The Honorable Thomas Jones, Of Fort Neck, Queens County, Long Island, a graduate of Yale College, Recorder of the City, and one of the Judges of the Supreme Court of the Province of New York, is the author. It was written, as appears from allusions in the text, between the years 1783 and 1788, during that dark period between the close Of the Revolutionary war and the establishment of the existing form of government of the United States in 1789, which is so little known and understood at this day. A period when the wisest and the best Of.the men who carried through the American Revolution almost despaired of the existence of the colonies which they had contributed to make independent states and which existence was only rendered possible by the slow and extremely unwilling adoption Of the Federal Consti tution framed by the Convention of 1787, an adoption, as John Quincy Adams expressed it, extorted by the grinding necessities Of a reluctant nation. The next day, after examining the sworn proofs sent to them, and Livingston himself, that Committee "Resolved, that the said Robert G. Livingston hath manifested a disposition very unfriendly to the American cause, and ought not to be permitted longer to have an opportunity of exerting his influence to the prejudice of his country, therefore, "Resolved, That the said Robert G. Livingston be committed to the Gaol of the County of Ulster at Kingston, there to remain till such time as this Committee, or the Convention, or a future Legislature shall make further order concerning him, and that the keeper of said Gaol, do receive and detain him accordingly." 1 Shortly after Mr. Livingston requested a rehearing, and offered to disprove the charges, which request was granted. Mr. Egbert Benson and the committee of Rhinebeck and Mr. Livingston subsequently appeared on the 18th of January, 1777, before the Committee to detect Conspiracies, when the latter submitted his disproving evidence, but the Committee resolved "that the said Robert G. Livingston, jun., hath materially failed therein, and that his conduct was highly unfriendly to the American cause," but as he was willing to take the oath of allegiance to this State, it was "ordered that the said Robert G. Livingston, jun., be reprimanded, and on his taking the oath of allegiance aforesaid be discharged." He at once appeared, took the oath, and was discharged accordingly.' On the 6th of January, 1777, the Journal of the Provincial Convention states, that " A letter without signature directed to Robert G....

Book excerpt: Excerpt from New York in the Revolution, Vol. 2: As Colony and State In 1895, Comptroller James A. Roberts, in moving some documents to make room for an extension to his office, brought to light many valuable papers relating to the Revolutionary War and the important position occupied by the State of New York in that momentous struggle. Through the kind assistance of various Legislatures, those documents were arranged and com piled and a volume issued therefrom which has been a valuable addition to the historical records of this State. One fact alone demonstrates the worth of the work which has been prosecuted in the Comptroller's Department in connection with these Revolutionary Records: The State of New York had formerly been credited with having furnished in the War for Independence but men, which number had been accepted as historically accurate. The documents which were first discovered by Mr. Roberts and afterward arranged by him and his successors, prove beyond dispute that New York's quota was at least men, giving to our State a much more commanding position as a factor in the Revolutionary contest than it had thereto fore occupied. The work which was issued by Mr. Roberts passed through two editions prior to the final arrangement of all the Revolutionary papers. On assuming the office of Comptroller, I found that the work of preparing these documents for consultation and the index to the same, had been practically completed and that the binding of the few remaining additional volumes of original documents would complete the Revolution ary work in its entirety. All that remained of interest to the general public was the printing and issuing of a Supplement or companion book to New York in the Revolution, which would give a complete resum of the Revolutionary Records of the Department. The Legislature of 1901 provided an item in the Supply Bill for this work which I now have the pleasure of adding to the historical annals of this State. The second edition of New York in the Revo lution was the roll-call of the officers and men who served in the War. This Supplement gives in a condensed form the history of the War as shown by the documents. It is not a reprint in the entirety of those documents, which only could be done at a great, and probably unwar ranted, expenditure; but it is a work calculated to give sufficient information upon the subject matter contained in those documents to answer every practical purpose. It may be that some future generation may see fit to publish all of the historical documents in this office and in other of the State departments, relating to the struggle of this Colony, with the others, for its independence. Taken seriously, the story Of this book may well have a practical side, considered in relation to our newly-acquired Colonial possessions. We at home hear vaguely Of these outlying parts being settled by some Of ourselves; but the conditions into which the Colonists go are but little understood and less noted. Yet, carrying our name and traditions and pluck, we must believe that their day's work will tell as the years go by.
