Book excerpt: Esta obra presenta el tratamiento seguido por la legislación y la jurisprudencia nacional al tema relacionado con los aspectos patrimoniales surgidos de la relación de pareja, partiendo de la sociedad conyugal nacida por el matrimonio, resaltando los aspectos más importantes como su definición, características, bienes que entran a formar parte del haber, las obligaciones comunes, los bienes propios y deudas de cada uno de los cónyuges; las recompensas que surgen a favor de uno de los cónyuges o de la sociedad conyugal, la forma como se deben liquidar dichas recompensas; disolución de la sociedad conyugal, causales y efectos, liquidación de la sociedad conyugal, la forma de realizarla y sus diferentes aspectos; las capitulaciones matrimoniales, la forma de elaborarlas y sus efectos. Luego, se trata el tema de la sociedad patrimonial entre compañeros permanentes surgida de la unión marital de hecho, que reúna los requisitos exigidos en el artículo 2.° de la Ley 54 de 1990 modificada por la Ley 979 de 2005, su similitud y diferencias con la sociedad conyugal, para termi nar con la sociedad de hecho surgida de la relación de pareja que no reúna los requisitos exigidos por la Ley 54 de 1990, tomando como fundamento el Código de Comercio y la jurisprudencia nacional. Para una mejor comprensión, se presenta el tema desde el punto de vista sustancial y procesal incluyendo algunos ejemplos de la manera como se debe proceder a la liquidación de la sociedad conyugal, que es el mismo tratamiento empleado para la liquidación de la sociedad patrimonial, con las particularidades propias de cada institución.

Book excerpt: The primary focus of this book is on criminal violence of both mentally disordered and criminal inmates, whose histories of criminal violence raise serious societal concerns about the commission of future acts of violence. It is difficult for legal experts, psychologists, and policy makers to make decisions that strike the proper balance between an offender's civil liberties and community safety. Such a balance requires an accurate assessment of the likelihood that an individual offender will commit a new violent or sexual offense. On the basis of their research on mentally disordered offenders, sex offenders, fire setters, and psychopathic offenders, the authors have devised an actuarial assessment instrument, the Violence Risk Appraisal Guide. The authors argue that risk management can be improved by combining what is already known about predicting violence, clinical decision making, and program evaluation. They conclude that the results of their applied research have implications for our understanding of the etiology of violent criminal behavior.
