[...] Recommendation 7 The Committee recommends that section 9 of CEPA be amended to strengthen the criteria for the establishment of administrative agreements and enhance monitoring and reporting of the performance of entities that enter into such agreements with the Minister. [...] Moffet of Environment and Climate Change Canada testified that the department has been implementing the "equivalent in effect" test for the past 15 years; however, the related wording in CEPA is ambiguous and could be clarified through an amendment.63 Industrial stakeholders, such as the Canadian Fuels Association, were generally supportive both of the use of equivalency agreements and of the gove.
