The fundamental premise of this book is that regulatory systems can be successfully reformed only if there are independent, objective and public evaluations of their performance. There is typically very little infrastructure investment during periods of fragility and conflict, and existing installations are often damaged or destroyed. The purpose of this manual is to contribute to improvements in the quality of infrastructure regulation. It does so by identifying key principles for the governance of infrastructure regulators and by suggesting how these principles can be introduced successfully and maintained over time. The introduction of cross-cutting governance principles for regulators is based on the assumption that a uniform set of governance principles can be less costly and complex for governments to implement and enforce and will provide potential investors with a more consistent and predictable regulatory environment to navigate. The manual also discusses the process of implementing regulatory governance reforms in fragile contexts. Improvements in governance frameworks for infrastructure regulators will support better and accountable regulatory decision-making, as well as increased investment and overall economic development. Case studies from relevant country experience complement and provide context to the discussion on principles.

Book excerpt: The 1990s and 2000s have witnessed a spurt of energetic institution-building in the developing world, as regulatory agencies emerge to take over the role of the executive in key sectors. This rise of the regulatory state of the south is barely noticed both by scholars of regulation and of development, let alone adequately documented and theorized. Yet the consequences for the role of the state and modalities of governance in the south are substantial, as politically charged decisions are handed over to formally technocratic agencies, creating new arenas and forms of contestation over the gains and losses from development decisions. Moreover, this shift in the developing world comes at a time when the regulatory state in the north is under considerable stress from the global financial crisis. Understanding the regulatory state of the south, and particularly forms of accommodation to political pressures, could stimulate a broader conversation around the role of the regulatory state in both north and south. This volume seeks to provoke such a discussion by empirically exploring the emergence of regulatory agencies of a range of developing countries across Asia, Africa, and Latin America. The cases focus on telecommunications, electricity, and water: sectors that have often been at the frontlines of this transition. The central question for the volume is: Are there distinctive features of the regulatory state of the South, shaped by the political-economic context of the global south in the last two decades? To assist in exploring this question, the volume includes brief commentaries on the case studies from a range of disciplines: development economics, law and regulation, development sociology, and comparative politics. Collectively, the volume seeks to shape the contours of a productive inter-disciplinary conversation on the emergence of a significant empirical phenomenon - the rise of regulatory agencies in the developing world - with implications both for the study of regulation and the study of development.

Book excerpt: Abstract: This paper focuses on an evaluation and benchmarking of the governance of regulatory agencies in the electricity sector in Latin American Countries (LAC). Using a unique database, we develop an index of regulatory governance and rank all the agencies in the LAC countries. The index is an aggregate number of the evaluation of four key governance characteristics: autonomy, transparency, accountability, and regulatory tools, including not only formal aspects of regulation but also indicators related to actual implementation. Based on 18 different indexes, we analyze the positions of agencies with regard to different aspects of their regulatory governance, considering not only performance in each variable but also scores in the different components of each category. This evaluation allows for the identification of particular country shortcomings regarding governance, and indicates needed improvements. Although the region shows an overall good governance design of their regulatory agencies, the implementation of the independent regulator model still faces several challenges. This is particularly evident in political autonomy and in the informal aspects of governance, where the region shows the largest number of countries with the lowest scores. Trinidad and Tobago and Brazil show the best results and Ecuador, Honduras, and Chile the poorest performances. The rest of the countries vary according to the different indexes. We give each governance variable equal weights and positively test the robustness of our approach using Principal Component Analysis.

Book excerpt: This publication focuses on the impact of tariff orders (distribution) issued by nine SERCs (state electricity regulatory commissions) in India during 2003/04, 2004/05, and 2005/06. The states covered are Andhra Pradesh, Assam, Delhi, Jharkhand, Kerala,Madhya Pradesh, Maharashtra, Uttarakhand, and West Bengal. The analysis has been undertaken based on data and information available up to January 2007. The book assesses whether the orders have resulted in reducing regulatory uncertainty and information asymmetry, and led to better performance of the distribution utilities. Different indicators have been used to assess the impact on consumption and access, efficiency, financial performance, competition, and consumer-related issues in the power sector of these states. In addition, various parameters have been studied to assess whether the regulatory systems follow the principles of good regulation in these nine states. br>The commercial loss (without subsidy) incurred by state power utilities increased from Rs 197 220 million in 2003/04 to Rs 221 290 million in 2004/05. In view of the huge losses being incurred by the utilities, the tariff determination function forms a central part of the reform process. A comprehensive survey of tariff orders issued by these SERCs for the distribution licensees has been undertaken to evaluate the effectiveness of regulatory orders in the electricity sector. It assesses whether the orders have resulted in reducing regulatory uncertainty and information asymmetry and better performance of the distribution utilities. However, tariff orders are only one index of effectiveness of the regulatory commissions. It is recognized that there are many other important functions of the SERCs besides tariff-setting, and some of them have also been covered in this study.In addition, other documents available in the public domain, including the Power Sector Rating Report, prepared by the Ministry of Power, Annual Report on the Regulation in practice: impact of tariff orders on the Indian electricity sector Working of State Electricity Boards and Electricity Departments, 1 and the Report on Restructuring of APDRP (Accelerated Power Development and Reform Programme),2 were also studied.
