This book offers a detailed discussion of the important issues in environmental law, policy, and economics, tracing their development over the past few decades through an examination of environmental law cases and commentaries by leading scholars. The authors focus on pollution, addressing both pollution control and prevention, but also emphasize the evaluation, design, and use of the law to stimulate technical change and industrial transformation, arguing that there is a need to address broader issues of sustainable development. Environmental Law, Policy, and Economics,which grew out of courses taught by the authors at MIT, treats the traditional topics covered in most classes in environmental law and policy, including common law and administrative law concepts and the primary federal legislation. But it goes beyond these to address topics not often found in a single volume: the information-based obligations of industry, enforcement of environmental law, market-based and voluntary alternatives to traditional regulation, risk assessment, environmental economics, and technological innovation and diffusion. Countering arguments found in other texts that government should play a reduced role in environmental protection, this book argues that clear, stringent legal requirements--coupled with flexible means for meeting them--and meaningful stakeholder participation are necessary for bringing about environmental improvements and technologicial transformations.

This book shows that while a number of legal frameworks to help promote the goal of sustainable development have been proposed at the international level they fail to fully capture the essence of sustainable development and international law's capacity to support its implementation. The book offers a critical analysis of past attempts to develop legal frameworks for promoting sustainable development at the international level, and advocates for a fresh approach based on lessons learnt from the law of international watercourses. The book is divided into four sections. The first section includes an overview of the topic area and an understanding of international law. In section two the book explores the meaning of sustainable development and considers the term's relationship with international law. A detailed analysis of how the law of international watercourses seeks to reconcile competing economic, social and environmental interests is carried out in section three. Book excerpt: New Instruments in Spatial Planning addresses the topic of transferring development opportunities between areas in planning practice by a debate between academics, lawyers and planning practitioners at an international planning symposium in Annapolis, MD, USA and the Van Doorne-Habiforum conference on Transferable Development Rights a year later. The idea of transferring development opportunities between areas is more than only the transfer of development rights. It relates more to compensation: not in money, but in a non-financial perspective. A comparative study on non-financial compensation was started, funded by Habiforum and linked to a number of research projects, such as Van Der Veens and Spaans research funded by the Delft Centre for Sustainable Urban Areas and Janssen-Jansens research funded by the Dutch Scientific Organization NWO-STIP. The chapters in this publication are representative of a close cooperation between planners, economists and lawyers from both science and planning practice. The exchange of knowledge within the framework of this book has arisen from divergent paths.
