This book investigates when detention became a centerpiece of U.S. immigration policy, revealing why the practice was reinstituted in 1981 after being halted for several decades and how the system expanded to become the world’s largest immigration detention regime. From the Krome Detention Center in Miami to Guantanamo Bay, Cuba, and to jails and prisons across the country, Haitians have been at the center of the story of immigration detention. When an influx of Haitian migrants and asylum seekers came to the U.S. in the 1970s, the government responded with exclusionary policies and detention, setting a precedent for future waves of immigrants. Carl Lindskoog details the discrimination Haitian refugees faced and how their resistance to this treatment—in the form of legal action and activism—prompted the government to reinforce its detention program and create an even larger system of facilities. Book excerpt: This article begins by stating that Haitian refugees who seek safe haven in the United States find instead that they are singled out for special discrimination by the government. The author, staff attorney at the Haitian Refugee Center, Inc., states that the Immigration and Naturalization Service (INS) 'routinely dismisses Haitians as solely 'economic migrants', unworthy of political refugee status'. Ms Little then goes on to give a summary analysis of some of the obstacles and conditions refugees face, whether interdicted at sea or interned in detention camps inside the United States. As for interdiction, she examines the actions of the United States Government in the last eight years following the Haitian Migrant Interdiction Operation Treaty (HMIO). She overviews the history of the treaty before describing its implementation through the interview process and the general problem of the protection of the legal rights of the interdicted Haitians. In the section of the article on the detention of Haitian refugees, the author examines the 'restrictive parole policy' of the INS. In addition, Ms Little describes conditions at the Krome North Processing Center in Miami, Florida, as reported by private attorneys and Haitian detainees. A description is also given of the conditions under which Haitian detainees were transferred from Florida to Louisiana and Texas. The remainder of the article analyses the obstacles to be overcome for obtaining legal representation for Haitian detainees. In the conclusion, the author says that 'The current INS policy of interdiction and detention of the Haitians is not only inhuman and unjust, it is also ineffective in its failure to address the reality of political repression in Haiti'.

Book excerpt: In response to a congressional request, GAO reviewed certain policies and practices of the Immigration and Naturalization Service (INS) related to the detention of aliens seeking asylum in the United States, INS detention policy, the selection of detention sites, the physical and health conditions of detention facilities, and the total Government cost for the detention of Haitian immigrants. In recent years, INS has taken into custody an increasing number of aliens attempting to enter the United States illegally. Before May 1981, INS released or paroled excludable aliens who were not considered a security risk. However, after that date, INS began to routinely detain excludable aliens for long periods. The rights of excludable aliens have been greatly enhanced in recent years by litigation. However, this litigation has resulted in the temporary suspension of exclusion hearings, thus delaying the hearing process. After a court declared that the new detention policy was null and void, INS has remedied a procedural issue concerning public notice but has remained committed to a strict detention policy. However, INS was not prepared to provide care for so many individuals for so long. Detainees at times live under severely crowded conditions without basic amenities and services. Two detention facilities are presently being used for Haitian aliens and construction of one more facility is being planned. Long-term detention of Haitians costs the Government about $49 a day per detainee, compared with costs for short-term detention which ranges from $12 to $18 per day in other INS facilities. GAO believes that INS should work to achieve better alternatives than the extremes that detention and parole now offer.

It is directed against one particular group of boat people - Haitians. There will, however, be some brief references to related United States programs and to US interdiction of non-Haitians.Haitian asylum seekers began arriving in the United States by boat as early as 1963. The numbers started becoming significant in the 1970s and surged dramatically in 1980 and 1981. The Haitians were fleeing persecution, poverty, and in some cases both. In response to the influx, in 1981 President Reagan entered into an agreement with the Haitian government.This paper will discuss the asserted justifications for interdiction, the resulting policy and legal problems, and the consequences of combining interdiction with related non-entreacute;e policies, such as detention, expedited removal, and other practices. It will suggest that the combination of measures is more lethal than the sum of its parts, sometimes leaving refugees with no acceptable options. If interdiction must be used, it will be argued, adequate provision for full and fair refugee status determinations is critical.

General reflections on US asylum policy are offered. This is followed by a set of conclusions and recommendations relating to safe haven, interdiction, access to counsel, deterrence and conditions of detention.
