Book HC 449 Pre Legislative Scrutiny of the Draft Wales Bill

Download or read book HC 449 Pre Legislative Scrutiny of the Draft Wales Bill written by Great Britain. Parliament. House of Commons. Welsh Affairs Committee and published by The Stationery Office. This book was released on 2016-02-28 with total page 4 pages. Available in PDF, EPUB and Kindle. Book excerpt: Due to the compressed nature of pre-legislative scrutiny, the Committee was not able to cover all provisions in the draft Bill in detail. Evidence covered a number of areas, but the three main aspects of the draft Bill that were raised, and on which this Report focuses, are: the transition to a reserved powers model; the reservation of criminal and private law and the necessity tests; and the consenting arrangements. The majority of witnesses have suggested improvements to the draft Bill. Some of these, such as replacing the "necessity" test with a test that is clearer and has a lower threshold, and that in relation to Ministerial consent, that the UK Government transfers to the Welsh Ministers all Ministerial functions in areas of devolved legislative competence, the Committee have been able to agree upon. Some of the evidence received raised other important and relevant issues; in particular many witnesses proposed a form of distinct legal jurisdiction. This issue may not have been apparent to all potential witnesses at the outset of the inquiry, so the Committee cannot be confident they received all relevant evidence on this important subject. They now ask the Secretary of State to reflect on the recommendations. There is a growing body of Welsh law that differs from that which applies in England, but the implications of this requires careful scrutiny. The Committee shares the view of the Silk Commission, that the UK and Welsh governments will need to continue to review the issue of a separate or distinct Welsh jurisdiction

Book House of Commons Welsh Affairs Committee Pre Legislative Scrutiny of the Draft Wales Bill HC 962

Download or read book House of Commons Welsh Affairs Committee Pre Legislative Scrutiny of the Draft Wales Bill HC 962 written by Great Britain: Parliament: House of Commons: Welsh Affairs Committee and published by The Stationery Office. This book was released on 2014-03-03 with total page 60 pages. Available in PDF, EPUB and Kindle. Book excerpt: The draft Wales Bill was published following the recommendations of the Silk Commission in November 2012. It sets out to devolve tax and borrowing powers to the Welsh Government and National Assembly for Wales, make changes to the electoral arrangements of the National Assembly for Wales, and clarify and update the devolution settlement. The Government hopes that the provisions in the draft Wales Bill will enable devolved governance in Wales to become more accountable. The cross-party Committee believes partial devolution of income tax to the Welsh Government should be put to the people of Wales in a referendum. The cross-party Committee also has sympathy with the argument that the issue of "fair funding" must be resolved before any income tax powers are devolved so that Wales is not unfairly disadvantaged. The issue of fair funding - how the size of the block grant from the UK Government is determined, currently by the Barnett formula which has long been criticised as providing an unfairly low allocation to Wales - needs to be examined and should not wait until after the 2015 General Election. The National Assembly for Wales should have power to decide its own Assembly term length, rather than this being decided at Westminster. The Committee recommends the clause in the draft Bill which permanently extends the length of the Assembly from four to five years should be scrapped and replaced with provisions that give the National Assembly the powers to determine the length of its own electoral term.

Book HC 284 Energy Generation in Wales Shale Gas

Download or read book HC 284 Energy Generation in Wales Shale Gas written by Great Britain. Parliament. House of Commons. Welsh Affairs Committee and published by The Stationery Office. This book was released on 2014 with total page 44 pages. Available in PDF, EPUB and Kindle. Book excerpt: Shale gas represents an opportunity for Wales but it must not come at the expense of Wales's natural environment. Both the UK and Welsh Governments must consider environmental risks, including the traffic and noise caused by commercial shale gas operations as well as the visual impact and other environmental risks associated with fracking. The issue of treatment, transportation and disposal of wastewater is a growing concern: toxic and radioactive water must not be allowed to contaminate water courses. The Government forecasts that nearly 70% of the UK's gas supply will be imported by 2025. It is vital that the UK identifies new sources of gas if it is to safeguard the UK's security of supply. Shale gas production across the UK is currently at the exploratory stage and there is no good data yet on the amount of shale gas in Wales. Should considerable reserves of shale gas be present-as industry representatives predict-it could be a decade before a viable shale gas industry is created in Wales. The UK Government and the Welsh Government should work with commercial companies and others to provide a reliable range of estimates of shale gas available in Wales and assess the overall impact of shale gas supply on the level and mix of energy produced in Wales and the UK. The Welsh Government should also begin to consider how the employment opportunities presented by shale gas production could be maximised

