Book excerpt: Against a background where farm incomes are falling, the Government needs to recognise that cutting payments to England's farmers will reduce their ability to compete in the marketplace, will leave farmers less able to invest in vital infrastructure and may make them more vulnerable to shocks such as poor weather, higher input costs and price variations. The Committee also warns against plans to transfer more money away from direct payments to farmers by shifting it towards environmental schemes. It recommends that the Government maintains the current 9% rate of transfer away from the direct payment budget. This rate of transfer should rise to 15% in 2017 only if it can demonstrate that additional funds are required and that this change will deliver a clear benefit. Money should also only go to people who actually farm the land and meet an 'active farmer test'. From 2015, 30% of the direct payment will be conditional on farmers achieving basic environmental measures. A National Certification Scheme approach to 'greening' does not offer the flexibility to avoid the Commission's impractical crop diversification rule so the Government is right to dismiss this approach. A new, single IT system is being developed, and the Government want access to CAP funding to be 'digital by default', meaning farmers will have to apply online. A lot went wrong in the last round of changes, and these problems gave rise to £580 million in penalties. Does it make sense to introduce a new computer system at the same time as complex new payment rules?

Defra is one of the smallest of Government Departments but it has faced among the most substantial budget cuts, which are set to continue up to 2016. Defra relies on a large number of arms length bodies to deliver many significant areas of policy. Ministers must clarify how further budgets cuts of over £300 million over the coming 2 years will impact on the funding provided to these agencies and the ability of the Department to respond to emergencies, exemplified by the flooding over Christmas and the New Year. Among the most significant challenges facing the Department in the next 12 months is implementation of the new Common Agricultural Policy, and there are risks that the introduction of a new digital system for delivering payments to farms will cause problems for those farmers who do not have access to rural broadband. The Committee found that the results of the Defra staff survey revealed an increased lack of confidence in the management and leadership of the Department, issues which must be addressed. Further challenges facing Defra in the coming year include policy relating to bovine TB and badger culling, its proposals on biodiversity offsetting, the introduction of plastic bag charging, and examining the role and potential of GM technology in food production.

The MPs are concerned that the Draft Bill contains only a broad framework and leaves too much of the important detail to be decided by the regulator, Ofwat, or to be introduced through secondary legislation that receives less parliamentary scrutiny. In welcoming the opportunities for greater competition within the retail water sector (providing billing services) the MPs ask Government to get on with implementing changes that would reduce flooding - many of which were recommended nearly five years ago. The MPs highlight the importance of managing our water resources sustainably and efficiently. They recommend that encouraging sustainable development be elevated to a primary duty of the regulator and that the Government brings forward legislation to enable the abstraction regime to be reformed by 2022. In addition they recommend implementation of existing provisions on bad debt and encouraging greater use of water meters, both of which would lower customers' water bills. However, the report concludes that the Government needs to undertake further work before embarking on "upstream" competition, which would enable companies to compete in the supply of water.

Book excerpt: In the Committee's report on broadband services it considers that the UK and Welsh Governments must work together and use all means available to bring broadband services in Wales up to speed with the rest of the UK, and eradicate broadband "slow spots" and "notspots" as a matter of urgency. Both Governments should consider promoting mobile and satellite technologies, particularly in remote areas of Wales in order to deliver this and not rely solely on rolling out fibre optic cabling. The availability of broadband has been consistently lower in Wales than the rest of the UK and although that gap has narrowed in recent years latest figures show the gap is widening again. The existence of notspots an slowspots has hindered existing businesses and deterred new businesses from choosing to locate to Wales - to the cost of the local economy.The Welsh Government's target is a commitment to provide all Welsh businesses with access to next-generation broadband by "the middle of 2016". The Committee also says that both Governments must ensure that the roll-out of superfast broadband is not achieved at the expense of delivering a good broadband service for all. The Committee recommends that Ofcom undertake a study to evaluate whether satellite broadband should be supported more vigorously in Wales; the delayed Spectrum auction, now planned for 2013, must ensure that 4G mobile services are available to at least 98% of people in Wales; and Ofcom must continue its efforts to open up access to infrastructure in Wales. BT's market power must be regulated effectively to ensure efficient operation of the market.

These changes include a new tier of environmental conditions, with penalties for farm businesses that do not comply or fail to meet new criteria for 'active' farmers, farm size and number of employees. The Committee sets out the key principles the UK government should promote. The first objective of the CAP should be to maintain and enhance the EU's capacity to produce food with a significant degree of self sufficiency and, in the long term, less reliance on income support from the tax payer. The UK's future food security is threatened by the low profitability of its agriculture. More than half of UK farm businesses would be unprofitable without the support they receive through the CAP. The Committee concludes that direct payments have a place within the CAP for as long as business conditions in agriculture fail to deliver a thriving and profitable industry. The CAP must deliver a competitive and viable agricultural sector that produces safe and high quality food with a lower environmental impact. The UK should press for the EU to argue more strongly for recognition of environmental and animal welfare production standards within trade agreements. The committee also warns that the EU proposal for a multi-tiered single farm payment will require expensive new computer systems and auditing.

