Book excerpt: This publication contains an article by Dr Richard Kirkham, Lecturer in the School of Law at Sheffield University, on the history of the post of Parliamentary Ombudsman to mark the 40th anniversary of its establishment, together with a foreword written by the current postholder, Ann Abraham. The paper discusses the origins of the Office and its creation through the Parliamentary Commissioner Act 1967, as well as its existing and future role, the changing landscape of the administrative justice system and possible amendments to Office's powers. The paper concludes that "a few required amendments aside, the Parliamentary Commissioner Act remains a good piece of legislation and the constitution is much stronger for the Parliamentary Ombudsman. As well as improving the power of the citizen to gain redress, as was originally intended, Parliament itself has gained a valuable tool in the ongoing process of calling the government to account."

Book Community Care Practice and the Law

Download or read book Community Care Practice and the Law written by Michael Mandelstam and published by Jessica Kingsley Publishers. This book was released on 2005 with total page 562 pages. Available in PDF, EPUB and Kindle. Book excerpt: This third edition of Community Care Practice and the Law has been substantially rewritten and restructured to reflect the rapid legal and policy changes affecting the community care field. It provides comprehensive and jargon-free explanations of both community care legislation and other areas of the law directly relevant to practitioners. Topics covered include: • assessment and eligibility criteria (`fair access to care') and waiting times • placing people in care homes • non-residential, domiciliary and home care services • carers' assessments and services • home adaptations and disabled facilities grants * direct payments * continuing health care and health services generally, including community equipment services * joint working between local authorities and the NHS * single assessment process, intermediate care * decision making capacity and incapacity * information sharing * adult protection * human rights and disability discrimination * health and safety at work legislation including manual handling people subject to immigration control, including asylum seekers care standards. Numerous examples of legal cases and ombudsman investigations clearly illustrate the practical impact of legislation on community care. A separate chapter provides an at-a-glance view of the whole range of legislation underpinning the everyday work of practitioners. The author also identifies the underlying mechanisms, tensions and problems affecting community care law and practice. Primarily covering England in detail, much of the legal case law covered and the legal principles involved are of general relevance across the United Kingdom, and where material is not directly applicable to Wales, Scotland and Northern Ireland, short summaries offer general pointers for the position in these three countries. This book is an essential guide for practitioners and managers in both the statutory and voluntary sectors, policy makers in local and central government, advocates, lawyers and social work students.

Book A Government that Worked Better and Cost Less

Download or read book A Government that Worked Better and Cost Less written by Christopher Hood and published by OUP Oxford. This book was released on 2015-04-03 with total page 257 pages. Available in PDF, EPUB and Kindle. Book excerpt: The UK is said to have been one of the most prolific reformers of its public administration. Successive reforms have been accompanied by claims that the changes would make the world a better place by transforming the way government worked. Despite much discussion and debate over government makeovers and reforms, however, there has been remarkably little systematic evaluation of what happened to cost and performance in UK government during the last thirty years. A Government that Worked Better and Cost Less? aims to address that gap, offering a unique evaluation of UK government modernization programmes from 1980 to the present day. The book provides a distinctive framework for evaluating long-term performance in government, bringing together the 'working better' and 'costing less' dimensions, and presents detailed primary evidence within that framework. This book explores the implications of their findings for widely held ideas about public management, the questions they present, and their policy implications for a period in which pressures to make government 'work better and cost less' are unlikely to go away.

Book excerpt: Healthcare organizations in the UK and the USA face a growing tide of regulation, accreditation, inspection and external review, all aimed at improving their performance. In the US, over three decades of regulation by state and federal government, and by non-governmental agencies, has created a complex, costly and overlapping network of oversight arrangements for healthcare organizations. In the UK, regulation of the government-run National Health Service is central to current health policy, with the creation of a host of new national agencies and inspectorates tasked with overseeing the performance of NHS hospitals and other organizations. But does regulation work? This book: . explores the development and use of healthcare regulation in both countries, comparing and contrasting their experience and drawing on regulatory research in other industries and settings . offers a structured approach to analysing what regulators do and how they work . develops principles for effective regulation, aimed at maximising the benefits of regulatory interventions and minimising their costs Regulating Healthcare is aimed at all with an interest or involvement in health policy and management, be they policy makers, healthcare managers or health professionals. It is particularly suitable for use on postgraduate health and health-related programmes.
