Download or read book Handbook on the Construction and Interpretation of the Laws Classic Reprint written by Henry Campbell Black and published by Forgotten Books. This book was released on 2017-01-10 with total page 728 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Handbook on the Construction and Interpretation of the Laws The following pages contain a condensed statement and ex position of the accepted rules for the construction and inter pretation of the written laws, whether constitutional or stat utory. In accordance with the general plan of the Hornbook Series, these rules have been formulated somewhat after the manner of a code, expressed in brief black - letter paragraphs numbered consecutively throughout the book, and explained, developed, and illustrated in the subsidiary text. The cases cited in the original edition of this work were considered sufficient in number and variety to explain and enforce the doctrines set forth, attention being'given to the more important and leading authorities and to those which had furnished the most forcible or striking illustrations of the application of the rules of construction in actual practice. But in view of the great and growing body of decisions upon this highly important subject, it has been deemed advisable, in the present edition, very largely to increase the number of citations. Practically [all of the reported cases dealing with the general subject or any of its subdivisions, decided within the fifteen years which have elapsed since the first publica tion of the book, have been collected by the author and cited in their proper connections. These additions have also te sulted in a complete and thorough revision of the entire work. Many parts of it have been greatly expanded and some'wholly rewritten. Some changeshave also been made in the arrange ment of the several parts or sections of the book, for the sake of what now appears to the writer a more logical and orderly system of classification. Download or read book Reading Law written by Antonin Scalia and published by West Publishing Company. This book was released on 2012 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this groundbreaking book, Scalia and Garner systematically explain all the most important principles of constitutional, statutory, and contractual interpretation in an engaging and informative style with hundreds of illustrations from actual cases. Is a burrito a sandwich? Is a corporation entitled to personal privacy? If you trade a gun for drugs, are you using a gun in a drug transaction? The authors grapple with these and dozens of equally curious questions while explaining the most principled, lucid, and reliable techniques for deriving meaning from authoritative texts. Meanwhile, the book takes up some of the most controversial issues in modern jurisprudence. What, exactly, is textualism? Why is strict construction a bad thing? What is the true doctrine of originalism? And which is more important: the spirit of the law, or the letter? The authors write with a well-argued point of view that is definitive yet nuanced, straightforward yet sophisticated.

Book excerpt: ""Interpreting Law" is an accessible introduction to statutory and constitutional interpretation by the nation's leading legislation scholar. This concise treatise not only identifies the primary "canons" or precepts that guide interpretation, but demonstrates how they operate and interact, as a matter of both practice and evolving aspiration. Unlike earlier academic treatises, which rummage through a potpourri of often arcane Supreme Court decisions, Professor Eskridge's new book focuses on a statute prohibiting "vehicles" in Lafayette Park, across the street from the White House. Each chapter engages the law student and the experienced practitioner to consider the application of the statute and its statutory and institutional context to a wide and often delightful array of situations. As the preface by Justice John Paul Stevens suggests, the reader will emerge from this book with a deeply enriched understanding of-and excitement about-legal interpretation."

Excerpt: ...that where an instrument contains a clause or provision in contravention of a statute, it renders the whole instrument invalid. I may here remark that the rule is in its nature arbitrary, and calculated to work injustice, and that it appears to be subject to exceptions. So, where there are different and independent covenants in the same instrument, part may be good and part bad. So, a personal covenant to pay a rent charge may be good, and the security of the rent charge on the living may be bad.f Cumulative Remedies and Penalties.--Where a precise remedy for the violation of a right is provided by statute, it often becomes a matter of interest to know whether the statutory remedy is the only one that can be had, or whether it is to be regarded as merely cumulative, the party aggrieved having also a right to resort to his redress for the injury sustained, at common law, or independently of the statute.(a) In regard to Wetherell v. Terre Haute, &c. R. R. 9 Ind. 283 (Eminent domain). A statute prescribing a method of investigating elections takes away the common-law remedy in cases covered by it., Commonwealth v. Garrigues, 28 Penn. St. 9. When a pecuniary obligation is created by statute, and a remedy is given by this we have already noticed the rule that where a statute does not vest a right in a person, but only prohibits the doing of some act under a penalty, in such a...
