Book excerpt: The Hindraf (Hindu Rights Action Force) Rally in November 2007 drew unprecedented global media attention upon the Indian community in Malaysia and its plight as a marginalised community for the past 50 years since Independence. The fact that the Hindraf leaders were petitioning the Queen of England to have their plight redressed metaphorically and actually demonstrates that the Indians understood the colonial era and the moment of Independence from the Empire as the point of genesis for their suffering. Analysts have accurately noted that the class action suit was a ploy for the group advocating Hindu Indians Rights in Malaysia to embarrass the incumbent UMNO-Ied Malaysian government. As civic space in Malaysia continued to narrow for non-Malay-Muslim minorities over the last fifty years beginning from the social bargain at independence to the NEP (affirmative action) to rising Islamisation, Indians, like other minorities, began to feel increasingly pressured by a lack of opportunities and freedom to practise their culture and religion. The Hindraf Rally in 2007 instigated my research in this area to understand the problems the Indians in Malaysia have endured and how Indian leadership and organisations over a span of 50 years have handled these problems. I undertook fieldwork in Malaysia from August 2009 to July 2010, interviewing journalists, prominent members of the Indian community, doing archival research and just talking and interacting with Malaysian Indians to understand the situation. The fact that Indians led by Hindraf lawyers were leading a protest in 2007, 50 years after Independence, suggests that Indian leaders and their organsiations had been inept in the management and problem solving approaches against the backdrop of a state that was adamant to preserve the rights of only one ethnic group above all others. This thesis charts the history of the Malaysian Indian community through its organisations and leadership to understand the text and context of the Malaysian Indian predicament as a marginalised minority to track a slow, haphazard road to the Hindraf Rally. It aims to understand how and why the Hindraf Rally of November 2007 occured and what it was a culmination of.

Neelakanda Ayer forecast that the fate of Indians in Malaya would be to become “Tragic orphans – of whom India has forgotten and Malaya looks down upon with contempt”. Ayer’s words continue to resonate; as a minority group in a nation dominated politically by colonially derived narratives of “race” and ethnicity and riven by the imperatives of religion, the general trajectory of the economically and politically impotent Indian community has been one of increasing irrelevance. This book explores the history of the modern Indian presence in Malaysia, and traces the vital role played by the Indian community in the construction of contemporary Malaysia. In this comprehensive new study, Carl Vadivella Belle offers fresh insights on the Indian experience spanning the period from the colonial recruitment of Indian labour to the post-Merdeka political, economic and social marginalization of Indians. While recent Indian challenges to the political status quo — a regime described as that of “benign neglect” — promoted Indian hopes of reform, change and uplift, the author concludes that the dictates of political discourse permeated by the ideologies of communalism offer limited prospects for meaningful change.

It examines the Indian community in Malaysia, a quiet minority which consists of the former Indian Tamil plantation labour community and the urban Indian middle-class. The first part of the book explores the role played by British colonial laws and policies during the British colonial period in Malaya, from the 1890s to 1956, in the construction of an Indian "race" in Malaya, the racialization of labour laws and policies and labour-based mobilisation culminated in the 1940s. The second part investigates the mobilisation trends of the Indian community from 1957 (at the onset of Independent Malaya) to 2018. It shows a gradual shift in the Indian community from a "quiet minority" into a mass mobilising collective or social movement, known as the Hindu Rights Action Force (HINDRAF), in 2007. The author shows that activist lawyers and Indian mobilisers played a crucial part in organizing a civil disobedience strategy of framing grievances as political rights and using the law as a site of contention in order to claim legal rights through strategic litigation. Highly interdisciplinary in nature, this book will be of interest to scholars and researchers examining the role of the law and rights in areas such as sociolegal studies, law and society scholarship, law and the postcolonial, social movement studies, migration and labour studies, Asian law and Southeast Asian Studies.

Against conventional wisdom, the newly reconfigured opposition grouping Pakatan Harapan (PH) decisively defeated the incumbent Barisan Nasional (BN), ending six decades of uninterrupted dominant one-party rule. Despite a long-running financial scandal dogging the ruling coalition, pollsters and commentators predicted a solid BN victory or, at least, a narrow parliamentary majority. Yet, on the day, deeply rooted political dynamics and influential actors came together, sweeping aside many prevailing assumptions and reconfiguring the country’s political reality in the process.
