Book excerpt: Access to works in the public domain is an important source of human creativity and autonomy, whether in the arts, scientific research or online discourse. But what can users actually do with works without obtaining the permission of a copyright owner? Readers will be surprised to find how many different kinds of permitted usage exist around the world. This book offers a comprehensive international and comparative account of the copyright public domain. It identifies fifteen categories of public rights and gives a detailed legal explanation of each, showing how their implementation differs between jurisdictions. Through this analysis, the authors aim to restore balance to copyright policy debates, and to contribute to such debates by making practical law reform proposals. A major intervention in the field of intellectual property law and copyright, this book will appeal to lawyers, scholars and those involved in the administration of copyright law.

Download or read book United States Code written by United States and published by . This book was released on 2013 with total page 1146 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Download or read book The International Guide to Legal Deposit written by Jan T. Jasion and published by Routledge. This book was released on 2019-05-23 with total page 303 pages. Available in PDF, EPUB and Kindle. Book excerpt: First published in 1991, this volume aims to take a close look at the laws of 27 countries to locate what others value in the realm of legal deposit and heighten our awareness of its importance for free access to information. It responds to the great concern over the freedom of the press, the end of censorship and absolute government secrecy, and guaranteed public access to information. The term ‘legal deposit’, known in the UK and several former-British Empire countries as ‘copyright deposit’, originated in France in 1537 and has spread throughout the world, though the definition of the term remains questionable. Jan T. Jasion examines this through three parts: various aspects of legal deposit, comparing legal deposit worldwide and a detailed examination of the laws of 27 countries to compare the various national interpretations of legal deposit.

Download or read book Electronic Legal Deposit written by Paul Gooding and published by Facet Publishing. This book was released on 2020-10-02 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: Legal deposit libraries, the national and academic institutions who systematically preserve our written cultural record, have recently been mandated with expanding their collection practices to include digitised and born-digital materials. The regulations that govern electronic legal deposit often also prescribe how these materials can be accessed. Although a growing international activity, there has been little consideration of the impact of e-legal deposit on the 21st Century library, or on its present or future users. This edited collection is a timely opportunity to bring together international authorities who are placed to explore the social, institutional and user impacts of e-legal deposit. It uniquely provides a thorough overview of this worldwide issue at an important juncture in the history of library collections in our changing information landscape, drawing on evidence gathered from real-world case studies produced in collaboration with leading libraries, researchers and practitioners (Biblioteca Nacional de México, Bodleian Libraries, British Library, National Archives of Zimbabwe, National Library of Scotland, National Library of Sweden). Chapters consider the viewpoint of a variety of stakeholders, including library users, researchers, and publishers, and provide overviews of the complex digital preservation and access issues that surround e-legal deposit materials, such as web archives and interactive media. The book will be essential reading for practitioners and researchers in national and research libraries, those developing digital library infrastructures, and potential users of these collections, but also those interested in the long-term implications of how our digital collections are conceived, regulated and used. Electronic legal deposit is shaping our digital library collections, but also their future use, and this volume provides a rigorous account of its implementation and impact.

Download or read book The Government and Copyright written by John S Gilchrist and published by Sydney University Press. This book was released on 2015-09-01 with total page 309 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Government and Copyright: The Government as Proprietor, Preserver and User of Copyright Material Under the Copyright Act 1968 focuses on the interplay between law, policy and practice in copyright law by investigating the rights of the government as the copyright owner, the preserver of copyright material and the user of other's copyright material under the Copyright Act 1968 (Cth). The first of two recurring themes in the book asks the question whether the needs and status of government should be different from private sector institutions, which also obtain copyright protection under the law. The second theme aims to identify the relationship between government copyright law and policy, national cultural policy and fundamental governance values. "As the first authoritative treatise on government copyright to be published in Australia, this book will be of immediate interest and relevance to Australian lawyers and policy makers, particularly in the light of ongoing efforts to ensure that the intellectual property system stimulates innovation and fosters trade and investment. Given that government copyright is recognised to some extent in most countries worldwide, this book is a valuable contribution to the international literature on this topic, which remains sparse." From the Introduction by Dr Anne Fitzgerald and Prof. Brian Fitzgerald