The report also concludes that: biodiversity offsetting can deliver positive impacts on the natural environment; the target to end all peat use by 2030 shows a lamentable lack of ambition and a review of progress must be brought forward to 2014; Defra must set a target to increase public engagement with nature, since local authorities, NGOs and charities can only secure funding for environmental projects when they can demonstrate measurable success; the Department for Health and the Department for Education must define measurements which demonstrate how greater public engagement with nature delivers gains in public health and educational attainment; the entire coastal path around England should be in place within 10 years.

Book excerpt: The EU Single Payment Scheme replaced 11 previous subsidies to farmers based on agricultural production with one payment for land management. The European Commission gave some discretion to Member States over how to implement the scheme, and the Rural Payments Agency (RPA), which is responsible for administering the scheme in England, opted for the dynamic hybrid model which incorporates elements of previous entitlement and new regionalised area payments based on a flat rate per hectare. A NAO report (HCP 1631, session 2005-06, ISBN 9780102943399), published in October 2006, found that the RPA underestimated the risks and complexities involved in implementing the hybrid model, and the IT system was never tested as a whole before the scheme was introduced. It failed to adequately pilot land registration, and underestimated the amount of work involved in both mapping the land and processing each claim, having to rely on often inexperienced temporary and agency staff to clear the backlog. The difficulties were not picked up early enough, neither by the RPA nor Defra, for corrective action to be taken in time, resulting in the RPA's failure to meet its own payment targets. Delayed payments have cost farmers money in additional interest and bank charges, and caused distress to a significant minority of farmers, particularly hill farmers. The cost of implementing the scheme was budgeted at £76 million but rose to £122 million by March 2006, with further cost increases likely. Following on from a previous Committee report on the RPA (HCP 840, session 2005-06, ISBN 9780215027115), published in January 2006 and in light of the NAO findings, this report focuses on aspects of policy decision-making and political accountability raised by the problems with the Single Payment Scheme. The Committee concludes the Scheme has been a catastrophe for some farmers and a serious and embarrassing failure for Defra and the RPA, and Defra's fundamental failure to carry out one of its core tasks (that is to pay farmers their financial entitlements on time) differentiates this issue from the myriad of botched Government IT projects. There is a need for greater expertise within government in the delivery of such complex IT projects, and the report also criticises the quality of advice given by the Office of Government Commerce and the IT system designed by Accenture as the principal IT contractor. Defra determined the policies which it required the RPA to implement and Defra leadership was at fault for accepting RPA statements that implementing the complex hybrid model to deadline was "do-able". The Committee argues that responsibility for this failure goes wider than the dismissal of the RPA chief executive, and ministers and senior Defra officials should also be held to account, particularly Margaret Beckett (the then Defra Secretary of State), Sir Brian Bender, (the former Defra Permanent Secretary) and Andy Lebrecht (the Director General for Sustainable Farming, Food and Fisheries). It concludes that a departmental failure as serious as this should result in the removal from office of those responsible for faulty policy design and implementation, and it recommends that new guidance on Ministerial accountability is needed in the event of such serious departmental failure.

The report tells Ministers they must: spell out how the Government will deliver its pledge to focus public money for flood defence on those communities at greatest risk and least able to protect themselves; ensure adequate and stable funding for local authorities and other agencies given new responsibilities under the Flood and Water Management Act 2010 to plan for and respond to flood events. The report calls on the Government to sharpen the regulatory framework for the water industry to ensure it places customers' views at the heart of a future strategy that will deliver improved affordability and water efficiency. Ministers should: clarify the role for social tariffs in helping those who have difficulty paying their water bills; implement a solution that brings down bills for customers in regions where water charges are at present disproportionately high due to the need for large-scale capital investment in sewage systems; publish a strategy to implement a wider programme of metering and variable tariffs designed to improve water efficiency while protecting those on low incomes from unaffordable price rises.

The Committee's report considers how defunct ships are dismantled and why most are currently dismantled in developing countries, mostly in Asia; health and safety protection for workers, and environmental protection standards; the international regulatory framework, including legislation such as the Basel Convention and EC regulations, IMO guidelines and enforcement problems; the principles of responsible ship recycling; the Government's approach to ship recycling and a UK ship recycling industry. Findings include that the Government has an important role to play in ensuring this issue receives sufficient international priority, particularly during the UK's forthcoming EU Presidency and chairmanship of the G8; as well at home in helping persuade UK-based shipowners to arrange for their vessels to be disposed of responsibly. As a first step, it should ensure that all naval and other publicly-owned vessels are dismantled to the highest health, safety and environmental standards.

Following on from its previous report on waste management issues (HCP 385-I, session 2002-03, ISBN 0215010876) published in May 2003, the Committee's report focuses on the progress being made to meet targets for recycling, and the impact of the EU Landfill Directive on reducing the amount of waste sent to landfills, particularly in hazardous waste landfill capacity. Findings include that waste policy has a lower public profile than many other environmental issues, and its development is hindered by a lack of quality data. Concerns are raised about the level of hazardous waste that is unaccounted for, following the ending of co-disposal of hazardous and non-hazardous waste in the same landfill. Government funding for research into new treatment technologies is welcomed, but more investment is needed; and the planning system is a key influence on the country's waste management capacity. The Committee also recommends that the Landfill Tax should be increased to £35 per tonne; and that the introduction of local authority schemes to promote household waste recycling should be left at the discretion of local councils, with variable charging schemes only introduced if this can avoid disadvantaging low-income families.

