Book Political Corruption and Organizational Crime

Download or read book Political Corruption and Organizational Crime written by Elizangela Valarini and published by Springer Nature. This book was released on 2021-10-01 with total page 425 pages. Available in PDF, EPUB and Kindle. Book excerpt: Level of compliance - one of the most important prerequisites of good governance - varies widely across countries of the Global North and the less developed, Global South. Acts of non-compliance, such as electoral irregularities, dubious deals between private and public sectors, questionable role of the justice systems and financial scandals, though they vary greatly across countries, are an omnipresent reality of contemporary life. This volume has brought together a number of case studies of such deviant behavior in political, juridical and corporate fields, from several countries of Asia, Europe and South America, within a common framework. Instead of a moral approach based exclusively on the legality and illegality of the act, the authors of these essays dissect non-compliance analytically, taking culture and context into account. They argue that, while criminal and corrupt dealings deserve to be exposed by all means from an ethical point of view, seen from an interdisciplinary angle, one needs to probe deeper into the dynamic that leads to such non-compliance with the law in the first place.

Download or read book Passions and Constraint written by Stephen Holmes and published by University of Chicago Press. This book was released on 1995-06 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: Holmes argues that the aspirations of liberal democracy - including individual liberty, the equal dignity of citizens, and a tolerance for diversity - are best understood in relation to two central themes of classical liberal theory: the psychological motivations of individuals and the necessary constraints on individual passions provided by robust institutions. Paradoxically, Holmes argues, such institutional restraints serve to enable, rather than limit or dilute, effective democracy.

Book The System of the Constitution

  • Author : Adrian Vermeule
  • Publisher : Oxford University Press
  • Release : 2011-12-30
  • ISBN : 0190208007
  • Pages : 232 pages

Download or read book The System of the Constitution written by Adrian Vermeule and published by Oxford University Press. This book was released on 2011-12-30 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: A constitutional order is a system of systems. It is an aggregate of interacting institutions, which are themselves aggregates of interacting individuals. In The System of the Constitution, Adrian Vermeule analyzes constitutionalism through the lens of systems theory, originally developed in biology, computer science, political science and other disciplines. Systems theory illuminates both the structural constitution and constitutional judging, and reveals that standard views and claims about constitutional theory commit fallacies of aggregation and are thus invalid. By contrast, Vermeule explains and illustrates an approach to constitutionalism that considers the systemic interactions of legal and political institutions and of the individuals who act within them.

Book Development with a Body

Download or read book Development with a Body written by Andrea Cornwall and published by Zed Books Ltd.. This book was released on 2013-07-04 with total page 219 pages. Available in PDF, EPUB and Kindle. Book excerpt: 'We used to talk about development with a human face. We should be talking about development with a body' Arit Oku-Egbas, African Regional Sexuality Resource Centre, Nigeria Sex and sexuality have always had a place at the heart of the development agenda - from concerns regarding population and environment, to practices in education and efforts for protecting reproductive health and rights. Yet this agenda has largely focused on negative dimensions of sexuality - disease, risk, violation - rather than positive aspects, including rights to sexual fulfillment, wellbeing and pleasure. The shift towards a rights-based approach to development has brought the human rights dimensions of sexuality into clearer view, and consequently the need to address discriminatory laws and violations of the human rights of those whose sexual identity and practices diverge from dominant sexual orders/norms. This book offers compelling insights into contemporary challenges and transformative possibilities of the struggle for sexual rights. It combines the conceptual with the political, and offering inspiring examples of practical interventions and campaigns that emphasize the positive dimensions of sexuality. It brings together reflections and experiences of researchers, activists and practitioners from Brazil, India, Nigeria, Peru, Serbia, South Africa, Turkey, the UK and Zambia. From political discourse on sex and masculinity to sex work and trafficking, from HIV and sexuality to struggles for legal reform and citizenship, the authors explore the gains of creating stronger linkages between sexuality, human rights and development.

Available in PDF, EPUB and Kindle.

Book On the Limits of Constitutional Adjudication

Download or read book On the Limits of Constitutional Adjudication written by Juliano Zaiden Benvindo and published by Springer. This book was released on 2013-01-02 with total page 421 pages. Available in PDF, EPUB and Kindle. Book excerpt: Juliano Z. Benvindo investigates the current movement of constitutional courts towards political activism, especially by focusing on the increasing use of the balancing method as a “rational” justification for this process. From the critical perception of the serious risks of this movement to democracy, the book takes as examples two constitutional realities, Germany and Brazil, in order to discuss the rationality, correctness, and legitimacy of constitutional decisions within this context. Through a dialogue between Jacques Derrida’s deconstruction and Jürgen Habermas’s proceduralism, the author confronts Robert Alexy’s defense of the balancing method as well as those two constitutional realities. This confrontation leads to the introduction of the concept of limited rationality applied to constitutional democracy and constitutional adjudication, which affirms the double bind of history and justice as a condition for a practice of decision-making committed to the principle of separation of powers.
