This is the first major inquiry into the European scrutiny system in the House of Commons for eight years. There is more that the Committee could do to look at the impact of new proposals. There should be a new requirement to appoint 'Reporters' to take the lead within Committees on EU issues, as well as a more coordinated approach to the Commission Work Programme. Whilst the system need not be scrapped as some have said, it must be enhanced. Many problems arise from the fact that new Members are appointed for each document. The Committee argues forcefully for a return to the permanent membership system, new powers and a change of name to reflect the Committees' core purpose: EU Document Debate Committees. The Committee also examined how EU business is taken on the floor of the House, and the procedures which apply to it. They set out a series of recommendations about the way debates are scheduled and conducted and put the case for a new session of 'EU Questions'. They also review working practices and the visibility of the House's scrutiny of the EU in the media. It concluded that now is the time to propose the introduction of a form of national veto over EU legislative proposals, and then to explore the mechanics of disapplication of parts of existing EU obligations, notwithstanding the European Communities Act 1972

Book excerpt: This book investigates everyday practices of intelligence cooperation in anti-terrorism matters, with a specific focus on the relationship between Europe and Britain. The volume examines the effective involvement of British anti-terrorism efforts in European cooperation arrangements, which until now have been overshadowed by the UK-US ‘special relationship’ and by political debates that overstate the divide between Britain and continental Europe. In arguing that British intelligence has always had a European dimension, it provides a distinct perspective to the study of intelligence cooperation and the role of British intelligence therein. Mobilizing a ‘field theory’ approach, the book provides an original contribution to the understanding of intelligence cooperation by investigating everyday bureaucratic practices of ‘ground-level’ security professionals and police forces, embedded in a European ‘field’ structured around the exchange of anti-terror intelligence. It also accounts for the drivers behind cooperation by using ‘field analysis,’ which explains the trajectory and positioning of actors according to their ‘capitals’ rather than necessities dictated by threats or state decisions. Book excerpt: The Government has struck a reasonable balance in the way it is planning to exercise its right to opt-out of pre-Lisbon Treaty EU policing and criminal justice measures, but the way it has engaged Parliament in the decision-making process has been badly handled and 'cavalier'. The Government left the Commons select committees far too little time to assess the reasons for their decisions on EU justice opt-ins, and did not provide the full impact assessment which was needed. The Committee agrees with the Government's plans to seek to opt back into seven of the sixteen measures, and not to opt into a number of others. The Committee also raises questions about the Government's intention not to opt back into two specific instruments, the Probation Measures Framework Decision and the Framework Decision on the settlement of conflicts of jurisdiction. The Committee also calls on the Government to provide an assessment of the effect of the extension of the jurisdiction of the Court of Justice of the European Union over the measures covered by the opt-out. The Committee also agrees with the Government's proposal to seek to rejoin decisions on data protection in policing and criminal justice, and on a data protection secretariat, but says that the arguments are more finely balanced in relation to the Framework Decision on settlement of conflicts of jurisdiction

Book excerpt: In September 2012, the Prime Minister announced that the Government intended to exercise the right conferred exclusively on the UK by the Lisbon Treaty to opt out of EU criminal law and policing measures adopted before that Treaty entered into force on 1 December 2009. The Government's current thinking is that we will opt out of all pre-Lisbon police and criminal justice measures and then negotiate with the Commission and other Member States to opt back into those individual measures that it is in our national interest to rejoin. This report aims to set out, once again, the information the Government should provide to ensure genuine engagement with Parliament in the process leading up to the Parliamentary vote on the UK's block opt-out. The Government's decision on the block opt-out will have potentially far-reaching implications. It will affect UK citizens who may be sought for, or involved in, criminal proceedings in another EU Member State and how suspects who have fled abroad are brought to justice in the UK. Above all, it will affect the way in which Government seeks to ensure public safety and security while protecting its citizens' freedoms. The Government has not only failed to satisfy requests for timely information, but has also failed to meet its own deadlines for the provision of its Explanatory Memoranda and to provide any reasonable justification. The delay is unacceptable and irreconcilable with the Government's professed commitment to enhanced Parliamentary scrutiny of EU justice and home affairs matters

Both Houses of Parliament have endorsed the Government's decision to exercise the UK's block opt-out. The debate and vote in the House of Commons took place on 15 July 2013. Should the Government want to avoid a gap in the application of these 35 measures to the UK, proceedings in Parliament and the necessary decisions at EU level to confirm UK participation in the 35 measures must be completed no later than 1 December 2014 or, in the event of delay, necessary transitional measures would have to be agreed by that date. This is an area of policy which is highly legally complex and politically sensitive. Yet the Government has failed to provide the information Parliament needs to scrutinise these measures properly. There are two sets of conclusions in the Report: first, the Committee asks detailed follow-up questions on a number of the measures in question, including the European Arrest Warrant. Second, the Government's overall approach is thoroughly analysed. The Committee sees signs of incoherence in Government policy - probably a consequence of coalition politics - and observes that several of the explanations for the 35 measures the Government wants to rejoin appear to have been written as if the Government was not intending to rejoin them, and vice versa. The Committee concludes that the House must be given the opportunity to vote on each of the measures the Government proposes to rejoin before formal negotiations with the European Commission and Council begin

The Government has given notification of its intention to exercise the block opt-out. Its right to do so, and the conditions attached to the exercise of that right, are contained in Article 10 of Protocol 36 annexed to the EU Treaties. The block opt-out covers 130 EU police and criminal justice measures which had been adopted prior to 1 December 2009, the date of the entry into force of the Lisbon Treaty. The Committee has also set out: (i) That there are many problems with the European Arrest Warrant, in its existing form, in particular that it is on a system of mutual recognition of legal systems which in reality vary significantly; (ii) The Committee welcomes and supports the Government's reform package for the arrest warrant; (iii) The Committee recommends separate votes on the arrest warrant to the rest of the opt-in package at an early stage to provide a parliamentary mandate for the Government's negotiations.; (iv) The Committee concludes that if the Government proceeds with the opt-in as proposed, it will not result in any repatriation of powers. Indeed, the increased jurisdiction of the European Court of Justice may result in a net flow of powers in the opposite direction.

Many proposed applications of gene drive research aim to solve environmental and public health challenges, including the reduction of poverty and the burden of vector-borne diseases, such as malaria and dengue, which disproportionately impact low and middle income countries. However, due to their intrinsic qualities of rapid spread and irreversibility, gene drive systems raise many questions with respect to their safety relative to public and environmental health. Because gene drive systems are designed to alter the environments we share in ways that will be hard to anticipate and impossible to completely roll back, questions about the ethics surrounding use of this research are complex and will require very careful exploration. Gene Drives on the Horizon outlines the state of knowledge relative to the science, ethics, public engagement, and risk assessment as they pertain to research directions of gene drive systems and governance of the research process. This report offers principles for responsible practices of gene drive research and related applications for use by investigators, their institutions, the research funders, and regulators.
