In To Retire or Not? the nation's foremost authorities on retirement policy and practice provide a critical assessment of academic labor markets and retirement patterns, explaining how to adjust pension and other incentive programs to ensure proper replenishment of intellectual and human capital. Case studies vividly illustrate how to predict the need for special retirement programs, how to structure voluntary early-out benefit plans, and how age-based retirement incentives work in practice. Recent legal decisions are assessed and critiqued. A recent amendment to the U.S. Age Discrimination in Employment Act ended mandatory retirement for tenured faculty at colleges and universities across the country. This law let individual faculty members enjoy an economic benefit enjoyed by almost all other American workers: they could choose to continue working past age 70 or "sell" the benefit back to their universities in exchange for earlier retirement. At the same time, however, educational administrators were faced with a faculty bulge created by the expansion of the professorate in the 1960s and early '70s, and the so-called "surplus army" of Ph.D.s of the 1980s. Colleges and universities everywhere are now faced with the higher costs of retaining senior professors instead of hiring entry-level replacements at lower salaries.

Book excerpt: A structural retirement model is estimated using data for tenured, male faculty employed in the 1970's at 26 high quality private colleges and universities. Simulations of raising and then abolishing the mandatory retirement age suggest very large increases in full time work by faculty members in their late 60's and early 70's. Simulations also suggest that early retirement incentive programs would offset only a small fraction of the increase in work due to changes in mandatory retirement, and that rents created by these programs exceed savings from induced early retirements, with salaries of replacements further adding to costs.

Book excerpt: This publication presents a close examination of conceptual, legal and related issues surrounding the dismissal of tenured higher education faculty, under the fourth exception to the Age Discrimination in Employment Act (ADEA). This exception, which will expire on December 31, 1993, permits existing, compulsory retirement-age policies to be applied to employees by their college or university employer at age 70 if the employees are "serving under a contract of unlimited tenure." The study is organized into four parts. The first, an introduction, describes the history of the development of the ADEA legislation and its amendments and exception as well as an overview of the study itself. Section II, "The Concept of Tenure," focuses on tenure's function and justification without considering the law. Part III, "The Legal Aspects of Tenure," addresses the question of whether the concept of tenure constitutes an unacceptable obstacle for institutions of higher education such that their efforts to achieve educational goals is unacceptably impaired. Part IV, "Conclusion," discusses age-neutral procedures, involuntary versus voluntary termination, the need to retain older faculty, and the role of academic tenure in the 1990s. The book is based on more than 50 accounts of academics who took early retirement options and a comprehensive review of incentive programs for early retirement, along with mid-career change programs. Chapter 1 explains why colleges and universities are interested in mid-career change and early retirement programs, and outlines the various options now available. Career options in industry, government, and academia are analyzed in chapter 2. Chapter 3 offers an analysis of the experiences of 70 of the first 100 or so persons who were induced to retire early, covering such topics as motivation, satisfaction with the decision, and ways that early retirement affected their well-being. Chapter 4 discusses the fiscal considerations involved in early retirement plans. Chapter 5 examines the manpower questions, including such questions as how incentive early-retirement plans will affect the age distribution of university and college faculties and whether early-retirement and mid-career change will modify age and talent distribution. Chapter 6 contains a discussion of the funding requirements and tax implications of increased-benefit retirement programs and an analysis of the legal aspects of age discrimination. The final chapter sketches the policy implications of mid-career change and early retirement, presents summary evaluation of the early-retirement schemes, and outlines a number of considerations for colleges, universities, and faculty members contemplating these options. In the final chapter several policy considerations are discussed, including: developing a mechanism for faculty review and evaluation; providing retirement and financial counseling; dissemination information about the options; and recognizing potential contributions from Emerkiti.
