Book excerpt: This dissertation summarizes the research of 30 court referred, custody dispute cases assessing the behaviors of the parents and their children to determine the presence or absence of Parental Alienation Syndrome (PAS). The criteria to determine the parent and their children's behaviors is Dr. Gardner's definition of Parental Alienation Syndrome. The parents were placed in three categories (mild, moderate or severe) based on their symptoms and behaviors. Their children (59) were then categorized into three groups (mild, moderate, severe). This investigation seeks to determine additional information regarding the presence or absence of PAS. Reluctance by the courts and mental health community to accept the validity of PAS probably contributes to the perpetuation of the disruption of parent-child relations in custody disputes. Findings and Conclusions: It appears the data from this study corroborates observations and definitions of Parental Alienation Syndrome. The data from this study indicates that the parents in the mild PAS category have children who exhibit fewer negative behaviors toward the alienated parents whereas children whose parents are in the severe category exhibit more negative behaviors towards the alienated parents. This study found that the more negative behaviors a child exhibits towards an alienated parent, the more severe their parent's symptoms and behaviors. Consequently, there is more severe alienation from the alienated parent and the more disruption to that parent-child relation. In this book, the authors define parental alienation as a mental condition in which a child - usually one whose parents are engaged in a high- conflict divorce - allies himself or herself strongly with one parent (the preferred parent) and rejects a relationship with the other parent (the alienated parent) without legitimate justification. Book excerpt: We are seeing an increase in high conflict, adversarial divorce cases in mental health practices and in the courtrooms around the country. These cases present with a significant amount of parental conflict and, as a consequence, represent a threat to the children caught in the middle of these conflicts. Curiously, there is a great commonality among these cases in terms of the tactics alienators use to separate a parent from his or her children. It is almost as if they, the favored parent, were reading from a published playbook. Many evaluators and clinicians include Parental Alienation (PA) as well as Parental Alienation Syndrome (PAS) in the same category when discussing this topic. PAS is acknowledged as being extremely controversial. It is controversial within the mental health profession and equally controversial within the legal profession. The purpose of this work is to share ideas, thoughts, background, theory and some experiences in working with high conflict families. It is important for professionals to get a sense of both sides of the PAS issue. Whether one uses PAS as a term, the problems brought by these cases are very real. The reluctance to consider PAS by name in the psychological and legal communities tends to contribute to the perpetuation of the problem in a variety of ways. Like any other designation, PAS can be and is misapplied and misused. Whether or not it is the appropriate diagnosis or description of behavior in a case must be determined by facts of that case and supported by evidence and data from multiple sources. An appropriate diagnosis and identification of PAS, along with a description of the severity, can make the difference between timely and effective interventions or allowing parents and children to be scarred for the rest of their lives. This work was compiled from a number of recordings of continuing legal education workshops and seminars that the authors had conducted over the last few years. In addition, the content was embellished with content from a number of papers that the authors published along the way. Some of these can be seen on the authors' websites, www.drbobevans.com and www.jmichaelbone.com . Also, the works of Richard Gardner (1998), the original author of the disorder referred to as Parental Alienation Syndrome, were reviewed and selected ideas and content are inserted into this work. Both authors are contributors to the proposed diagnosis for inclusion into the next edition of the Diagnostic and Statistical Manual published by the American Psychiatric Association and some of that work is include herein. The authors are very grateful for having the experience and honor of working with Dr. Gardner when he was alive. He was a man of unusual talent, a prolific writer and a pioneer in the field of forensic psychiatry. Unfortunately, much of his work is misquoted, exaggerated and at times misunderstood. This book is simply a snapshot or overview of Parental Alienation and Parental Alienation Syndrome and should be used as an outline in working with this disorder. Readers are encouraged to read Dr. Gardner's works and others thoroughly in order to have a working knowledge so they can work with the children and families who have become victims of this terrible malady.

Book excerpt: Parental alienation is a complex family issue that has gained recent popularity in Canadian Courts. Unfortunately, parental alienation targets primarily the children in a household and often leaves them psychologically and developmentally harmed. Instances of parental alienation arise during high-conflict parental separation, mainly because of child custody frustrations. Parental alienation was first coined by Gardner in 1987, and is defined as one parent’s direct intention to damage their child’s relationship with the other parent through emotional manipulation and deception tactics. It is often characterized by a child’s extreme withdrawal of one parent and unyielding loyalty to the other parent. Not only is parental alienation emotionally and financially draining to all parties, it also poses unique challenges to court participants in its legal applications. To ensure cases of parental alienation are managed appropriately, courts require considerable time and judicial resources. The decisions regarding alienating cases in Canada are decided based on judicial discretion and relative experience. It is argued here, and in some social science research, that judges should be mandated to consider expert evidence and/or opinions before making potentially life-altering decisions. Unfortunately, it is evident through Canada’s historic precedents that judges lack uniformity in their decision-making with respect to this specific area of family disputes. It is provided throughout this research paper that a tool needs to be developed in the Canadian family law system, to quantify the presence of alienation in custody disputes. This would allow judges to make decisions that are more objective and consistent in nature. An example of this type of tool can be borrowed from the United States,called the Parental Rejection-Acceptance Questionnaire. This tool was originally designed for social services, however, its implementation in legal systems could potentially change the way alienation cases are heard in Canadian Courts. A tool such as this would provide the courts with an inexpensive alternative to the labour intensive process that is currently in place.Preventative measures have since been established in Canada to reduce the risk of parental alienation for children. These measures include parenting programs that are designed to teach families appropriate parenting strategies and effective coping mechanisms. They also advocate for children’s safety and emotional development by informing parents of the psychological dangers associated with alienating behaviours. Greater self-awareness and educational motivation is necessary to manage the growing regularity of parental alienation cases in Canadian legal environments and social systems.