This book was released on 2006-03-16 with total page 53 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Government of Wales Bill will have constitutional implications that the Select Committee on the Constitution believes require scrutiny. The Bill seeks to take the next step in the devolutionary process and sets out five main aims: to differentiate between the National Assembly for Wales from the Government of the Assembly; to alter the way people are elected to the Assembly, preventing persons standing simultaneously as a candidate on a regional list and for a constituency; develop the law-making powers of the Assembly, delegated through Parliament; set out a scheme for the devolution of primary legislative powers to the Assembly; establish a Welsh Consolidated Fund. The Committee views the Bill as containing provisions of constitutional significance not only to Wales but for the future of the United Kingdom's scheme of devolution generally. The report sets out the background to the Bill, and examines the major constitutional issues.

Available in PDF, EPUB and Kindle. Book excerpt: Contrary to popular myth, Britain does have a constitution, one that is uncodified and commanded little political interest for most of the twentieth century. In the late 1990s, Tony Blair's New Labour Government launched a program of reform that was striking in its ambition. Reinventing Britain tells the story of Britain's constitutional reform and weighs its long-term significance, with essays both by officials who worked on the reforms and by other leading commentators and academics from Britain and North America. Book Criminalising Coercive Control

Download or read book Criminalising Coercive Control written by Marilyn McMahon and published by Springer Nature. This book was released on 2020-02-28 with total page 265 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book considers whether coercive control (particularly non-physical forms of family violence) should be prohibited by the criminal law. Based on the premise that traditional understandings of family violence are severely limited, it considers whether the core of family violence is power-based controlling or coercive behavior: attempts by men to psychologically dominate their partners. Such behavior can cause significant psychological, physical and economic harms to victims and is increasingly recognized as a form of human rights abuse. The book considers the new offences that have been introduced in England and Wales (controlling or coercive behavior), Ireland (controlling behavior) and Scotland (domestic abuse). It invites consideration of three key questions: Do conventional criminal laws adequately regulate non-physical abuse? Is the criminal law an appropriate mechanism for responding to the coercive control of family members? And if a new and distinctive offence is warranted, what is the optimal form of that offence? This ground-breaking work is essential reading for researchers and practitioners interested in coercive control and the proper role of the criminal law as a mechanism for regulating family violence.

Book Corporate Social Responsibility Corporate Restructuring and Firm s Performance

Download or read book Corporate Social Responsibility Corporate Restructuring and Firm s Performance written by Liangrong Zu and published by Springer Science & Business Media. This book was released on 2008-10-01 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: In today’s globalized and competitive business environment, companies increasingly look to restructuring, mergers & acquisitions and downsizing to survive, grow and maximize profits. However, when they are not managed in a socially responsible manner, restructurings may exert the negative impact on employees, shareholders, communities, and society as a whole. The book empirically explores the phenomena of corporate social responsibility (CSR), restructuring, and relationships with firms’ performance in China. It gives an insight into how Chinese firms respond to expectations of stakeholders by making social goals a part of their overall business operations. It also gives a fresh view of the new concept of socially responsible restructuring. For those seeking to promote socially responsible practices in restructuring, the book provides a unique and stimulating analysis and touchstone.

Book excerpt: "[A] most impressive achievement by an extraordinarily intelligent, courageous, and—that goes without saying—'well-read' mind. The scope of this work is enormous: it provides no less than a comprehensive, historically grounded theory of 'modern peoplehood,' which is Lie’s felicitous umbrella term for everything that goes under the names 'race,' 'ethnicity,' and nationality.'" Christian Joppke, American Journal of Sociology "Lie's objective is to treat a series of large topics that he sees as related but that are usually treated separately: the social construction of identities, the origins and nature of modern nationalism, the explanation of genocide, and racism. These multiple themes are for him aspects of something he calls 'modern peoplehood.' His mode of demonstration is to review all the alternative explanations for each phenomenon, and to show why each successively is inadequate. His own theses are controversial but he makes a strong case for them. This book should renew debate." Immanuel Wallerstein, Yale University and author of The Decline of American Power: The U.S. in a Chaotic World
