Book excerpt: Excerpt from Annual Report of the Board of Harbor and Land Commissioners: For the Years 1899 On Nov. 3, 1898, a hearing was given in New Bedford, on the petition of a joint special committee of the city council of New Bedford, for the revision and re-establishment of harbor lines in New Bedford harbor. All other hearings were given by the Board at its office in Boston. April 14, 1898, the Board refused to grant a permit to the Eastern Dredging Company to dredge in Shirley Gut, for fear of disturbing the metropolitan sewer and the water pipe connection with Deer Island. May 31, 1898, the Board refused to grant a permit to the Bay State Dredging Company to dump dredged material in Mystic River near the shore line, as it could not be done at the place desired consistently with the public interest. June 15, 1898, Frank Rutzen, petitioner for license to build a boat landing in Dorchester Bay, at his own request was given leave to withdraw. June 21, 1898, the Board refused to grant a permit to Chas.E. Davis to dump dredged material in New Bedford harbor, owing to objections on the part of shore residents near the desired locality. Aug. 3, 1898, John Burns, petitioner for license to drive piles and construct blocks for repairing scows in Boston harbor at East Boston, at his own request was given leave to withdraw. Aug. 9, 1898, E. E. Tilden, petitioner for authority to remove stones from the beach at Point Allerton in Hull, was given leave to withdraw, on the ground that such removal would tend to weaken the beach. Oct. 5, 1898, Joseph Hellen, petitioner for license to drive piles in Mystic River in Medford, was given leave to withdraw, as the work proposed would be outside the United States harbor line. The Board has inspected from time to time the work done under appropriations made by the Commonwealth, on the South Boston flats, the Province Lands in Provincetown, and at Osterville, Meuamsha Inlet, Scorton harbor and Green Harbor; also the sites of proposed work in tide water, great ponds and the Connecticut River, covered by petitions and plans filed with the Board. The present organization of the Board is as follows: George E. Smith of Swampscott, chairman, Samuel M, Mansfield of Boston, Charles C. Paine of Barnstable. From Dec.1, 1910, to Nov. 30, 1911, the Board has given 210 formal and informal hearings, and has received 194 petitions for the improvement and protection of rivers, harbors and foreshores, for licenses to build and maintain structures, for privileges in tide waters, great ponds and Connecticut River, to dredge material, to remove material from beaches, and for other purposes. Ninety-three licenses for structures and privileges in tide waters and great ponds have been granted during the year; also 62 permits for dredging, for the removal of material from beaches, and for other purposes. Inspections have been made at various times, by and under the direction of the Board, of work completed and in progress on the Commonwealths Flats at South Boston; of sites of authorized work under appropriations made by the Legislature; also upon petitions and plans presented of the sites of proposed work in tide waters; rivers and harbors, on petitions for improvement under chapter 481. Book excerpt: Excerpt from Annual Report of the Board of Harbor and Land Commissioners: For the Year 1897 In addition to its other duties, the Board conducts a bureau of information, relative to matters over which it has charge, and the inquiries relating thereto are repeated and constant. In order not to disappoint the public and to insure a regular and systematic performance of all its duties, the Board has substantially daily sessions for five days out of the week, and during all the business hours of each day it endeavors to have at least one of its members present. In the past year one hundred and sixty-five formal hear ings have been given, at which one hundred and eight petitions for licenses to build and maintain structures, and for privileges in tide waters and great ponds, were heard and determined; and of these, one hundred and four were granted, one withdrawn and three denied. Of the hearings not given at the commissioners' rooms in the State House, two were given at Cotuit and Oster Ville on Sept. 9 and 10, 1897, under chapter 483 of the Acts of 1897, for the purpose of personal acquaintance with the locality and people, and of listening to the testimony of all parties interested in the construction of a channel from Osterville Bay to Vineyard Sound. Chapter 85 of the Resolves of 1894, entitled "Resolve directing the Board of Harbor and Land Commissioners to inquire into the proposed construction of a dam and lock in Charles River basin, reads as follows: - Resolved That the board of harbor and land commissioners are hereby directed to inquire into the construction of a dam and lock in the tidal basin of Charles river, as proposed in the report of the metropolitan park commission and the state board of health, sitting as a joint board, with special reference to interference with tide water and its effect upon the harbor of Boston, giving an opportunity to be heard to persons desiring a hearing thereon, and to report thereon in print to the next general court within ten days from the commencement of the session thereof; and a sum not exceeding fifteen hundred dollars is allowed for necessary expenses of such inquiry and hearing, to be paid out of the treasury of the Commonwealth. After public notice in the newspapers and special notice to the following cities and towns on the Charles River, to wit, Boston, Cambridge, Newton and Watertown, an investigation in compliance with the resolve was begun at the State House on October 3, and continued, by adjournments from time to time, up to Dec. 7, 1894.Seventeen hearings in all were had, and both sides of the question were ably represented by counsel. John E. Abbott, Esq., of Watertown, G. A. A. Pevey, Esq., city solicitor of Cambridge, and W. S. Slocum, Esq., city solicitor of Newton, appeared in support of the report of the joint Board; and Hon. John D. Long, Hon. William E. Russell and John T. Wheel-right, Esq., appeared in remonstrance. The Citizens Association of Boston appeared by Herbert L. Harding, Esq.
