Excerpt: ...the recovery of a mining title, or for damages to any such title, shall be affected by the fact that the paramount title to the land on which such mines lie is in the United States, but each case shall be adjudged by the law of possession." The only other two instances before the general law of 1866, where Congress recognized possessory rights or rules of miners, or granted a fee in mineral lands, were local in their character and application; one was section 2 of the Act of May 5, 1866, (14 U. S. Stat. at Large, 43), concerning boundaries of the State of Nevada; and the other was the Act of Juy 25, 1866, (14 U. S. Stat. at Large, 242), commonly known as the Sutro Tunnel Act. INTRODUCTION OF LODE LAW OF l866. On May 28, 1866, Senator Conness, chairman of the committee on mines and mining in the United States Senate, reported back to that body Senate bill No. 257, entitled "An Act to regulate the occupation of mineral lands, and to extend the right of pre-emption thereto," and recommended the passage of a substitute. This book was released on 2017-11-16 with total page 1138 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Mines and Minerals Since the publication, in the year 1867, of the Third Edition of the Author's Treatise, mining industry has, upon the whole, and notwithstanding occasional variations, enormously increased e and the law, also, of mines and minerals, from having been more frequently before the Courts and from other causes, has received a corresponding development. The principles of that law are now more definitely settled, and its details are much more accurately ascertained or ascertainable, than they or either of them were at the time the Author wrote. In the present or Fourth Edition, the Editor has endeavoured, while founding upon the old edition, to express these more definite principles, and to arrange these more accurately ascertainable details of mining law in a form at once convenient and logical, embodying them in the Author's Treatise in their appropriate places, and generally carrying forward that Treatise to the stage at which mining law has now arrived. For the better attainment of the objects above ex pressed, the Editor, although averse to taking liberties with either the method or the matter of his Author, has found himself compelled to take, and has also taken in fact, very considerable liberties with both. He has greatly altered the method; and he has greatly altered the matter also. Firstly, as regards alterations of method, - the Editor has made the following alterations, viz. Available in PDF, EPUB and Kindle. Book excerpt: History has left us a classic image of western mining in the grizzly forty-niner squatting by a clear stream sifting through gravel to reveal gold. What this slice of Western Americana does not reveal, however, is thousands of miners doing the same, their gravel washing downstream, causing the water to grow dark with debris while trout choke to death and wash ashore. Instead of the havoc wreaked upon the western landscape, we are told stories of American enterprise, ingenuity, and fortune. The General Mining Act of 1872, which declared all valuable mineral deposits on public lands to be free and open to exploration and purchase, has had a controversial impact on the western environment as, under the protection of federal law, various twentieth-century entrepreneurs have manipulated it in order to dump waste, cut timber, create resorts, and engage in a host of other activities damaging to the environment. In this in-depth analysis, legal historian Gordon Morris Bakken traces the roots of the mining law and details the way its unintended consequences have shaped western legal thought from Nome to Tombstone and how it has informed much of the lore of the settlement of the West.
