Freedom of speech is indispensable to a democratic society, enabling it to operate with a healthy level of debate and discussion. Historically, legal scholars have underappreciated the power of stigmatization, instead focusing on anti-discrimination law, and the implicit assumption that the state is permitted to communicate freely with little fear of legal consequences. Whilst integral to a democratic society, the freedom of a state to express itself can however also be corrosive, allowing influential figures and organizations the possibility to stigmatize vulnerable groups within society. The book takes this idea and, uniquely weaving legal analysis with extant psychological and sociological research, shows that current legal approaches to stigmatization are limited. Starting with a deep insight into what constitutes state expressions and how they can become stigmatizing, the book then goes on to look into the capacity the law currently has to limit these expressions and asks even if it could, should it? Examining how this power grab comes at the tail end of more than a decade of seemingly democratic politics, the contributors also explore the mechanisms of de-democratization through two distinctive, but interrelated angles: A set of comparative analyses explores illiberal forms of governance in Turkey, Russia, Southeast Europe and Latin America. The violations have reached to unprecedented levels in parallel with the emergence of the current political-Islamist authoritarianism. The oppressive regime under President Recep Tayyip Erdoğan’s rule instrumentalized the country’s legal system to muzzle the political dissidence, turning the prisons into concentration camps. The number of inmates behind the bars has reached historic highs. Hosting convicts much more than their capacities, the prisons, which were already substantially subpar, have fallen way below the minimum acceptable standards for human dignity. Patients in particular bore the most of the brunt of this precipitated deterioration of the prison conditions and the wrath of the Turkish regime against its opponents.

To exemplify this, the authors examine the Friday sermons delivered weekly in every mosque in Turkey by the Turkish State’s Directorate of Religious Affairs (Diyanet). By analyzing all sermons delivered between 2010-2021, the book shows how the Diyanet has enthusiastically adopted AKP’s increasingly Islamist, authoritarian, civilisationist, militarist and pro-violence populism since 2010, and how it has tried to socially engineer beliefs in line with this ideology.