Book excerpt: The UK's 347,000 kilometre network of sewers and 9,000 sewage treatment works fulfil the vital function of managing over 11 billion litres of waste water each day. Changing weather patterns and population growth are leading to increased volumes of waste water in some parts of the country. In coming years, there will be a need to construct new infrastructure to manage waste water. In particular, new infrastructure is needed in the River Thames area to cope with population growth and to meet the European Union's environmental requirements. But the draft National Policy Statement (NPS) on Waste Water needs radical improvement if it is to provide a valuable policy framework to guide decision-makers. The Committee criticise the draft National Policy Statement for focussing on two specific London projects, the Thames Tunnel and replacement of a sewage treatment works in North East London. They argue that it should set out a strong set of general principles for decision makers to apply to any waste water project once a specific application is made, rather than have site-specific sections. The Planning Act 2008's new regime for Nationally Significant Infrastructure (NSIPs) does not currently apply to the Thames Tunnel project-a surprising omission given that this multi-billion pound project is one of only two waste water projects likely to be of sufficient scale to come within the ambit of this NPS. The Government must rectify this urgently.

The reform of abstraction licenses must be brought forward as the Government's current plans - to reform the abstraction regime by the mid-to-late 2020s - will not take effect rapidly enough given that our rivers are already running dry. Defra must also work with Ofwat and the Environment Agency to tackle urgently those abstractions which are already causing severe damage to our rivers. It is "extremely disappointing" that the White Paper fails to set a target to increase levels of water metering. The report also highlights how bad debt in the water sector adds around £15 to each household's water bill every year. Defra must implement existing legal provisions rapidly to tackle this problem. The Committee also examines proposals to increase competition in the sector. They conclude that Defra should set a clear target date for opening a competitive retail market for water, and should take account of lessons that can be learned from Scotland. The Committee believes that the White Paper's proposals will fail to deliver a well-functioning retail market and suggests how to remedy this. The Government also needs to take action to encourage the development of Sustainable Drainage Systems (SuDS), which can reduce the risk of flooding, and to implement the relevant outstanding provisions of the Flood and Water Management Act 2010. It is "deeply worrying" that the Government had not yet reached an agreement with insurers about providing cover for homes in areas of flood risk

Greater attention needs to be paid by the Government to the issue of water shortages due to drier summers, including considering alternative water pricing mechanisms to relate costs more directly to amount used, and ensuring building regulations pay greater attention to water efficiency. Water companies must also do more to reduce water leakages.

Defra has had to secure an extra £300 million to meet the potential cost of disallowance of expenditure by the European Commission arising on the problems in administering the scheme. Following on from a NAO report on this topic (HCP 1631, session 2005-06; ISBN 9780102943399 published in October 2006, as well as a report from the Environment, Food and Rural Affairs Select Committee (HCP 107-I, session 2006-07, ISBN 9780215033383) published in March 2007, this report by the Public Accounts Committee examines the impact of the payment delays on the farming sector, why implementation failed, the role of Defra and the changes being put in place to rectify the mistakes made. Lessons highlighted include: the Department made the scheme unnecessarily complex by choosing to adopt the most demanding implementation option; the Rural Payments Agency shed too many experienced staff at a key time; implementation of the project started before the scheme specification was finalised; and the IT system was introduced without adequate testing, a failure often seen with government IT projects.

Book excerpt: This is the 11th report from the Environment, Food and Rural Affairs Committee (HCP 544-I, session 2007-08, ISBN 9780215524201) and focuses on the potential of England's rural economy. A report from the Rural Advocate to the Prime Minister in June 2008 (http://www.ruralcommunities.gov.uk/files/CRC74.pdf), estimated the untapped potential from rural business as between £236 billion and £347 billion per annum. The Department for Environment, Food and Rural Affairs (DEFRA) has not commented on these figures, but the Committee believes that if the figures are accurate, tackling the factors that inhibit growth of businesses in rural areas could make a substantial difference to the performance of England's economy as a whole. The Committee states that DEFRA should produce its own estimate and that the Department's present approach to the rural economy will not deliver the tailored solutions that rural business needs. DEFRA's new Departmental Strategic Objective (DSO) does not convince the Committee that this will identify the factors inhibiting economic growth. The DSO is spilt into two intermediate outcomes: (i) that the needs of rural people are met through mainstream policy; (ii) by supporting economic growth in rural areas with the lowest levels of performance. Both these outcomes are directed towards the objective of developing "Strong Rural Communities". For the Committee, DEFRA should focus on achieving economic growth across rural areas as a whole, and not exclusively concentrate on areas of the lowest performance and that the indicators obtained from the DSOs are incomplete, because they do not include transport, communications, planning and further education.
