The Department recalculates each award annually and has identified that for 2003-04 it overpaid some £2.2 billion to 1.9 million families. It believes that 2004-05 will see a similar level of overpayment. This is partly due to the nature of the scheme where awards are provisionally based on previous income whilst the final award is based on actual income. However the level of overpayment has been higher than was initial estimated and repayments have caused distress to some families. This report looks at measures being taken to reduce overpayments; claimant error and fraud; and the settlement with EDS over problems with the computer system. The Committee attaches great importance to this subject and wish to return to it in the future.

Findings include: there is significant uncertainty about any estimates of spirits fraud based upon current methodologies and data sources; better use needs to be made of existing information from alcohol producers to track suspected illicit products; and poor communication within the Department has undermined anti-fraud operations and prosecutions.

The difference is mainly because these systems exclude some debt that is due but is paid almost immediately and there are timing differences in when debt is downloaded from the main tax systems. This report analyses trends in debt levels using figures from the debt management systems. It examines: The Department's performance in managing debt; how the Department manages and prioritises debts; the Department's methods for collecting debt and how it encourages taxpayers to pay on time. It finds that though the Department has improved its management of tax debt, over the last year debt as a proportion of net receipts and the age of debt has increased on some taxes.

Book excerpt: Following on from a NAO report (HCP 798, session 2005-06, ISBN 0102936978) published in February 2006, the Committee's report concludes that the handling of cases in magistrates' courts has in recent years become complex and protracted to the extent that it no longer amounts to summary justice. 55 per cent of the £173 million cost of delay in the magistrates' courts is attributable to the defence, but the police and the Crown Prosecution Service (CPS) account for another 14 per cent (£24 million) each. The CPS needs to review its organisational structure, revise its system for preparing for magistrates' court cases by adopting current best practice, and address the cultural resistance within the organisation to more modern working practices.

Book excerpt: In January 2004, the Inland Revenue entered into a contract with Capgemini to provide IT services to support the Department's business. The contract, known as ASPIRE (Acquiring Strategic Partners for the Inland Revenue), replaced two previous contracts with EDS and Accenture and, following the merger of the Inland Revenue and HM Customs & Excise in 2005, the latter's IT services contract with Fujitsu was incorporated within ASPIRE in April 2006. This change from one supplier to another was the first of this scale in the public sector, and the contract provides wider lessons for the public sector in re-competing major contracts, particularly relating to the payment of transition costs. The cost of the contract has risen from £2.83 billion to £8.5 billion over the 10 year term. Following on from a NAO report on this topic (HCP 938, session 2005-06; ISBN 9780102939170) published in July 2006, the Committee's report examines the procurement process, the transition to a new supplier and the performance of the ASPIRE contract to date. Findings include: i) before concluding the deal, the Department should have evaluated bids against a range of demands for IT services and analysed the effect of different scenarios on suppliers' prices and profit margins; ii) it should have evaluated the performance of consultants and the lessons to be learned from their use, not only for their own benefit but for that of other departments; iii) by contributing to bid costs and paying transition costs to secure competition for the contract, the Department incurred a premium of £51.9 million; iv) it should set more challenging performance targets to impose sufficient discipline on suppliers; and v) the Government should not be placed in the invidious position of having to commission further work from a contractor in order to recover compensation for underperformance.

The Committee makes a number of conclusions and recommendations including in relation to: the deportation of foreign nationals, the use of alternatives to remand such as electronic tagging, contingency planning to ensure greater flexibility in accommodation plans including pilot testing new accommodation to identify possible problems early on, the application of best practice in anti-suicide monitoring measures, and the impact of moving prisoners around the prison estate on their training needs.

Companies are required to submit tax returns each year along with any tax due, and these tax returns are then checked for non-compliance. In 2004-05, HM Revenue and Customs collected about £33 billion in corporation tax, and it expects receipts to increase to £42 billion in 2005-06. Following on from a National Audit Office report (HC 678, session 2005-06; ISBN 0102936641) published in January 2006, the Committee's report examines the management of Corporation Tax and sets out a number of conclusions and recommendations. Given an estimated 40 per cent error rate in tax returns, the Department should improve its targeting of enquiries into tax returns for non-compliance and its use of risk assessment techniques in order to increase the tax yield. Plans to restructure the local area office network should help reduce local variations in performance and improve efficiency in enquiry work. All companies will be required to file their tax returns electronically by 2010, and this system should realise a number of benefits, including greater convenience for companies and a reduction in Department's costs and errors in keying-in data.

Once registered with Companies House, companies become liable for Corporation Tax when they begin business. In 2004-05, HM Revenue and Customs (the Department) collected £33 billion in tax. Companies submit company tax returns to the Department, which processes and checks them for non-compliance and collects the tax. This NAO report examines the management of Corporation Tax and sets out the following conclusions and recommendations: that HM Revenue and Customs has increased the yield from the tax through a more structured approach to risk assessment and better management of information; a greater yield from the tax may be obtained through matching resources to risk across the tax network; a reorganization of local compliance work into fewer and larger offices, could provide improvements in effectiveness and efficiency, with a matching of staffing levels and experience to local compliance risks and workloads; the Department should pursue its' stronger focus on taxpayers' needs together with any tax simplification, and reduce compliance burdens for companies, which should increase levels of compliance, thus ensuring companies understand and meet their requirements in regard of Corporation Tax.
