes from being committed, with prison building not being an effective long-term answer to coping with the already record-breaking prison population which is predicted to rise further. The average prison place costs £41,000 a year (plus further capital costs and health and education expenditure on top), with the Government's new prisons costing - on current estimates - up to £4.2 billion over the next 35 years. The Committee believes that a more "prudent, rational, effective and humane" use of resources is needed to shift the focus of expenditure away from incarceration and towards rehabilitation and prevention. This would involve investment in local education, health, drug, alcohol and community programmes in targeted areas based on analyses of where offences occur, where offenders live and "what works" in reducing offending. Book excerpt: In its report examining the impact of Lord Leitch's 2006 review of skills ("Prosperity for all in the global economy - world class skills", 2006, ISBN 9780118404860), the Innovation, Universities, Science and Skills Committee says the Government must place re-skilling at the heart of its skills policy in order to meet the challenges of recession and redundancies. Re-skilling rather than up-skilling should be the priority as redundancies force people to move to other sectors. Government focus should be on tackling skills shortages and approaching skills as part of wider national economic development planning. The Committee recommends that more flexibility is built into training support to ensure skills development meets current and future demand. The abolition of the Learning and Skills Council and the creation of a new Skills Funding Agency for post-19 training could add to existing confusion about training and skills provision. The system must be simplified and the Government should quickly provide clarity on the roles of the different organisations and ensure the system can be understood by its users. It is essential that the Government's Train to Gain programme is made flexible enough to deal with rapid adjustments for unemployed people who need quick re-training. Aspects of Train to Gain are currently failing to satisfy different demands and unless the programme is radically re-focused one of Leitch's central reform planks will be lost. The sustainability of co-funded higher education courses is a concern and the Committee warns that the current economic downturn may affect the willingness of employers to meet the required level of investment.

As a member of the House of Lords he is unable to answer questions in the House of Commons. The report compares the current situation with previous examples of Cabinet ministers being in the House of Lords. The Committee notes that the current situation differs from the past in that a significant proportion of the ministerial support team is based in the Lords or shared with other departments. It is unfortunate that the department for business is so thinly represented in the Commons. One solution would be to amend Standing Orders to allow Lord Mandelson to appear at the Despatch Box to answer questions in the Commons. There are precedents for this approach. Such a change might, though, encourage governments to appoint more members of the House of Lords as department heads, and the Committee feels that would be an unwelcome and significant constitutional change. The Procedure Committee should investigate a mechanism for parliamentary questions to the Secretary of State for Business, Enterprise and Regulatory Reform.

Book excerpt: The run on deposits at Northern Rock in September 2007 was one of the key moments in a financial crisis. After nationalising Northern Rock in February 2008, the Treasury eventually decided to split out a new retail bank, ("Northern Rock plc"), for sale, and to run-down the majority of the mortgage assets in a separate public sector vehicle, Northern Rock (Asset Management) plc ("NRAM"). Northern Rock plc was sold to Virgin Money in 2011 for proceeds currently estimated at £931 million, an expected loss of £469 million. The Treasury hopes to recover all the public funds provided to Northern Rock but this is far from certain as it relies on a profitable wind-down of NRAM. Moreover there will still be an economic loss, currently estimated at £2 billion. The Treasury took too long to nationalise the bank and failed to make an effective challenge to the bank's business plan. The Treasury has started to address this lack of capacity: it has established UK Financial Investments ("UKFI") with a small team of 12 people to manage the taxpayer shares in banks. The £66 billion cash spent purchasing shares in RBS and Lloyds may never be recovered. In hindsight, the Treasury's decision to create and sell a new bank turned out to be no worse than any available alternative, because no matter which part of the bank was sold, or when, a larger amount of assets would need to be retained in public ownership.

Warning of water scarcity in the South and East of England, the Committee calls for the creation of a 'water efficiency obligation' to ensure the regulatory regime emphasises the need to preserve resources and to rewards customers who install efficiency measures. Other recommendations are made on the uneven regional impacts of investment in water infrastructure, the impacts of climate change, and the issue of transparency, from the price review process itself to how well Ofwat currently requires companies to demonstrate they undertake effective consultation with consumers during business planning.
