Book House of Commons European Scrutiny Committee Reforming the European Scrutiny Process in the House of Commons Volume I HC 109 I

Download or read book House of Commons European Scrutiny Committee Reforming the European Scrutiny Process in the House of Commons Volume I HC 109 I written by Great Britain: Parliament: House of Commons: European Scrutiny Committee and published by The Stationery Office. This book was released on 2013-11-28 with total page 138 pages. Available in PDF, EPUB and Kindle. Book excerpt: The depth and pace of EU integration has demonstrated the need for effective democratic parliamentary scrutiny and accountability of Government at Westminster. This is the first major inquiry into the European scrutiny system in the House of Commons for eight years. There is more that the Committee could do to look at the impact of new proposals. There should be a new requirement to appoint ’Reporters' to take the lead within Committees on EU issues, as well as a more coordinated approach to the Commission Work Programme. Whilst the system need not be scrapped as some have said, it must be enhanced. Many problems arise from the fact that new Members are appointed for each document. The Committee argues forcefully for a return to the permanent membership system, new powers and a change of name to reflect the Committees' core purpose: EU Document Debate Committees. The Committee also examined how EU business is taken on the floor of the House, and the procedures which apply to it. They set out a series of recommendations about the way debates are scheduled and conducted and put the case for a new session of ’EU Questions'. They also review working practices and the visibility of the House's scrutiny of the EU in the media. It concluded that now is the time to propose the introduction of a form of national veto over EU legislative proposals, and then to explore the mechanics of disapplication of parts of existing EU obligations, notwithstanding the European Communities Act 1972

Book Debating the Democratic Legitimacy of the European Union

Download or read book Debating the Democratic Legitimacy of the European Union written by Beate Kohler-Koch and published by Rowman & Littlefield Publishers. This book was released on 2007-04-18 with total page 403 pages. Available in PDF, EPUB and Kindle. Book excerpt: The discussion about a constitution for the European Union and its rejection by referendum in two of the EU founding member states has once again spurred public and scholarly interest in the democratic quality and potential of the European Union. Debating the Democratic Legitimacy of the European Union brings together distinguished thinkers from law, political science, sociology, and political philosophy to explore the potential for democratically legitimate governance in the European Union. Drawing on different theoretical perspectives and strands from democratic theory, this volume is the first of its kind to overcome the present state of fragmentation in the debate about the conditions and possible remedies for what is often called the "democratic deficit" of the European Union. Among the pressing questions addressed by the contributors are: What future is there for parliamentary democracy in the European Union? Can we observe the evolution of a European public sphere and civil society? Can participatory democracy or deliberative democracy pave the road for a democratically legitimate European Union? Conversations about democracy have engaged the public in a new way since the beginning of the Iraq war, and this volume is the best resource for students and readers who are interested in democracy in the European Union. Contributions by: Rudy B. Andeweg, Katrin Auel, Arthur Benz, Lars-Erik Cederman, Damian Chalmers, Deirdre Curtin, Donatella Della Porta, Klaus Eder, Erik O. Eriksen, Ulrich Haltern, Hubert Heinelt, Doug Imig, Christian Joerges, Beate Kohler-Koch, Christopher Lord, Paul Magnette, Andreas Maurer, Jeremy Richardson, Berthold Rittberger, Rainer Schmalz-Bruns, Michael Th. Book Health Law and the European Union

Download or read book Health Law and the European Union written by Tamara K. Hervey and published by Cambridge University Press. This book was released on 2004-11-04 with total page 541 pages. Available in PDF, EPUB and Kindle. Book excerpt: How does the law of the European Union affect health law and policy? At first sight, it seems limited. However, despite its restricted formal competence, the EU has recently become increasingly involved in the health field. Litigation based on EU law has resulted in a 'right to receive health care services' across national boundaries which may have huge practical implications for national health systems. The EU has promulgated legislation regulating clinical research, and the marketing of pharmaceuticals; patients' rights are affected by EU legislation on data protection and product liability; the qualifications of health care professionals are legally recognised across the EU; and the EU has acted to promote public health. This book explores the various impacts of measures of EU law on national health law and policy. Through elaboration of selected examples, the authors show that, within the EU, health law cannot be regarded as a purely national affair.
